Abstract

This article aims to introduce The Hague Principles 2015 to the discourses of choice of law and private international law in Indonesia. Various attempts to harmonize choice of law have been undertaken since the second half of the twentieth century. Those attempts remain to continue to the twenty-first century and are marked, among others, by the issuance of The Hague Principles 2015. This harmonization instrument has been drawing attention and debates due to its nature as a non-binding instrument, and some novel provisions it introduces that have never been explicitly addressed in the previous harmonization instruments on choice of law.Bahasa Indonesia Abstrak: Tulisan ini bertujuan untuk memperkenalkan The Hague Principles 2015 dalam diskusi-diskusi mengenai pilihan hukum dan hukum perdata internasional di Indonesia. Sejak paruh kedua abad ke-20 telah dimulai berbagai usaha untuk mengharmonisasi aturan-aturan mengenai pilihan hukum dalam kontrak. Usaha ini terus berlanjut di abad ke-21 dan ditandai salah satunya dengan terbitnya The Hague Principles 2015. Instrumen harmonisasi ini mengundang banyak perhatian dan perdebatan karena sifatnya sebagai sebuah instrumen yang tidak mengikat, dan beberapa ketentuan di dalamnya yang belum pernah diatur secara tegas dalam instrumen-instrumen harmonisasi mengenai pilihan hukum sebelumnya.

Abstract

ABSTRACTASEAN member countries will carry out the ASEAN Economic Community (AEC) in 2015. The ASEAN  Economic CommunityASEAN, the Political-Security Community and the ASEAN Socio-Cultural Community are the 3 main pillars of the ASEAN Community. Specifically, the purpose of the AEC is the liberalization of trade in goods and services, investment, capital and Labor flow in the South-East Asia region. In relation to the investment liberalization, ASEAN member countrieshave entered into the ASEAN ComprehensiveInvestment Agreement (ACIA). ACIA is designed with the purpose of creating an investment regime that is more free and open, in order to achieve economic integration in the South-East Asia region. One of the obstaclesencountered in the effort to achieve the purpose of the ACIA is the legalisation process of foreign public documents. The legalisation process for foreign public documents is a complicated process, time-consuming and very costly. The Hague Convention Abolishing the Requirement for Legalisation for Foreign Public Documents 1961(Apostille Convention) regulates the simpler, less time-consuming and less costly. However, Brunei Darussalam is the only ASEAN member countries who party to this convention. Considering the objectives to be achieved within the framework of the AEC in 2015 and to create a conducive regime for investment activities in the South-East Asia region, accession of the ASEAN members to the Apostille Convention is inevitably required. Keywords: AEC 2015, Apostille, Investment.  ABSTRAK Pada tahun 2015, negara-negara anggota ASEAN akan merealisasikan Masyarakat Ekonomi ASEAN (MEA). Bersama dengan Masyarakat Politik dan Keamanan ASEAN (ASEAN Political-Security Community) dan Masyarakat Sosial dan Budaya ASEAN (ASEAN Socio-Culture Community), MEA menjadi 3 pilar dalam pembangunan Masyarakat ASEAN. Tujuan dari MEA adalah adanyaliberalisasidibidang perdaganganbarang dan jasa, investasi, aliran modaldan tenaga kerjadi wilayahAsiaTenggara.Sehubungan dengan tujuan liberalisasi di bidang investasi, negara-negara anggota ASEAN telah menyepakati ASEAN Comprehensive Investment Agreement (ACIA). ACIA dirancang dengan tujuan untuk menciptakan suatu rezim investasi yang lebih bebas dan terbuka, demi tercapainya integrasi ekonomi di wilayah ASEAN. Salah satu hambatan yang dihadapi dalam usaha untuk mencapai tujuan ACIA adalah adanya keberadaan proses legalisasi dokumen publik asing yang berbelit-belit, dan memerlukan waktu dan biaya yang tidak sedikit. Proses legalisasi yang lebih sederhana dengan waktu dan biaya yang lebih sedikittelah diatur secara komprehensif dalam The Hague Convention Abolishing the Requirement for Legalisation for Foreign Public Documents 1961 (Apostille Convention). Namun demikian, Brunei Darussalam adalah satu-satunya negara anggota ASEAN yang telah menjadi peserta dari konvensi ini. Dengan mempertimbangkan tujuan yang hendak dicapai dalam rangka MEApada tahun 2015 dankelancaran dalam kegiatan investasi di wilayah regional ASEAN, aksesi negara-negara anggota ASEAN terhadap Apostille Conventionmerupakan suatu kebutuhan yang tak terhindarkan. Kata Kunci: MEA 2015, Apostille, Investasi

