Abstract

This study aims to discuss two problems, namely the form of legal protection and responsibility and the bank's efforts in solving the problem of theft of account balances with customers. This study uses the Normative Empirical legal method by using the legal, conceptual and sociological approach. From the results of the study, it was found that the bank as a place to store funds is fully responsible and will compensate for all losses if it is true that the lost funds are caused by Skimming or Pishing and the settlement efforts use non-litigation channels by means of mediation based on the provisions of Bank Indonesia Regulation Number 10/1/PBI. /2008 amendment to Bank Indonesia Regulation Number 8/5/PBI/2006 concerning banking mediation.

Abstract

This research has the purpose to find out the right and duty regulations in the PDAM Mataram agreement that make damages for customers, and find out the type of legal protections against customers who got damages by the services of PDAM Mataram City. This research uses normative-empirical legal research. The consumer's legal protection against water services by PDAM that make damages for the customers, namely the legal protection on their agreement on the implementation uses written on their form. This form is about rights and duties the parties regulate in Act Number 8 of 1999 about consumer protection. The type of legal protection against customers for water services by PDAM Mataram City that makes damages for the customers, namely if they break the consumer's rights so the customers can use the provisions as stipulated in Act Number 8 of 1999 concerning Consumer Protection to make a lawsuit. Meanwhile, lawsuits against the business actors, namely the PDAM Kota Mataram, can be imposed through civil, criminal, or state administrative law process.

Abstract

This study aims to determine the implementation and responsibility of buying and selling imitation pearls at UD Ocin Pearl to- the consumer. This research applies empirical legal research methods using facts that occur in the field, and normative legal methods, namely legal research that defines law as a building system of norms such as legislation and various data. The implementation of this imitation pearl sale and purchase agreement is carried out by small traders who take the imitation pearl at the UD Store. Ocin. This imitation pearl was then traded in front of the hotel visited by out-of-town and local guests at an affordable price.

Abstract

Penelitian ini bertujuan untuk mengetahui pelaksanaan Pendaftaran Jaminan Fidusia Secara Elektronik oleh Notaris berdasarkan Peraturan Pemerintah Nomor 21 Tahun 2015, serta hambatan yang dihadapi oleh Notaris dalam pelaksanaan pendaftaran jaminan fidusia secara elektronik. Penulisan ini bersifat normatif-empiris, seluruh data dianalisis dengan metode analisis data kualitatif. Hasil penelitian menunjukkan bahwa notaris melakukan penginputan data melalui aplikasi yang telah disediakan oleh Direktorat Jenderal AHU, kemudian data dikirim melalui jejaring internet. Hambatan yang disebabkan oleh sistem operasional yang tidak dapat bekerja dengan baik sehingga mengakibatkan penginputan data yang dilakukan notaris terhambat, sehingga notaris wajib melakukan penginputan data ulang.

Abstract

This study aims to determine the form of PDAM Tirta Ardhia Rinjani's responsibility to consumers who are disadvantaged in the supply of clean water in Batukliang District, to find out what efforts are made by the customer when a default occurs by PDAM Tirta Ardhia Rinjani. The type of research used is empirical normative, which examines the application of laws and regulations based on legal concepts and theories to see firsthand the reality on the ground by conducting interviews to obtain field data. The research location is PDAM Tirta Ardhia Rinjani (Central Lombok). Based on the results of the study that: First, the form of PDAM Tirta Ardhia Rinjani's responsibility to consumers who are harmed by direct review of complaints experienced by customers but there is no further action to resolve these complaints and without providing information or explanations given to customers who suffer a loss. Second, the settlement of disputes carried out by the PDAM with customers by seeking and prioritizing the deliberation route or through non-litigation, even if the efforts made cannot be carried out, then proceed to court.

Abstract

This study aims to determine the responsibility of the Financial Service Authority (OJK) in supervising online loans and to find out patterns of dispute resolution in the event of default in online loan agreements through the Maucash Application. This type of research is normative-empirical legal research using statutory approaches, conceptual approaches, and sociological approaches. Data collection techniques used library data and field data from interviews which were analyzed descriptively-qualitatively. The results of this study indicate that OJK supervision of MauCash based on POJK Number 77/POJK.01/2016 is divided into two stages, namely pre-operational business and during business operation. For the settlement of default disputes, MauCash forms a Field Collection Team for billing and within 180 days the data will automatically be included in the OJK SLIK.
