Abstract

Peran masyarakat sangat penting dalam pembangunan nasional, adapun hal yang dapat dilakukan dalam membantu pembangunan dapat diwujudkan dengan mendirikan berbagai macam usaha. Banyak bidang usaha yang dapat dilakukan oleh para pelaku usaha di Indonesia bukan hanya dalam bentuk barang emlainkan juga jasa. Di dunia usaha jasa, persaingan akan selalu ada dan semakin hari semakin ketat. Hal tersebut merupakan ancaman bagi kelangsungan hidup sebuah perusahaan, tetapi disisi lain justru memberikan peluang bagi para pengusaha dan terpacu untuk mengembangkan bisnisnya. Namun ternyata dalam perjalanan bisnis, seringkali terjadi permasalahan yang disebabkan oleh pengguna jasa, sebagai contoh adalah jasa perbaikan kapal yang juga tidak lepas dari potensi wanprestasi yang dilakukan oleh pengguna jasa perbaikannya. Penelitian ini menggunakan jenis penelitian yuridis normative yaitu dilakukan dengan cara menelaah dan menginterpretasikan hal-hal yang bersifat teoritis yang menyangkut asas, konsepsi, doktrin dan norma hukum yang berkaitan dengan perlindungan konsumen dan perjanjian. Analisis data dalam penelitian ini menggunakan analisis kualitatif. Berdasarkan hasil analisis ditarik kesimpulan secara deduktif, yaitu cara berpikir yang didasarkan pada fakta-fakta yang bersifat umum untuk kemudian ditarik suatu kesimpulan bersifat khusus.

Abstract

Informed consent bertujuan tidak hanya untuk melindungi pasien dari kesewenangan dokter, tetapi juga diperlukan untuk melindungi dokter  dari kesewenangan pasien yang melanggar batas-batas hukum dan perundang-undangan. Kasus terjadinya konflik antara pasien dengan dokter sudah banyak terjadi dimasyarakat. Masing-masing berpegang pada keyakinan mengenai kebenaran, sehingga dengan informed consent dapat diketahui bahwa terdapat keseimbangan yang ingin dicapai baik bagi dokter maupun pasien serta hubungan hukum  antara dokter dengan pasien. Permasalahan dalam penelitian ini adalah bagaimana pengaturan kewajiban dokter terhadap informed consent dalam praktik kedokteran. Tujuan penelitian ini untuk mengetahui pengaturan kewajiban dokter terhadap informed consent dalam praktik kedokteran untuk mewujudkan perlindungan hukum terhadap pasien. Hasil penelitian bahwa pengaturan mengenai persetujuan tindakan medik berawal dari hubungan dokter dan pasien yang bersifat paternalistic terdapat pada Peraturan Menteri Kesehatan RI nomor 585/Menkes/Per/IX/1989 sebagaimana telah diperbarui dengan Permenkes nomor 290/Menkes/Per/III/2008, Undang-Undang Nomor 29 Tahun 2004 Tentang Praktik Kedokteran, serta Peraturan Pemerintah Nomor 32 Tahun 1996 Tentang Tenaga Kesehatan.

Abstract

This study examines the performance of Satpol PP officers in enforcing public order, with a particular focus on work discipline and ethical behavior as fundamental aspects of public service accountability. Despite a clear legal mandate given to Satpol PP, challenges remain in ensuring that law enforcement practices are carried out in accordance with ethical standards and professional norms. This study aims to analyze how the legal framework and organizational factors influence the actual implementation of public order enforcement by Satpol PP officers. This study uses a normative-juridical approach combined with empirical qualitative methods. The normative analysis was conducted by examining laws and regulations, codes of ethics, and standard operating procedures that govern the authority and duties of Satpol PP. Empirical data were collected through in-depth interviews, field observations, and document analysis involving Satpol PP officers and relevant stakeholders at the local government level. The collected data were analyzed using thematic analysis to identify patterns and discrepancies between legal norms and field practices. The findings indicate that the gap between normative regulations and empirical implementation is influenced by factors such as leadership practices, organizational culture, legal understanding, and internal oversight mechanisms. These factors significantly influence the consistency of discipline and ethical behavior in enforcing public order. This study makes a practical contribution by offering recommendations for strengthening legal compliance, ethical governance, and performance evaluation mechanisms within the Public Order Agency (Satpol PP). Theoretically, this research enriches empirical legal studies by integrating normative analysis with field-based evidence in the context of public order enforcement.

