Abstract

The need for a very complete and fluctuating society is impossible to make the codification of the law perfectly. One of the difficultiy is the difference between local customs that are not the same as the customs of the old (Arab customs). The change here is not only about values alone but also can affect changes to religious (Islamic) law. The results of this study indicate that custom can be used as a Hujjah in Islamic law as long as there are not Sharih explanation of a particular case, contradicting the qhat'iy proposition of muqayyad (not absolute, and typically (uncommon) nash. Based on the results of this study, it is advisable to the legal practitioners when they want to decide on the law, put to their customs forward rather than directed to the customs other than them, so that it can provide a verdict that can be undertaken by the community.

Abstract

Empirically transcendental communication creates inner experiences for humans. Humans as communicators convey messages in prayer as a medium of communication against God as an absolute communicator. The effect in transcendental communication felt by humans is inner peace or tranquility of the soul. In Islamic epistemology methodically known methods of thinking bayani, burhani and irfani. Burhani is a framework for thinking that is not based on sacred texts, nor experience. The aim of the viewfinder is exoteric, so the way it works is based on logic wrangling. Irfani is a thinking methodology model based on direct experience and approaches to religious spiritual reality. With Burhani's methodical reasoning humans use their minds in analyzing empirical events that are seen, heard and felt. But reason alone is not enough in processing human experience. then with the method of intuition or irfani use the heart to feel the inner experience that humans pass in each event of his life. The union with his Lord in prayer, which is manifested in his prayers, fasting and other worship become part of the process of human transcendental communication

Abstract

This paper is the result of field research on "Review of Islamic Law on Salam Contracts with Online Systems at the Indra CMP Asembagus Situbondo Online Shop", this study aims to answer questions about:, How is the implementation of salam contracts with online systems at Indra CMP Asembagus online shop Situbondo Asembagus Situbondo. and, How is the Islamic law review of the salam contract with the online system at Indra CMP Asembagus Situbondo's online shop. This study uses a qualitative method. The results of the study conclude that the relationship of the parties in the salam contract agreement with the online system is the same as the usual salam contract agreement. However, the sale and purchase of salam contracts with an online system does not meet directly between buyers and sellers, it's just that the perpetrators of the contract are brought together in one internet network site. In Islamic law, a sale and purchase contract is allowed to enter into a contract using writing (letters) on the condition that the two parties are far apart from each other or the contract actors are silent, for the perfection of the contract it is required that the other person addressed by the writing is willing to read the writing. A review of Islamic law on salam contracts with an online system can be concluded that online salam contracts are allowed as long as they do not contain elements that can damage them such as usury, injustice, fraud, fraud and the like and fulfill the pillars and conditions in buying and selling.
