Abstract

This research aims to know what factors that motivates the society occupying that plantation area at Tanah Abang village, District of Talo, Seluma Regency, Province of Bengkulu and efforts or patterns of conflict settlement that have been done. This research is empirical law research. This research is empirical legal research. The data is used in this research is primary data which is gathering directly from observation subject utilizing questionnaire for respondent and interview for the sources. Secondary data is gotten from literature and document study. And then, those data are analyzed in qualitative descriptive. The results arefirst, factors that motivate conflict happened is inconsistency of both company in performing the fixed rules especially about land releasing, local official mentality particularly village leader that took advantage of the situation to get individual profit, there is no apparent border either village or district, and many neglected land that cause other person inside or outside the area occupatied the land.Second, effrot or pattern that has been done to solve conflict is: outside the court that still doesn’t reach final result yet.

Abstract

Acquired land questions that are not as per clear arrangements, bringing about irreconcilable circumstances between families. This is known as a "land debate". Land debates are land questions between people, legitimate substances or organizations that don't have an expansive socio-political effect. The goals of this examination are 1) To decide the execution of intercession by the Office of Spatial Agrarian Affairs/National Land Agency of Boyolali Regency in the settlement of legacy debates. 2) Knowing the hindrances in the execution of legacy question settlement intercession by the Office of Spatial Agrarian Affairs/National Land Agency of Boyolali Regency. 3) Knowing the job of an outsider as a go between. The exploration approach utilized in this examination is an observational juridical methodology. This exploration is clear examination. The sort of information utilized is essential information utilizing essential, auxiliary and tertiary legitimate materials. Strategies for gathering information through interviews, documentation, writing study and other inquiries identified with the object of exploration. The information investigation strategy utilized enlightening subjective. The consequences of the exploration are 1) The most common way of carrying out the intervention completed by the Agrarian and Spatial Planning Office/National Land Agency of Boyolali Regency is as per the arrangements in the Regulation of the Minister of Agrarian and Spatial Planning/Head of the National Land Agency Number 21 of 2020 concerning Handling and Settlement of Land Cases which incorporate : Case study; Initial case title;' Recorded aftereffects of starting case title; Mediation; Final case degree; Minutes of case settlement. Imperatives looked during the time spent carrying out the intervention The shortfall of the respondent and the whereabouts of the litigant is obscure. 3) The Agrarian and Spatial Planning Office/National Land Agency of Boyolali Regency generally includes an outsider in helping the smooth course of intervention. From the consequences of the investigation, it is suggested that the Division of control and treatment of debates in the Agrarian and Spatial Planning Office/Land Agency of Boyolali Regency should lead an assessment after every intercession is completed so the execution of additional intervention can run as expected and agree and harmony between the gatherings. Memperoleh pertanyaan tanah yang tidak sesuai pengaturan yang jelas, membawa situasi yang tidak dapat didamaikan antara keluarga. Ini dikenal sebagai "debat tanah". Debat tanah adalah pertanyaan tanah antara orang-orang, elemen atau yayasan yang sah yang tidak memiliki efek sosial-politik yang luas. Tujuan dari penelitian ini adalah 1) Untuk memutuskan pelaksanaan intervensi oleh Badan Usaha Pertanahan Tata Ruang/Kantor Pertanahan Umum Rezim Boyolali dalam penyelesaian sengketa warisan. 2) Mengetahui hambatan dalam pelaksanaan intervensi penyelesaian debat warisan oleh Badan Penataan Ruang Agraria/Organisasi Pertanahan Umum Rezim Boyolali. 3) Mengetahui pekerjaan orang luar sebagai perantara. Pendekatan pemeriksaan yang digunakan dalam penelitian ini adalah metodologi yuridis observasional. Pemeriksaan ini jelas eksplorasi. Jenis informasi yang digunakan adalah informasi penting yang menggunakan bahan-bahan yang penting, tambahan dan tersier yang halal. Teknik pengumpulan informasi melalui wawancara, dokumentasi, studi penulisan dan kegiatan lain yang diidentifikasi dengan objek eksplorasi. Strategi investigasi informasi yang digunakan jelas subjektif. Akibat dari penyidikan tersebut adalah 1) Cara pelaksanaan intervensi yang paling umum dilakukan oleh Kantor Pertanahan dan Tata Ruang/Kantor Pertanahan Kabupaten Boyolali telah sesuai dengan pengaturan dalam Pedoman Imam Masalah Agraria dan Penataan Ruang/Atas Peraturan Pertanahan Umum Nomor 21 Tahun 2020 tentang Penanganan dan Penyelesaian Perkara Pertanahan yang memuat : Analisis kontekstual; Judul kasus awal;' Efek samping dari rekaman judul kasus yang mendasarinya; Perantaraan; gelar kasus terakhir; Berita acara penyelesaian kasus. Keterbatasan yang dialami dalam siklus syafaat Kekurangan termohon dan keberadaan penggugat tidak jelas. 3) Tempat Kerja Penataan Agraria dan Tata Ruang/Pertanahan Umum Peraturan Daerah Boyolali biasanya melibatkan pihak luar dalam membantu kelancaran siklus intervensi. Dari hasil pemeriksaan, direkomendasikan agar pembagian penguasaan dan perlakuan perdebatan di Kantor Agraria dan Tata Ruang/Kantor Pertanahan Rezim Boyolali harus memimpin penilaian setelah setiap syafaat selesai sehingga dapat dilakukan intervensi lebih lanjut. berjalan sesuai harapan dan sepakat serta harmonis antar pertemuan.

