Abstract

Nowadays, youth is an important asset for the next generation of Nation and Religion, but it should be noted that there are so many disturbances that usually come at any time, one of which is technology. The youth of the Masjid Dusun Banjaranyar mostly have religious education experience a sluggishness in activities, because the mosque, which is supposed to be the center of education, is not given much attention, and there are rarely activities or even none. We focus on this program in developing Hadroh Arts skills and reading Mawlid, this activity involves mosque youth and youth youth organizations. This program is pursued through several stages, namely: Appreciative Inquiry (AI); Discovery; Visioning; Asset Mapping; Mobilization (Action Planning), Monitoring and Evaluation. The method used is service learning, including learning strategies, teaching, and reflecting. The result of this service is the impact of changes from each participant, this can be seen from the results of the pre-test and post-test assessments carried out. Changes from each participant began to improve a lot, this was also seen after conducting a posttest assessment with routine exercise twice a week, everything became more evenly distributed.

Abstract

This article aims to analyse the relevance of the position of the Supreme Court in relation to the Religious Courts within the national legal system, the role of the Supreme Court in the guidance and supervision of Religious Courts, and the review of the Supreme Court Regulation Number 5 of 2019 on Guidelines for Adjudicating Marriage Dispensation Applications. The approach used in this study is a normative juridical approach with a descriptive-analytical nature. The primary data source in this research is Supreme Court Regulation (PERMA) Number 5 of 2019, while secondary sources include books and articles relevant to the discussion. The data analysis technique employs content analysis. To test the validity of the data, triangulation is used along with an expanded reference base. The research results show that this "one roof" coaching aims to ensure that judicial power is exercised independently, responsibly, and without influence from the executive or other parties, thereby improving the judicial system, making it more integrated, and operating under a single command. As the Religious Courts are under the same roof as the Supreme Court, the role of judicial guidance is emphasised in Law Number 3 of 2006. Regarding technical guidance, this involves directions, particularly in the application of law by judges, carried out through various channels and methods. Meanwhile, the study of the Supreme Court Regulation Number 5 of 2019 indicates that the Supreme Court plays a key role in maintaining consistency, justice, and legal certainty in handling marriage dispensation cases in the Religious Courts, helping to preserve the integrity of the religious judicial system and ensuring that each marriage dispensation request is handled fairly and in accordance with the prevailing laws.

Abstract

Nikah Mut'ah contract is when a man marries a woman by specifying the length of their marriage period, whether it is a day, a week, or a month, or other time limits. That mut'ah marriage was once allowed by the Prophet PBUH is not denied by Ahlu Sunnah scholars. There are reports that mention the practice of mut'ah marriage at the time of the Prophet, but there are also many reports that confirm that mut'ah marriage has been cancelled. The schools of Maliki, Shafi'I, Hanafi and Hambali agree that mut'ah marriage or contract marriage is haram and invalid. Imam Shafi'i said, Mut'ah marriage which is prohibited is all marriages that are limited by time, either in the short term or long term, while Imam Nawawi said, Mut'ah marriage is not allowed, because marriage is basically a mutlaq aqad, so it is not valid if it is limited by time.
