Abstract

During New Order period, government was the most powerful institution with 'unlimited' authorities and having less control from other state institutions. Consequently, it tended to promulgate many policies overwhelming its power. Only after the 2004 Election, the new regime has declared its pledge to reform the bureaucracy. Bureaucratic reform alone Is Inadequate, however. It has to be accompanied by law reform, particularly In the field of constitutional / public administration law (hukum administrasi negara). In that sense, this paper tries to elaborate two basic dimensions of constitutional law. I.e. government dimension and authority dimension. Those two dimensions consist certain facets that contribute to violation of law as practiced in the past. Hence, to prevent the appearance of similar case in the future, all facets of government (bureaucracy) and authority should be carefully scrutinized and simultaneously recovered.

Abstract

Previously, government’s programs on people empowerment were considered to be failed in achieving their targets. One of the reasons is that the programs were improperly designed. At that time, policy on people empowerment was constantly associated to micro credit programs which in reality, unable to strengthen social and economic independency of the citizens. In such a case, this paper offers 5 categories of empowerment program that should be linked to 4 sectors of development, namely economic, social and cultural, political and administrative, and infrastructure dimension. Another important thing is that acceleration oof empowerment programs require political will of the government (booth in central and local level) to burst through and innovate every single public policy.

Abstract

Recently the demand to assign the authority of district/municipality to the sub districts   and villages  is ever-increasing. This is not merely a need, but rather it has been a must to promote the effectiveness and efficiency of local autonomy implementation. However, there is an indication that the authority handed over is not implemented optimally. The apparent weaknesses are among others instigated by the imprecision of authority approach and pattern used, and other technical reasons such as the lack of resource distribution concept, implementation and technical procedures, etc. Other crucial factors hindering the implementation of the autonomy policy are the obscurity of the criteria to determine the authority to be assigned, and the local organizational structure of sub district which is forced to accept and implement the regional authority. Based on the various problems as discussed above, this essay tries to analyze and evaluate the practice of authority delegation from the head of district/municipality to the heads of sub districts and villages, and to offer some essential policy alternatives

Abstract

Decentralization is widely believed to be an effective tool for promoting democratic local governance as well as a cure for bureaucratic pathology. Based on literature studies and,cross-country evidence, policy on regional autonomy promises many significant improvements in varying sectors of development. In the case of Law 22/1999, however, it does not produce expected results yet, both at local and national levels. This paper examines the correlation between decentralization framework and socio-economic development in Bandung, with special reference to the six development fields, i.e. budget management, investment, physical infrastructure, education and human development, environmental protection, and people participation and community development. The general conclusion is that there are many significant changes but only little progress. This might be caused either by incorrect implementation or insufficient time to implement the law. Whatever the causes are, this paper supports the idea of revising some parts of the law in order to create a better atmosphere of local politics.

Abstract

The dispute on Ambalat Block between Indonesia and Malaysia has encouragedgovernment institutions to pay more vigilance on the promotion of developmentprograms of border areas. There is a shift of paradigm posing border-areas as the‘frontyard’ instead of ‘backyard’. It implies that efforts on promoting borderdevelopment along North Kalimantan region call for an an emergency policy orcatch-up strategy. This comprises endeavors for establishing specific institution,providing ample amount of funds, and designing an integrated action plan on thehastening of border development. This paper portrays some essential dimensions ofborder areas such as general description and problems of border areas, the nature of Ambalat conflict, legal framework of border areas, and recommended strategies to redevelop the North Kalimantan region.

Abstract

Kebijakan desentralisasi luas yang digulirkan semenjak 1999 tidak saja dimaksudkan untuk memenuhi tuntutan reformasi, namun juga untuk mendorong terwujudnya pemerintahan yang demokratis dan berkinerja tinggi. Dalam tataran akademik, wacana tentang hubungan antara rezim demokratis dengan rezim pembangunan belum menemui titik temu. Sebagian berpendapat bahwa demokrasi merupakan produk dari proses pembangunan yang berhasil, sementara sebagian lain berargumen bahwa demokrasi merupakan prasyarat untuk dapat berjalannya pembangunan di suatu negara/daerah. Dalam upaya mewujudkan kondisi kepemerintahan lokal yang demokratis sekaligus berkinerja tinggi, kebijakan otonomi luas diyakini merupakan strategi yang tepat, sebagaimana ditunjukkan oleh contoh di negara-negara yang menerapkan kebijakan serupa. Meskipun demikian, desentralisasi juga dapat mengalami kegagalan jika tidak dikelola dengan baik. Untuk itu, desentralisasi perlu diikuti dengan upaya membangun kapasitas daerah serta sinkronisasi tiga pilar kekuatan lokal menuju konsep pembangunan yang terintegrasi. Tulisan ini mencoba mengevaluasi implementasi desentralisasi di Kota Bandung. Hasil analisis mengindikasikan bahwa desentralisasi di Kota Bandung berdampak lebih signifikan terhadap penguatan demokrasi lokal dibanding terhadap peningkatan pembangunan sosial ekonomi. Meskipun demikian, untuk jangka panjang desentralisasi menumbuhkan harapan besar terwujudnya rezim pembangunan yang demokratis.