Abstract

Village Assets are one of the assets belonging to the Village Government that are utilized and managed for a business activity which will later become one of the sources of Village income. One of the village assets that can be managed by the village is in the form of village treasury land. In the management of this Village Cash Land, it must be in accordance with the provisions of the applicable laws and regulations. However, there are often cases of abuse in the management of Village Treasury Land by the Village Head, therefore there is a need for law enforcement in the problem of misuse of Village Treasury Land management. The purpose of this study was to find out about the management of Village Cash Land by the Village Head in Pusporenggo Village, Musuk District, Boyolali Regency and to find out the obstacles faced in managing Village Cash Land in Pusporenggo Village, Musuk District, Boyolali Regency. The research method used in this study is a research with an empirical juridical approach, where the data are taken directly and real from the results of interviews and literature studies. The results of research on the management of village treasury land in Pusporenggo Village have been carried out in accordance with the Regulation of the Minister of Home Affairs Number 1 of 2016, which is managed through leases and cooperation in the use of buildings for handover, namely in the form of renting shop houses, renting land for agriculture, building construction. Meetings that are rented out for receptions, construction of dams in cooperation with PDAM, and construction of soccer fields. In managing the village treasury land in Pusporenggo Village, it is through an auction system. The obstacle in managing village treasury land in Pusporenggo Village is that there are still many tenants who violate the contents of the lease agreement that was agreed upon at the beginning, namely the rent payment is in arrears by the tenant. It is hoped that the Village Government will give strict sanctions to village treasury land tenants who are in arrears in their rent payments. Aset Desa adalah merupakan salah satu kekayaan milikPemerintah Desa yang dimanfaatkan dan dikelola untuk suatu kegiatan usaha yang nantinya akan menjadi salah satu sumber pendapatan Desa. Salah satu aset desa yang dapat dikelola oleh desa adalah berupa tanah kas desa. Dalam pengelolaan atas Tanah Kas Desa ini haruslah sesuai dengan ketentuan dalam peraturan perundang-undangan yang berlaku. Akan tetapi seringkali terjadi beberapa kasus terhadap penyalahgunaan dalam pengelolaan Tanah Kas Desa oleh Kepala Desa, maka dari itu perlu adanya penegakan hukum dalam permasalahan penyalahgunaan pengelolaan Tanah Kas Desa. Tujuan penelitian ini adalah untuk mengetahui tentang pengelolaan Tanah Kas Desa oleh Kepala Desa di Desa Pusporenggo Kecamatan Musuk Kabupaten Boyolalidan mengetahui hambatan yang dihadapi dalam pengelolaan Tanah Kas Desa di Desa Pusporenggo Kecamatan Musuk Kabupaten Boyolali.Metode penelitian yang digunakan dalam penelitian ini adalah penelitian dengan pendekatan yuridis empiris, dimana data diambil secara langsung dan nyata dari hasil wawancara dan studi pustaka. Hasil penelitian tentang pengelolaan tanah kas desa di Desa Pusporenggo telah berjalan sesuai dengan Peraturan Menteri Dalam Negeri Nomor 1 Tahun 2016, yaitu dikelola dengan melalui sewa dan kerjasama pemanfaatan bangun guna serah, yaitu berupa sewa bangunan ruko-ruko, sewa tanah untuk pertanian, pembangunan gedung pertemuan yang disewakan untuk acara resepsi, pembuatan embung kerjasama dengan PDAM, dan pembangunan lapangan sepak bola. Dalam pengelolaan tanah kas desa di Desa Pusporenggo ini dengan melalui sistem lelang. Adapun hambatan dalam pengelolaan tanah kas desa di Desa Pusporenggo adalah masih banyak penyewa yang melakukan pelanggaran terhadap isi perjanjian sewa yang telah disepakati di awal, yaitu menunggaknya pembayaran uang sewanya oleh pihak penyewa. Diharapkan Pemerintah Desa memberikan sanksi yang tegas kepada penyewa tanah kas desa yang menunggak pembayaran sewanya.
