Abstract

This study aims to know and analyze and examine the realization of good governance principles in fisheries management regulation in Indonesia; analyze and formulate the ideal fisheries management regulation model in accordance with the concept of good governance.This research is normative juridical research, which is research that puts law as a building of norm system, consisting of principles, norms, rule of law, judgment, agreement, and doctrine. The approach used in this normative legal research is the statute approach and the conceptual approach. The data obtained were analyzed by qualitative method.            Based on data analysis, it can be concluded that 1) Realization of 8 Main Characteristics of good governance according to UNESCAP are participation, orientation on consensus, accountable, transparent, responsive, effective and efficient, fair and inclusive and follow the rule of law in law, and efficient that cannot be applied; 2) The ideal fisheries management model in accordance with the principle of good governance is a co-management model, because this model use community empowerment and involve all stakeholders as well.

Abstract

The management of mineral and coal mining by Freeport has been carried out since 1967 based on a work agreement/contract of work, which is regulated in Law No. 11 of 1967 concerning Basic Mining Provisions. Since the enactment of Law no. 4 of 2009 concerning Coal Minerals under the authority in the management of minerals and coal changed from a work agreement/contract of work to a mining business permit. This article will try to respond to opportunities for contract extension or termination of work contacts and see which regimes will provide greater opportunities for the benefit of the state (in the sense of greater chance of realizing people's welfare). The provisional hypothesis of this article is that the licensing regime is more appropriate to be the basis for implementing the management of mineral and coal mining.

Abstract

This study analyzes the challenges faced by PEKKA women in Bantul regarding economic empowerment amid the Indonesian government's social restriction policies. It also explores the strategies these women have implemented to survive and strengthen community cooperatives during and after the pandemic. Using a socio-legal method with an intersectional approach, the results indicate that the pandemic and social distancing measures have significantly impacted the economies of female-headed households compared to those supported by both husbands and wives. This impact is particularly pronounced for women who run small businesses that had to close during the pandemic. PEKKA women work collectively in community cooperatives to support their members who are experiencing economic difficulties. This community economic empowerment is supported by various capacity-building programs for strengthening skills and business diversification. As a result, PEKKA women have been able to overcome adversity and emerge stronger after the pandemic. This experience demonstrates that individual women's empowerment and collective empowerment are closely interconnected. The relationship between the two suggests that individual agency can lead to collective empowerment, while, conversely, collective empowerment can also influence individual growth. Through the analysis of gender and class intersectionality, the similarity of the background of women who are members of the PEKKA cooperative strengthens the bonds between them and becomes a significant driver to overcome adversity. In contrast, cooperatives with heterogeneous members tend to experience decline.
