Abstract

The enactment of new decentralization framework has been unwisely implemented in many regions. Districts/city governments tend to promulgate new local taxes and levies result in high cost economy for regional business activities. The principle of delivering administrative approval (perijinan) is also misgiving as it is deployed for all people’s economic facets. Philosophically, not everysingle economic activity requires such kind of permission. This situation leads to the deprivation of public service quality. In order to restore government performance in delivering public services, this paper tries to offer a solution from the perspective of constitutional / public administration law (hukum administrasi negara), i.e. providing new mechanism of administratief beroep or administrative legal efforts (upaya hukum secara administratif).

Abstract

The global issue on environmental degradation is becoming solemn concern among national and local governments. One of strategies in overcoming environmental problems, particularly in the shielding / caring areas (kawasan lindung), is to promote special institution in charge of composing plan, implementing programs, controlling and evaluating performance, as well as building strategic alliances among stakeholders to protect and improve the quality of shielding areas. This paper tries to analyze the probability of making new institutions based on “collaborative management” principles. In brief, it offers two models of such institution, namely, upstream – downstream solidarity; and central – regional solidarity.

Abstract

The promulgation of extended-decentralization policy has brought about the competition climate among district/city governments in delivering public services. The capacity to accomplish public tasks, however, tends to be insufficient. That’s why, regional-cooperation-based management is believed as the paramount mode to minimize local government’s shortage on the one hand, and to improve public accountability and performance on the other hand. In the East Kalimantan case, the tradition of conducting public affairs through collaborative management seems to be disregarded. Nevertheless, the prospect to intensify regional cooperation is fairly promising. This paper examines the likely development cooperation among three autonomous regions, i.e. Bontang City, East Kutai District, and Kutai Kartanegara District, the Bosanggarong (Bontang, Sangatta, and Tenggarong) Development Forum. The study has been highlighted on three dimension of development: provision of basic infrastructure facilities (public works), environmental management, and garbage / waste-disposal services.  Keywords: Otonomi / desentralisasi, kerjasama antar daerah, pelayanan masyarakat

Abstract

Although decentralization has been the major theme in the field of public administration within the last five decades, there is still diverse understanding of it. One of the confusions is that decentralization is frequently perceived contrary to the deconcentration. Such confusion leads to the imbalance in theoretical sources and policy framework on deconcentration compared to decentralization.To provide a deeper picture on deconcentration and decentralization, this paper tries to elaborate the fundamental idea of the deconcentration and decentralization, its impact and relationship, its historical development, as well as its difference in the notion of power sharing among levels of government.  Keyword: deconcentration, decentralization. Meskipun desentralisasi telah menjadi tema utama di bidang administrasi publik selama lima dekade, namun masih sering ditemui adanya perbedaan pemahaman mengenai hal ini. Salah satu yang menimbulkan kebingungan adalah bahwa desentralisasi sering dianggap sebagai konsep yang berlawanan dengan dekonsentrasi. Hal ini mendorong ketidakseimbangan dalam sumber-sumber teoritis maupun kebijakan antara dekonsentrasi dengan desentralisasi. Untuk menyajikan gambaran lebih dalam mengenai dekonsentrasi dan desentralisasi, tulisan ini mencoba untuk menggali ide dasar dekonsentrasi dan desentralisasi, dampak dan hubungannya, sejarah perkembangannya, serta perbedaannya dalam hal pembagian kewenangan antar level pemerintahan.  Kata Kunci : dekonsentrasi, desentralisasi

