Abstract

Penelitian ini merupakan jenis penelitian lapangan yang bersifat kualitatif. Data primer adalah data yang diperoleh dari pemilik butik Shopie Fashion Sukorejo dan karyawan serta konsumen butik Shopie Fashion Sukorejo Situbondo. Data sekunder adalah buku-buku refrensi yang akan melengkapi dokumentasi yang telah ada. Metode pengumpulan data yang penulis gunakan adalah wawancara, telaah, dokumen, dan observasi. Dalam menganalisis data, peneliti menggunakan teknik analisis data kualitatif. Hasil penelitian menunjukkan bahwa ditinjau dari perspektif marketing syariah, Karakteristik marketing syari’ah dalam menghadapi persaingan bisnis yang diterapkan oleh Butik Shopie Fashion adalah ketuhanan (tauhid), yaitu dapat membentengi diri dengan nili-nilai spiritual. Akhlak yaitu dengan berperilaku baik dan simpatik, bersikap adil, jujur tidak curang dan bekerja secara profesional, realistis yaitu dengan fleksibel dalam bergaul, humanistis yaitu dengan menjadikan pembeli sebagai raja dan ramah kepada pelanggan. Dan cara butik shopie menghadapi persaingan yaitu dengan cara mmperluas pasar, promosi yang tepat, memiliki harga yang kompetetif dan melakukan pelayanan yang terbaik.

Abstract

Buying and selling to win arisan is a type of arisan that uses the lottery method at a time that has been determined or agreed upon by all arisan members. However, with the passage of time human needs change. This is because of the fulfillment of needs that must be met immediately, thus making some people try to get money in a fast and easy way to go. By practicing buying and selling, winning the social gathering is one way to meet needs. Based on the results of this study, it can be seen that the practice of buying and selling social gathering wins with the lottery method that occurs in Banyuputih Village, Banyuputih Subdistrict, there is an additional payment without any agreement. According to the Shafi'i madhhab, additional payments that occur in the sale and purchase of winning social gatherings are legal, because the additional payment is a form of gratitude to the seller for wanting to help in trouble. In buying and selling transactions, the social gathering is based on the principles of consensual and mutual help and in accordance with sharia law.

Abstract

This paper is the result of field research on "Review of Islamic Law on Salam Contracts with Online Systems at the Indra CMP Asembagus Situbondo Online Shop", this study aims to answer questions about:, How is the implementation of salam contracts with online systems at Indra CMP Asembagus online shop Situbondo Asembagus Situbondo. and, How is the Islamic law review of the salam contract with the online system at Indra CMP Asembagus Situbondo's online shop. This study uses a qualitative method. The results of the study conclude that the relationship of the parties in the salam contract agreement with the online system is the same as the usual salam contract agreement. However, the sale and purchase of salam contracts with an online system does not meet directly between buyers and sellers, it's just that the perpetrators of the contract are brought together in one internet network site. In Islamic law, a sale and purchase contract is allowed to enter into a contract using writing (letters) on the condition that the two parties are far apart from each other or the contract actors are silent, for the perfection of the contract it is required that the other person addressed by the writing is willing to read the writing. A review of Islamic law on salam contracts with an online system can be concluded that online salam contracts are allowed as long as they do not contain elements that can damage them such as usury, injustice, fraud, fraud and the like and fulfill the pillars and conditions in buying and selling.
