Abstract

The practice of sharia banking in Indonesia, the provision of mudharabah financing is generally followed by the provision of guarantees by business actors, since mudharabah financing contracts which are not followed by collateral are difficult to obtain mudharabah financing. Sharia banking interpreting collateral is an additional collateral for businesses managed by business actors in accordance with article 1 verse 26 of Law no. 21 of 2008 concerning Sharia Banking. For Sharia Banks Mudharabah financing guarantee is the second source of payment of capital given while the main source is the result of mudharib’s business. When the business actor fails to fulfill its obligations to the sharia bank, the guarantee can be used as an effort to anticipate the failure to pay the financing provided. The problems that form the basis of this research is what is the basis of the idea of imposition of collateral in mudharabah financing contract perspective of Law no. 21 of 2008. To analyze the above research question the author uses normative juridical research as a method so that found a comprehensive, systematic, critical, constructive and argumentative answers. Abstract

Marriage Dispensation from the Court is a decision in the form of determining a dispensation for prospective male or female brides who have law number 16 of 2019 states that you must not have married before you turn 19 years old. Even if there is a legislation that restricts the minimum age at which one can be married, refer to this potential anomaly as underage marriage. Consequently, if a man and a woman get married before turning 19, it's referred to as underage marriage. The research methodology employed is normative juridical, which involves examining theoretical frameworks, concepts, pertinent statutory rules, and legislative procedures. Judges of the Pandan Religious Court were directly interviewed as part of the data collection process. According to research, the judge will allow the request for marriage dispensation under the legal rationale. Marriage dispensation is the term used to describe when a court permits a prospective husband and wife who are under the age of 19 to get married. To aid in the effective administration of justice, the Chief Justice of the Republic of Indonesia established Regulation of the Supreme Court of the Republic of Indonesia Number 5 of 2019 concerning Guidelines for Adjudicating Applications for Marriage Dispensation. Marriage dispensation applications are not clearly and thoroughly governed by statute. This regulation was drafted on November 20, 2019, and it was formally published on November 21 to ensure that everyone in society may read it and abide by it.

Abstract

Latar belakang, Kebersihan merupakan sumber kesehatan terhadap jiwa dan raga bagi personal dan lingkungan sekitarnya. Pola makanan dan minuman yang bersih dan sehat sangatlah menjadi prioritas utama didalam sumber kehidupan masyarakat pasca kebiasaan baru. Tujuan Utama dari penelitian ini untuk menegetahui kapasitas produk pangan berlabel halal sebagai ketahanan baru di Kota Medan. Metode: Dalam penelitian ini dilakukan dengan pendekatan secara yuridis normatif. Pengambilan sampel secara normatif sebagai acuan atas produk di lapangan pertumbuhan industri dan perkembangan produk berlabel halal hingga priode tahun 2020, Hasil: Pencapaian yang di peroleh dengan metode dan sisitem produk pangan yang higienis berlabel halal memberikan dampak yang positif dari sudut peningkatan ekonomi serta daya minat masyarakat Kota Medan serta menimbulkan budaya baru tentang memperhatikan kebersihan. Peran serta aparat Pemerintah didukung Anggota Legislatif memberikan perobahan yang signifikan ditengah masyarakat.. Simpulan: Penerapan produk pangan berlabel halal yang diyakini adalah higieneis dalam kondisi pasca pademi yang mengutamakan kebersihan dan kesehatan memberikan dampak positip didalam ketahanan ekonomi di Kota Medan khususnya.

Abstract

Instruments in sharia banking have many forms of contracts or financing that are used in sharia banking. Even though you have many contracts or types of financing, sharia banking must be based on sharia principles. Legally, sharia banking is regulated in Law Number 21 of 2008 concerning sharia banking. However, sharia banking must also refer to the Koran and hadith which are contained in the DSN-MUI fatwa. Murabahah contracts are used in sales and purchase principle products, contracts or sales and purchase agreements can technically be applied in the banking world, especially sharia banking. Murabahah financing almost dominates all forms of distribution of funds to sharia banks, in number, this gives the impression that all sharia bank fund distribution transactions are deliberately made murabahah, possibly to minimize the risks that will befall the bank in each distribution of funds. By utilizing the concept of a sale and purchase agreement, transactions in banking can be avoided from usury. Compared to other financing mechanisms, murabahah is the most profitable and carries the least risk for sharia banks.
