Abstract

This article aims to discuss the condition of one area in Riau Province that is still implementing legal cases' settlement using customary law with the mediation method, namely Pelalawan Regency. The problem of this research is finding out how ninik mamak and traditional leaders are mediators in resolving legal cases in each sub-district or village in Pelalawan Regency. In order to approach this problem solving, a sociological legal research theory reference is used and then analyzed qualitatively. In collecting data, apart from interviews and literature studies, it is also obtained by involving local indigenous community leaders. This study indicates that ninik mamak or traditional leaders as representatives of indigenous peoples have an important role, namely as mediators and are obliged to resolve legal cases that occur in the community, especially in Pelalawan Regency. Therefore, it is hoped that this article can provide a new perspective for law enforcement officers in overcoming the many cases that cannot be resolved by the judicial subsystem and the overcapacity of correctional institutions throughout Indonesia

Abstract

Terkait teknik yang baik dalam upaya penyelesaian sengketa dalam masyarakat adat sehingga tercapinya win-win solution yang menguntungkan kedua belah pihak yang bersengketa, bagaimanakah bentuk-bentuk dan penyelesaian sengketa yang terjadi dalam masyarakat adat di Desa Kualu Kecamatan Tambang Kabupaten Kampar, bagaimana teknik mediasi yang digunakan dalam penyelesaian sengketa masyarakat adat di Desa Kualu Kecamatan Tambang Kabupaten Kampar.

Abstract

Alternatif Penyelesaian sengketa biasa digunakan para pihak yang bersengketa salah satunya melalui mediasi.. Melalui pihak penengah, disebut dengan mediator, dilakukan di luar pengadilan (non litigasi). Penyelesaian sengketa melalui mediasi ini tentunya tidak selalu berhasil tercapainya perdamaian, karena sengketa berlanjut, kurang ahlinya tokoh masyarakat  bertindak sebagai pendamai para pihak (mediator). Seperti salah satu hasil penelitian penulis dilakukan di Desa Kualu Kecamatan Tambang, terhadap pelaksanaan penyelesaian sengketa yang terjadi dalam masyarakat. Desa ini dengan sistem kekarabatan yang berlaku adalah matrilineal, atau sistem kekerabatan yang diambil dari garis keturunan Ibu.Permasalah dalam masyarakat melalui musyawarahkan oleh para tokoh masyarakat adat . Namun yang bertindak sebagai pihak penengah yang netral disebut mediator, yakni ninik mamak yang dihormati masyarakat dan kelompok suku yang ada. Sebelumnya dimusyarawarahkan oleh kerabat atau keluarga terdekat. Jika permasalahan masih berlanjut maka diselesaikan melalui ninik mamak suku. Namun pelaksanaan mediasi dalam masyarakat ini dihadiri oleh pihak lain selain para pihak yang bersengketa, tentunya tidak sesuai dengan teori mediasi yang bersifat rahasia. Kendala lain mediator tersebut belum mempunyai sertifikat sebagai mediator. Adanya teknik mediasi yang dilakukan dengan cara “kaukus” atau mediator bertemu dengan para pihak dengan cara memisahkan tempat antara pihak satu dengan yang lainnya, cara dialog antara mediator dengan para pihak satu persatu.

Abstract

The study using the geoelectric method produces resistivity values with different color images. Data is displayed in the form of a collection of 1D and 2D pseudosection points which are then processed using Progress and Res2Dinv software. The 1D cross-section results in the appearance of the subsurface structure vertically or shows the depth and thickness of the subsurface layers. The results of Wenner and Schlumberger configuration data processing show that there are differences in resistivity and depth values on each path but have the same lithology. This is because the Schlumberger configuration can only display 1 point of depth vertically, so the data obtained cannot compare the resistivity horizontally. But the advantage of the Schlumberger configuration is that it is capable of displaying a large depth compared to the Wenner configuration so that it is difficult to read a thin layer of this configuration. The Wenner configuration result displays the depth and length of the layer along the track so that the thickness of the layer from the start of the track to the end of the track can be interpreted. The layer which has a small thickness can be identified using the Wenner configuration, but cannot reach any deeper depths.
