Abstract

The social change of the Dago Pojok Bandung Creative Village community is one way to preserve traditional villages as a creative village that adapts to the development of times in today's modern society. The empirical approach in the study of legal Anthropology which explains that traditional/modern society has a very large influence in the lives of social change in society to achieve progress. The Comparative Approach to Legal Anthropology explains that in traditional/modern societies a rule is needed that governs the lives of its people. The change of traditional society should be addressed to the good for the good of the next generation in social life through norms, behavior that avoids the deviations of traditional/modern social change.

Abstract

Pluralisme Hukum, sering diartikan sebagai keragaman hukum. Dalam perjalanannya, pluralisme hukum tidak terlepas dari sejumlah kritik, misalnya pluralisme hukum dianggap tidak terlalu menekan batasan-batasan hukum yang digunakan, dan pluralisme hukum dianggap kurang mempertimbangkan struktur sosial ekonomi makro yang mempengaruhi kehidupan masyarakat. terjadinya sentralisme hukum dan pengabaian keadilan. Pluralisme hukum umumnya digunakan untuk memahami realitas hukum dalam masyarakat. Oleh karena itu, dalam jurnal ilmiah ini akan dibahas lebih lengkap tentang pluralisme hukum di masyarakat, khususnya dalam menerapkan konsep Konsep Segitiga Hukum Pluralisme Hukum, di era globalisasi saat ini. Konsep hukum ini digagas oleh Werner Menski, sebagaimana tertuang dalam ulasannya yang berjudul Flying Kites in a Global Sky: New Models of Jurisprudence. Mengambil sikap pluralis hukum yang mencerminkan realitas sosial-hukum global, artikel ini pertama-tama mengidentifikasi hambatan mental yang signifikan bagi para sarjana hukum dalam berteori tentang pluralisme hukum. Jika hukum di mana-mana dinamis dan plural secara internal, bahkan jika tidak segera terlihat, mengakui pluralisme tentu menjadi aktivitas yang sangat dinamis, sebanding dengan tantangan menerbangkan layang-layang: Satu langkah salah, dan struktur halus runtuh. Jika pengajaran hukum tidak menanggapi pluralisme secara serius, pendidikan hukum hanya akan memberdayakan segelintir aktor yang memiliki hak istimewa, yang mampu memanipulasi hukum dan berbagai kegunaannya yang terkait dengan kekuasaan. Pendekatan yang sadar sosial terhadap pengajaran hukum harus mempermasalahkan bahwa sementara kita membutuhkan hukum untuk menghindari kekacauan, di mana-mana hal itu berisiko eksploitasi dan penyelewengan terus-menerus.