Abstract

Public order and community tranquility are essential prerequisites for social stability and high-quality public services. However, Public Order Agency (Satpol PP) personnel frequently encounter challenges in the field, including community conflicts, limited understanding of regulations, and insufficient persuasive communication skills in carrying out enforcement duties. Therefore, a structured competency-strengthening program is necessary to enhance the professionalism and effectiveness of Satpol PP personnel. This community service program aimed to improve the competencies of Satpol PP officers in regulatory understanding, persuasive communication, conflict management, and field decision-making. The program was implemented through training sessions, case simulations, group discussions, and practical mentoring involving 50 Satpol PP personnel. Evaluation was conducted using pre-tests and post-tests, participatory observations, and performance assessments during the training activities. The results demonstrated significant improvements in participants’ understanding of regulations and enforcement procedures, enhanced persuasive communication skills when interacting with the public, and better abilities to resolve conflicts in a humane and proportional manner. The average participant score increased from 68.4 before the training to 86.7 after the program. In addition, participants showed greater confidence and readiness to perform public order and community tranquility enforcement duties. The program also generated positive impacts on service quality, field coordination, and the institutional image of Satpol PP as a professional, humane, and accountable public agency. This initiative can serve as a sustainable capacity-building model for local government personnel in supporting effective public order and community tranquility management.

Abstract

The enforcement of regulations against street vendors by the Civil Service Police Unit (Satpol PP) often creates a dilemma between maintaining public order and protecting the livelihoods of informal-sector communities. This condition highlights the need to strengthen the capacity of Satpol PP personnel in exercising administrative discretion in accordance with the General Principles of Good Governance (AUPB). This community service program aimed to enhance the knowledge and practical capacity of Satpol PP personnel in Batam City to implement discretionary authority in a lawful, proportionate, accountable, and public-oriented manner. The program was conducted through problem identification based on document review and case studies of street vendor enforcement, followed by educational sessions, focus group discussions (FGDs), and mentoring activities to evaluate enforcement practices using five indicators of good governance: legality, conformity with the purpose of authority, administrative prudence, proportionality, and public benefit. The results showed that the participants had a better understanding of the legal basis for administrative discretion; however, several challenges remained, including inconsistent administrative documentation, inadequate justification of discretionary decisions, and limited integration between enforcement measures and street vendor empowerment programs. In addition, the discussions revealed that enforcement actions focusing solely on restoring public order had not yet produced sustainable compliance and continued to generate social tensions with informal-sector vendors. The program recommends strengthening AUPB-based standard operating procedures, improving administrative documentation, enhancing pre-enforcement communication, and integrating enforcement activities with more comprehensive street vendor management and empowerment programs to ensure that the exercise of administrative discretion becomes more accountable, humane, and socially just.

Abstract

Abstract (TNR11) This article examines the effectiveness of alternative dispute resolution mechanisms, particularly mediation and arbitration, in the settlement of industrial relations disputes in Batam’s industrial area, with emphasis on two principal parameters: efficiency and legal certainty. Batam occupies a distinctive place in Indonesia’s economic geography as a free trade zone, an industrial cluster, and a strategic investment hub. This position generates intensive labour relations and, inevitably, a significant volume of industrial disputes. At the same time, the Industrial Relations Court (Pengadilan Hubungan Industrial/PHI) serving the Riau Islands Province is located in Tanjungpinang rather than in Batam. For workers and employers in Batam, this institutional arrangement increases travel costs, procedural burdens, and the time required to obtain formal adjudication. Using a normative juridical method supported by statutory, conceptual, case, and document-based approaches, this study analyses legislation, court decisions, institutional reports, scholarly literature, and verifiable secondary empirical information relating to dispute settlement practice in Batam. The study finds that mediation has become the dominant and relatively effective mechanism because it reduces costs, shortens processing time, and filters a substantial number of disputes before they reach litigation. However, legal certainty remains less than optimal due to persistent weaknesses in the execution stage, the non-binding nature of mediators’ recommendations, the underutilization of arbitration, and the absence of a PHI in Batam. The article therefore argues for stronger mediation institutions, the establishment of a local PHI in Batam, enhanced labour-law literacy, and better harmonisation between central and local policy as essential steps toward a dispute resolution system that is faster, fairer, and more legally certain. Abstract

This study aims to analyze the synergy between the Civil Service Police Unit (Satpol PP) and the community in enforcing regional regulations in Sagulung District, Batam City, with particular emphasis on the forms of public participation, coordination mechanisms, and their impact on the effectiveness of public order enforcement. The study employed a qualitative descriptive approach. Data were collected through field observation and documentation of collaborative practices between Satpol PP and local residents in supporting the enforcement of regional regulations. The findings show that such synergy is built through two-way communication patterns, formal complaint channels, local coordination forums, and the involvement of community leaders, neighborhood associations, community protection units, and residents in monitoring, reporting, prevention, and assistance during enforcement activities. Community participation was found to accelerate the detection of violations, improve Satpol PP’s responsiveness, strengthen public compliance, and reduce the potential for conflict during enforcement processes. However, the effectiveness of this collaboration remains constrained by several inhibiting factors, including uneven legal awareness among citizens, limited institutional resources, and the lingering repressive image of enforcement officers. This study concludes that regional regulation enforcement becomes more effective when implemented through a participatory partnership model that positions the community not merely as an object of regulation, but as an active subject sharing responsibility for maintaining public order.

