Abstract

Currently, many unregistered marriages are carried out, including by members of the police. The purpose of this study was to identify and analyze unregistered marriages carried out by members of the police with the aim of having more than 1 (one) wife or having polygamy and the sanctions in terms of the Chief of Police Regulation No. 6 of 2018. This type of research is normative with a legal approach. The type of data used is secondary data consisting of primary, secondary and tertiary legal materials, while data analysis is carried out qualitatively. Members of the police are not allowed to carry out unregistered marriages to have more than 1 (one) polygamous wife because they violate Article 4 of the Regulation of the Chief of Police Number 6 of 2018 and the sanction is that they can be dishonorably dismissed (PDTH) or expelled from the Indonesian National Police Agency without receiving a salary or severance pay.

Abstract

Marriage can be carried out by both men and women who are old enough. The purpose of this study is to identify and analyze the factors that cause underage marriage in Indonesia and underage marriage in adolescents in terms of Law Number 16 of 2019. This type of research is normative with a legal approach. The type of data used is secondary data consisting of primary, secondary and tertiary legal materials, while data analysis is carried out qualitatively. Factors that cause underage marriages in Indonesia are religion and culture, economy, education, already pregnant, the will of parents, their own will, customs and culture, feeling that they have been able to take responsibility, promiscuity, closing shame, arranged marriages, worship and social media. Meanwhile, underage marriages in adolescents according to Law Number 16 of 2019 are marriages carried out by boys and girls who are under the age of 19 (nineteen) years. In practice, it is mostly done by teenagers between the ages of 12 (twelve) to 19 (nineteen) years. This should not be done but if something unwanted happens and to protect the rights of children, especially girls, a marriage dispensation can be requested at the religious court.

Abstract

The franchise business is one of the most visible concrete examples in export and import trade between countries globally. To guarantee the interests of the parties, this business needs to be registered in accordance with the applicable laws and regulations. This type of research is normative with a conceptual and statutory approach. The data used is secondary data consisting of primary, secondary and tertiary legal materials. In Article 11 of the Minister of Trade Regulation Number 71 of 2019 concerning Franchise Management, it is stated that a Franchise Registration Certificate (STPW) is issued by the OSS Institution for and on behalf of the Minister or Regents and Mayors. STWT application process submitted through the Online Single Submission (OSS) Institution. For this reason, it is recommended that the franchisor and franchisee register their businesses in accordance with applicable regulations and that local governments are more active in socializing franchise registration and exercising tighter supervision of franchisors and franchisees who do not register their businesses

Abstract

Airport Pass is an entry permit sign for individuals, vehicles, cargo and posts that will enter the Security Restricted Area, the requirements for obtaining which have been regulated in regulations issued by the Government. The purpose of this research is to conduct a legal review of the Airport Pass service at the Airport Authority Office in Region II Medan when entering the Security Restricted Area. The type of research in this paper is normative with a statutory and conceptual approach. While the specification of the research is analytical descriptive, namely explaining the problem according to the research title. The data used is secondary data which consists of primary legal materials in the form of Law No. 25 of 2009, Law No. 1 of 2009, Permenhub No. PM 33 TAHUN 2015, Permenhub No.PM 167 Year 2015, Permenhub No. PM 178 of 2015 and secondary legal materials in the form of books, journals, electronic news, and opinions of legal experts, laws and regulations, and writings related to research titles. Legal review of Airport Pass services at the Airport Authority Office in Region II Medan as a public service provider. Therefore, it is suggested to all partners or certain parties who already have an Airport Pass to always use it when entering the airport location and follow the usage regulations that have been set according to the mandate of the law regarding public services. Administrative sanctions for those who violate it for the sake of creating security and order in carrying out services in the Airport Region II Medan area.

Abstract

Marriage is a form of worship because it has a noble purpose to maintain human survival as stated in the Qur'an. It is hoped that a marriage will be carried out forever and without anything being hidden. In Islam, a husband is allowed to have more than one wife (polygamy) as long as he can act fairly and comply with applicable regulations. When you want to remarry, one of the conditions is the wife's consent and permission from the Religious Court. The husband committed the falsification of his identity when he was about to remarry. Through analytical descriptive research, this article aims to understand the terms and conditions of polygamous marriages and for husbands to understand the impact of the law on falsifying identities in marriage.
