Abstract

The increasing market for retail industry in Indonesia faces a challenge poses by sellers’ preference towards the selling of domestic goods. In order to overcome this problem, the government issues a mandate for retailer to sell domestic products as high as 80% of their traded goods. This may raise ineffectiveness in terms of the implementation since the capabilities in stock management varies among retailers, added with the absence of clear technical guidance that determines the fulfilment of 80% domestic product to be traded by a retailer. As such, there is a need to provide case-based recommendations addressing the governance and technical specification of the mandate to be applied. This study is aimed at formulating guideline to fulfil calculation requirements and providing policy recommendation for policy adoption by retailers. The study is done in 2016, whereby data collection is performed through interviews and focus group discussions with relevant parties representing 15 modern retailers. Analysis is done by carrying out stock keeping unit analysis in modern retailer and triangulate preliminary results through focus group discussion with key persons. The analysis shows that stock keeping unit management in modern retail must be integrated with a unique code that identifies the manufacturer origin which is issued by global standardization and distribution institution. In addition, the proposed system needs to be supported with policy of International unique code registration process, both by manufacturer and modern retail. In keeping with the refinement of relevant policy, there is also a need to have coordination amongst responsible authorities.

Abstract

The implementation of mandatory regulations of tin export through commodity multi-exchange has been considered effective in suppressing illegal tin trading practices, building transparency in transaction and export record, and creating added value for tin export. However, the essence of a multi-exchange policy should also promote the increasing in value and volume of tin transactions. This analysis aims to see the difference in the value and volume of tin transactions before and after the multi-exchange policy. By using the Paired Sample t-test, there are shown significant differences in value and volume of tin transactions whereby the value and volume transacted after the multi-exchange policy is relatively lower. The decrease in transaction value will affect the state tin royalty revenue. Interestingly, the decline in transaction value is driven by the high disparity between the value and volume of transactions between the two exchanges. Therefore, trade policies that support the consolidation of the tin market are urgently needed to optimize state royalty revenues.

Abstract

The potential of Indonesia's e-commerce sector is estimated to reach US$ 137.5 billion by 2025 and become the largest in the Asia Pacific region. Currently, the development of the e-commerce sector is regulated in Government Regulation Number 80 of 2019 concerning Trade through Electronic Systems (PP PMSE). This analysis aims to see the level of commitment and ability of marketplace actors in complying with the provisions in PP PMSE, considering their dominant role in Indonesia’s e-commerce. By using the Rule, Opportunity, Capacity, Communication, Interest, Process, Ideology (ROCCIPI) approach, respondents perceive that licensing, personal data protection, and consumer protection are clear and in accordance with the commitment and ability of the respondent. However, respondents' perceptions regarding the sale of domestic products and the practice of fair business competition need to be addressed so as to provide a clear reference. Regulations will be effective if they can foster the commitment and capability of business actors. Therefore, the essence of the policy recommendations is to focus on efforts to increase sales of domestic products as well as supervision that supports fair and sound competition. Since the commitment and capability of business actors to comply will determine effective regulations, the Co-Regulation approach needs to be used in the policy-making process by prioritizing Public Private Dialogue (PPD) that optimizes existing regulations, and harmonizes with the direction of global cooperation in e-commerce development.

Abstract

Sistem Resi Gudang Kopi (SRG Kopi) adalah instrumen perdagangan bagi petani guna memperoleh harga jual yang baik dan pembiayaan produksi. Tulisan ini bertujuan untuk menganalisis pelaksanaan dan kinerja SRG Kopi. Berdasarkan analisis deskriptif dan Importance Performance Analysis (IPA), PT Ketiara merupakan pengelola SRG Kopi di Aceh Tengah yang telah berkontribusi terhadap peningkatan volume dan nilai barang dalam SRG Kopi. Berdasarkan persepsi responden petani kopi, kinerja PT Ketiara didukung oleh atribut kejelasan tata cara pembuatan resi gudang (prosedur, waktu dan biaya), pemahaman petugas dalam penerbitan resi, pengujian mutu produk yang transparan dan akurat, pengelolaan gudang penyimpanan, kemudahan saat pengeluaran barang, keberadaan fasilitas penjamin, keamanan gudang, fasilitas gudang yang terstandar, ketersediaan informasi harga, bantuan pemasaran oleh pengelola gudang, serta perolehan harga jual yang menguntungkan. Dukungan kebijakan yang diperlukan ke depan adalah sosialisasi kepada petani serta pemberian bagi pihak swasta untuk mendirikan dan mengembangkan kapasitas gudang untuk SRG Kopi