Abstract

Law Number 24 of 2009 on National Flag, Language, Emblem, and Anthem of Indonesia requires that any contract involving an Indonesian party must be drafted in Indonesian. In applying this law, the Supreme Court of the Republic of Indonesia, in Nine AM v. PT Bangun Karya Pratama Lestari judgment, annulled a loan agreement because it was considered to violate the language requirement. Although claiming to strengthen the use of Indonesian language in a contract, this judgment underscores a potential risk of voidance a foreign party face in entering into an agreement drafted in a foreign language when contracting with an Indonesian counterparty. On the other side of the hemisphere, the Court of Justice of the European Union in Anton Las v. PSA Antwerp NV and New Valmar BVBA v. Global Pharmacies Partner Health Srl drew the public attention to the obligation to use Dutch in employment contract and company documents as imposed in the Dutch-speaking region of Belgium. Despite Indonesia and Belgium being geographically far from each other, the abovementioned judgments underline the phenomenon that national language still plays an important role in influencing cross-border legal relations. This article seeks to explore the legal impacts of the obligation to use national language in contracts has on freedom of parties to contracting. It further argues that this obligation impedes international contracting.

Abstract

Given the divergence of conflict of laws rules and recognition of foreign judicial decisions, a harmonized rules of conflict of laws is highly anticipated to improve legal certainty and cross-border commercial transactions. This book aims to provide a comprehensive overview of various approaches to conflict of laws of fourteen jurisdictions in East and South East Asia. It emphasizes that an understanding on the different frameworks toward conflict of laws in the region is necessary to encourage the harmonization attempts in the future. Corporate counsels, officials, policymakers, and other practitioners outside East and South East Asia are the intended readers of this book. Thus, the information specified in this book is also purposed to assist the ease of doing cross-border transactions inside and outside the region.

Abstract

The historical background of contractual choice of law is still hardly discussed in the literature of Indonesian private international law. The available literature merely focuses on the scope and limitation of the choice of law. The choice of law is accepted and discussed as a widely acknowledged doctrine without sufficiently addressing its origin and evolvement until it became the concept as we understand to date. Employing an exposition through the academic literature, this article studies the narrative that began the idea of contractual choice of law up to the end of the 19th century as an intricate idea in private international law.

Abstract

Wrongful removal or retention of a child outside the state of his or her habitual residence is known as international child abduction. The Hague Convention on the Civil Aspects of International Child Abduction 1980 established procedures to ensure the prompt return of the internationally abducted child to the state of his or her habitual residence. By discussing the international child abduction cases involving Indonesia, this article demonstrates the obstacles in returning those internationally abducted children. This discussion is undertaken by taking into account the difference in qualifying the concept of international child abduction in Indonesian law and the Hague Convention 1980.

Abstract

Salah satu hal krusial yang tak dapat dihindari dari penyelesaian sengketa perdata lintas batas negara adalah adanya kebutuhan penyampaian dokumen peradilan ke dan dari luar negeri. Sebab persoalan ini umumnya merupakan bagian dari ketentuan hukum acara perdata nasional, setiap negara mempunyai ketentuan dan prosedur yang berbeda-beda untuk penyampaian dokumen peradilan ke dan dari luar negeri. Oleh karenanya, sebagian besar negara telah menjadi peserta dari HCCH 1965 Service Convention. HCCH 1965 Service Convention adalah instrumen internasional yang menyediakan prosedur yang sederhana dan dapat memfasilitasi berbagai dimensi yang perlu diperhatikan dalam penyampaian dokumen peradilan ke dan dari luar negeri. Artikel ini bertujuan membahas relevansi HCCH 1965 Service Convention untuk Indonesia dalam penyampaian dokumen peradilan perdata ke dan dari luar negeri. Pembahasan ini didasarkan atas dua pertimbangan, yaitu masih rumitnya prosedur penyampaian dokumen peradilan perdata dari Indonesia ke luar negeri dan sebaliknya, dan Indonesia belum menjadi negara peserta HCCH 1965 Service Convention.