Abstract

This study examines the justice dilemma between punishment and rehabilitation in the Juvenile Criminal Justice System (Sistem Peradilan Pidana Anak/SPPA) and formulates a more proportional legal reasoning standard for handling children in conflict with the law. The research employs a normative juridical method using statutory and conceptual approaches, supported by doctrinal analysis and relevant scholarship on retributive, rehabilitative and restorative justice. Legal materials are analyzed through systematic and teleological interpretation, as well as prescriptive legal argumentation, to assess the relationship between child protection, victims’ interests and the legitimacy of punishment. The findings show that the central dilemma lies not in the existence of punishment or rehabilitation per se, but in the absence of consistent argumentative standards to determine when punishment may be justified and when rehabilitation should be prioritized. The study finds that punishment remains legally possible within SPPA, but its legitimacy must be strictly limited by necessity review, the ultimum remedium principle and proportionality. Conversely, rehabilitation and diversion should not be treated merely as policy preferences, but as normative priorities because they are aligned with the best interests of the child and social reintegration objectives. This study formulates an operational normative reasoning framework requiring law enforcers to assess the purpose of intervention, the availability of alternatives, procedural quality and the justificatory basis of decisions. These findings contribute to strengthening consistency in SPPA implementation and to developing a more accountable, humane and just juvenile justice practice.

Abstract

This study examines local taxpayer compliance in Batam from an administrative law perspective by testing the effects of tax literacy, tax regulatory outreach, and perceived fairness of tax collection. The study is motivated by the need to strengthen local own-source revenue, which requires compliance that is not merely formal but also grounded in procedural legitimacy in tax-collection practices. An explanatory quantitative design was employed. A total of 150 questionnaires were collected from registered local taxpayers who actively interacted with the local tax system; after screening for completeness and response consistency, 120 responses were deemed eligible for analysis. The data were analyzed using PLS-SEM (SmartPLS) through measurement-model and structural-model assessment. The results indicate that tax literacy, tax regulatory outreach, and perceived fairness of tax collection all have positive and significant effects on local taxpayer compliance. Among these predictors, perceived fairness of tax collection emerges as the most influential determinant, underscoring the importance of procedural fairness, transparency, and equal treatment in shaping compliance behavior. In addition, the model demonstrates adequate explanatory power, predictive relevance, and overall model fit. The findings suggest that improving local taxpayer compliance requires an integrated strategy combining stronger tax literacy, better-designed regulatory outreach, and reforms in service quality and tax-collection procedures. Theoretically, this study enriches the literature on local tax compliance from an administrative law perspective, particularly with respect to procedural justice and the legitimacy of tax collection. Practically, the findings can inform policy strategies aimed at strengthening taxpayer literacy, designing more effective regulatory outreach, and improving the procedural fairness of tax-collection services in order to enhance compliance and the quality of local tax governance in Batam City.

Abstract

Manusia sebagai makhluk sosial artinya manusia sebagai warga masyarakat. Dalam kehidupan sehari-hari manusia tidak dapat hidup sendiri atau mencukupi kebutuhan sendiri. Setiap manusia cenderung untuk berkomunikasi, berinteraksi, dan bersosialisasi dengan manusia lainnya. Dapat dikatakan bahwa sejak lahir, dia sudah disebut sebagai makhluk sosial. Permasalahan yang sangat mendasar dalam memberlakukan hukum secara efektif tidak lain karena kurangnya kesadaran hukum oleh masyarakat itu sendiri. Namun dalam kenyataannya kesadaran hukum tidak memberikan dampak yang signifikan terhadap tunduknya masyarakat terhadap hukum. Untuk itulah perlu ada sebuah dorongan yang lebih bersifat memaksa atau biasa dikenal dengan penegakan hukum. Penelitian ini bertujuan mengetahui Implementasi Penegakan Hukum Dalam Perspektif Sosiologi Hukum dalam kenyataannya dimasyarakat. Hasil penelitian menunjukkan bahwa Penegakan hukum ini dilakukan antara lain dengan menertibkan tugas, fungsi, dan wewenang lembaga lembaga yang bertugas menegakkan hukum menurut kewenangan masing-masing lembaga, untuk mencapai terciptanya ketertiban dan kepastia hukum maka perlu adanya system kerjasama yang baik antar lembaga-lembaga penegak hukum.