Abstract

Misuse of hazardous materials may risk human health and the environment. In order to protect consumer's rights from the illegal behavior of producers, importers, distributors, and other stakeholders along the distribution of goods and services, The Government has issued Trade Minister Regulation Number 44/M-DAG/PER/9/2009 regarding Procurement, Distribution, and Surveilance of Hazardous Materials. This study is conducted in Makassar City, and the objectives of this paper are to identify and to evaluate the implementation of the Trade Minister Regulation. By using Regulatory Impact Assesment, the study reveals that Trade Minister Regulation Number 44/M-DAG/PER/9/2009 regarding Procurement, Distribution, and Surveilance of Hazardous Materials needs to be revised and consummated in order to provide effectiveness and prevention of misuse of hazardous materials, especially in foodstuffs.        Keywords:  Hazardous material, Trade Minister Regulation Number 44/M- DAG/PER/9/2009, Regulatory Impact AssesmentPenyalahgunaan bahan berbahaya dapat menyebabkan resiko bagi kesehatan manusia dan juga lingkungan hidup. Dalam rangka melindungi hak-hak konsumen dari penyalahgunaan yang dilakukan produsen, importir, distributor dan setiap pihak yang berada dalam jalur perdagangan barang atau jasa, pemerintah menetapkan Peraturan Menteri Perdagangan Nomor: 44/M- DAG/PER/9/2009 tentang Pengadaan, Distribusi dan Pengawasan Bahan Berbahaya. Penelitian ini dilakukan di Makassar untuk mengetahui gambaran pelaksanaan sekaligus mengevaluasi Permendag. Dengan menggunakan metode Regulatory Impact Assesment (RIA), hasil penelitian menunjukkan bahwa Permendag tersebut perlu direvisi dan disempurnakan sehingga pelaksanaannya bisa lebih efektif dan tidak terjadi penyalahgunaan B2, khususnya yang terkait dengan bahan pangan. Abstract

The government has stipulated Trade Minister Regulation Number 16/M-DAG/PER/3/2017 regarding Refined Sugar Trade in Commodity Auction Market. However, the method of determining the highest and the lowest sugar price has not been arranged in the regulation. Thus, this study aims to analyze the price range of Refined Sugar in Commodity Auction Market. Import parity approach of raw sugar is utilized to calculate auction price range. The cost components are highest and lowest raw sugar price in international market as well as tolling fee for production and distribution of refined sugar. The result indicates that the estimated lowest price is between IDR 7,869/Kg and IDR 8,176/Kg and the estimated highest price is between IDR 11,527/Kg and IDR 11,742/Kg. This study recommends that import parity approach of raw sugar can be used to determine the price range of refined sugar. However, technical guidance for seller/buyer with existing sales contracts, technical team consisting representative of stakeholders to anticipate the fluctuating price issue, and the certainty of import quota for raw sugar as supply guarantee of refined sugar in action market are needed to be considered in order to support the regulation. Keywords: Refined Sugar, Auction Market, Parity Price Pemerintah menerbitkan Peraturan Menteri Perdagangan Nomor 16/M-DAG/PER/3/2017 Tentang Perdagangan Gula Kristal Rafinasi (GKR) Melalui Pasar Lelang Komoditas (PLK). Dalam regulasi dimaksud, terdapat 1 (satu) aspek dalam mekanisme lelang yang belum dicapai kesepakatan, yaitu metode penentuan Harga Batas Bawah (HBB) dan Harga Batas Atas (HBA) penjualan GKR. Untuk menganalisis besaran rentang harga lelang GKR, digunakan pendekatan paritas impor GKM dengan komponen harga GKM tertinggi dan terendah, serta biaya tolling terkait produksi dan distribusi GKR. Besaran HBB diperkirakan berada pada kisaran Rp 7.869/Kg dan Rp 8.176/Kg dan HBA sebesar Rp 11.527/Kg dan Rp 11.742/Kg. Sebagai perangkat kebijakan, pendekatan paritas impor GKM dapat digunakan untuk menentukan rentang harga GKR. Namun demikian diperlukan beberapa pertimbangan antara lain petunjuk teknis bagi peserta lelang yang sudah memiliki kontrak penjualan, dukungan tim teknis yang terdiri dari perwakilan pemangku kepentingan untuk mengantisipasi dinamika harga GKM, serta kepastian kuota impor GKM dalam menjamin supply GKR di PLK.
