Abstract

Banking has a strategic position as an intermediary institution andsupport payment system. To guarantee the loan or financing providedby the bank to the debtor or customer, the bank will charge thecollateral to the customer. In practice, credit already secured bycollateral is often carried out take-over. Take over is chosen by thecommunity because for various reasons, such as simple credit procedures and the time required is also relatively fast. This researchtries to analyze the responsibility of Notary in making takeoveragreement specially if loan / credit is secured with right of land. Themethod used in this research is normative. Where researchers get datafrom literature studies which will then be tested with legal principles.The result of the research shows that in the making of deed of take overagreement, in essence Notary has responsibility both morally and law.

Abstract

Dewan Perwakilan Daerah (DPD) merupakan lembaga baru hasil amandemen UUD 1945. DPD dilahirkankarena mempunyai gambaran kedepannya untuk checks and balances antar lembaga-lembaga negara. Hal inibertujuan agar lembaga-lembaga negara lebih efektif dibandingkan pada masa Orde Baru. Di Indonesia,Dewan Perwakilan Rakyat biasanya disingkat dengan (DPR) dan Dewan Perwakilan Daerah yang sering disingkat dengan (DPD) merupakan representasi rakyat Indonesia yang memiliki fungsi legislatif, anggarandan pengawasan, agar terwujudnya negara Indonesia yang demokratis dan sejahtera. Dalamimplementasinya, meskipun merupakan lembaga perwakilan rakyat yang dipilih melalui Pemilu, namunfungsi dan kewenangan DPD masih lemah dari pada DPR (vide Pasal 22D UUD 1945). Realitaskonstitusional seperti ini memerlukan pemikiran lebih lanjut terkait bagaimana dua lembaga ini dapatberfungsi lebih ideal dan saling melengkapi.

Abstract

Islamic banking is experiencing growth both in Indonesia and in the world. In Indonesia, the growth of the number of Islamic bank offices continued to grow. This shows that community needs for Islamic banks are very high. The government of course has to deal with this development. The most substantial improvement is the existence of policies regarding the regulation of Islamic banking. This is very important because the banking sector is very sensitive, especially the possibility of a dispute between the customer and the bank is also quite large. These disputes must eventually be resolved by both parties, namely the bank and the customer because both of these parties have the same position as the parties concerned. This study aims to describe the competence of the Religious Courts in resolving sharia banking disputes as well as knowing the obstacles faced by the Religious Courts in deciding Islamic banking disputes. The type of research used is empirical juridical. The results of the study can be a reference for further research and become a reference source for related subjects.