Abstract

Deconcentration is one of the most important principles in managing central-local relationship in a unitary state. Together with decentralization and assistance task principles, deconcentration reveals the best strategy to assure the integrity of the state. In the Indonesian context, however, there is a tendency that decentralization is getting stronger, while deconcentration is moving to the opposite direction. This paper tries to elaborate the norm and the practice of deconcentration in Indonesia, and the possibility to construct an equilibrium concept between decentralization and deconcentration.  Keywords : deconcentration, decentralization, Indonesia.Dekonsentrasi adalah salah satu asas terpenting dalam pengelolaan hubungan pusat-daerah di sebuah negara kesatuan. Bersama dengan desentralisasi dan tugas pembantuan, dekonsentrasi merupakan strategi terbaik dalam menjamin integritas negara. Dalam konteks Indonesia, terdapat kecenderungan bahwa asas desentralisasi semakin menguat, sementara asas dekonsentrasi berjalan menuju arah berlawanan. Tulisan ini mencoba mengelaborasi sisi normatif dan empiris dalam implementasi asas dekonsentrasi di Indonesia, dan kemungkinan untuk mengembangkan ide keseimbangan antara desentralisasi dan dekonsentrasi.  Kata kunci: dekonsentrasi, desentralisasi, Indonesia.

Abstract

There is an assumption that instead of decentralization (devolution), unitary states prefer to choose deconcentration (administrative decentralization) as a tool to manage central-local government relationship. However, international experiences show that degree of decentralization varies among countries. Basically, this paper tries to elucidate the association between deconcentration and unitary states and provide some empirical evidences on the implementation of deconcentration in various countries. It also proposes three possible models of deconcentration for unitary states, and concludes with some notes to be considered in reformulating Indonesia's policy on decentralization. The method being deployed in this article is completely documentary studies. K uncris: deconcentration, decentralization, unitary states.Ada sebuah asumsi bahwa negara dengan bentuk kesatuan lebih cenderung menerapkan dekonsentrasi atau desentralisasi administratif sebagai instrumen dalam mengelola hubungan pemerintah pusat dan daerah. Meskipun demikian, pengalaman internasional menunjukkan bahwa derajat desentralisasi di berbagai negara sangat beragam. Atas dasar itu, makalah ini bertujuan untuk menggali dan menganalisis hubungan antara dekonsentrasi dengan bentuk negara kesatuan, dan menyajikan bukti-bukti empiris tentang implementasi dekonsentrasi di berbagai negara. Tulisan ini juga menawarkan tiga model alternatif dekonsentrasi untuk negara kesatuan, serta memberikan catatan-catatan yang dapat dipertimbangkan dalam merumuskan kembali kebijakan desentralisasi di Indonesia. Adapun metode yang digunakan sepenuhnya mendasarkan pada analisis dokumen. Kata Kunci : dekonsentrasi, desentralisasi, negara kesatuan.

Abstract

The role of central government in strengthening sub-national governments is unquestionably vital. Principally, the central government also determines the degree of decentralization in a country. This paper tries to explore the role of central government in Japan in promoting local development through decentralization. There are some lessons that might adopted to build decentralization in Indonesia effectively. Firstly, central government needs to reinforce its commitment to transfer more powers to local government, and to reduce its intervention over local regulations. Secondly, the new framework of decentralization should oblige central government to provide economical incentive system in order to promote competition among local governments.Keywords: decentralization, role of central government, Japan, Indonesia.Tidak diragukan lagi bahwa peran pemerintah pusat dalam memperkuat pemerintah daerah sangat penting. Tingkat desentralisasi di suatu negara sangat ditentukan terutama oleh Pemerintah Pusat. Tulisan ini mencoba untuk mengeksplorasi peran pemerintah pusat di Jepang dalam mempromosikan pembangunan daerah melalui desentralisasi. Ada beberapa pelajaran yang mungkin dapat diadopsi untuk membangun desentralisasi yang lebih efektif di Indonesia. Pertama, Pemerintah Pusat perlu memperkuat komitmennya untuk mentransfer kewenangan yang lebih besar kepada pemerintah daerah, dan mengurangi intervensi atas peraturan atau regulasi daerah. Kedua, kerangka baru desentralisasi perlu mewajibkan pemerintah pusat untuk memberikan sistem insentif ekonomi dalam rangka mempromosikan kompetisi antar pemerintah daerah.Kata Kunci : desentralisasi, peran pemerintah pusat, Jepang, Indonesia.
