Abstract

To realize the purpose of marriage, there are many challenges and trials experienced by husband and wife due to the uncontrolled use of sosial media which leads to divorce. Divorce occurs due to several factors including the influence of sosial media. The development of sosial media brings many benefits to society, but if it is not wise in its use, it is very detrimental to its users. This type of research is field research with a qualitative approach. Data were collected by interview and study of documents regarding divorce cases caused by the influence of sosial media in the jurisdiction of the Padang High Court of Religion. Furthermore, the data were analyzed descriptively with reduction, display and verification techniques. The results of the first study are that the legal basis used by the Panel of Judges in resolving this case is Government Regulation no. 9 of 1975 Article 19 hruf (c) in conjunction with Islamic Law Compilation Article 116 haruf (g and h) by considering the arguments for benefit to avoid negative things that will arise for the plaintiff and the defendant. Furthermore, the results of the second study are the forms of sosial media that cause divorce based on the analysis of the six decisions, namely: first, establishing quite intense communication via telephone with one of the defendant's ex-lover. The two defendants had an affair on Facebook, the three defendants often cheated on Facebook with other women. The four defendants often called other women. The five defendants often communicated with other men on their cellphones. The six applicants found another cellphone number in the respondent's cellphone which contained repeated short messages.

Abstract

Studi ini menyorot jumlah bagian warisan untuk anak perempuan lebih besar dari bagian warisan untuk anak anak laki-laki berdasarkan beberapa kasus yang ada di Kecamatan Tanah Cogok. Pembagian warisan terhadap anak perempuan ini dilaksanakan melalui cara ishlah. Adapun tujuan yang ingin dicapai dalam tesis ini adalah: (1) Untuk mengetahui alasan, cara, pendapat para ulama serta tokoh adat dan perspektif hukum Islam terhadap Pembagian warisan hanya untuk anak perempuan. Penelitian ini menggunakan metode penelitian empiris, yaitu penelitian dengan adanya data-data lapangan sebagai sumber data utama. Berdasarkan hasil penelitian dapat disimpulkan bahwa pembagian warisan terhadap anak perempuan di Kecamatan Tanah Cogok adalah: (1) Alasan perempuan mendapatkan bagian warisan lebih banyak dari laki-laki adalah: tingkat kesulitan dalam menjaga serta mengurus kedua orang tua semasa masih hidup, sedangkan laki-laki sibuk dengan pekerjaannya sendiri. (2) cara pembagian warisan adalah: Warisan dibagikan setelah pewaris meninggal dunia serta setelah dilunasi semua hutang-hutangnya. (3) Pendapat toko adat dan ulama adalah dengan cara ishlah, dalam pembagian tersebut mereka tidak menemukan perseteruan antara ahli waris karena telah saling ridha. Kelompok toko ulama dan toko adat tidak setuju dengan alasan bahwa cara tersebut tidak sesuai dengan ketentuan hukum waris Islam. (4) praktek pelaksanaan pembagian warisan terhadap perempuan di Kecamatan Tanah Cogok secara teori tidak sejalan dengan hukum kewarisan Islam karena telah bertentangan dengan beberapa prinsip asas ijbari.

Abstract

This research aimed to elaborate the legal phenomenon of marriage postponement proposed by the applicant in the examination process of marriage dispensation cases at the Religious Courts of Bukittinggi. The decision is taken after the applicant receives out-of-court assistance in marriage dispensation cases by other institutions that has been explicitly regulated in the Supreme Court (PERMA) Number 5 of 2019. The purpose of the assistance is to ensure the children’s readiness in entering marriage and the follow up to limited amendment of Article 7 Marriage Law on age limit. This phenomenon is intriguing due to a sizeable finding on previous marriage dispensation cases where most applicants insisted on getting married soon. This field study is descriptive qualitative research applying the descriptive-analysis method. The empirical-juridical approach was employed, analyzing primary and secondary data sourced from interviews and documentations. The collected data were subjected to Creswell’s technique starting from data processing to data interpretation. The results showed that the assistance practice has successfully encourage many child applicants to make decisions based on their best interests, namely postponing the marriage that is facilitated through an integrated system that includes psychological examination, legal approach, and religious approach. Indeed, this system is non-existent in the previous examination process of marriage dispensation cases. Interpretation and realization of Article 15 of PERMA are perceived to have contributed to the decreasing number of marriage dispensation cases in the Religious Courts of Bukittinggi, and establishing PERMA Number 5 of 2019 as the law that guarantees the prevention of child marriage.

Abstract

This study examines the legal pluralism in Yemen, which develops through a complex interaction between Islamic law (sharia), state law (qanun), and tribal customary law (‘urf) amidst a prolonged political and humanitarian crisis. These three legal systems operate not only in parallel but also in competition to establish authority, legitimacy, and mechanisms for dispute resolution. The purpose of this research is to analyze the structure, dynamics, and dialectics of these legal systems as well as their impacts on society, particularly vulnerable groups such as women and children. This study employs a qualitative descriptive method based on library research using primary sources including Yemeni legal documents, international reports, and recent academic studies. The findings reveal that sharia remains dominant in family law, state law governs civil and economic sectors, and customary law plays a significant role in local dispute settlement during the weakening of state institutions. Armed conflict intensifies legal fragmentation, creating severe uncertainty in access to justice while enabling militias to politicize legal institutions. The study concludes that Yemen’s legal pluralism is hybrid, dynamic, yet fragile, as it is not supported by a stable state structure. Therefore, reconstructing Yemen’s legal framework requires harmonizing sharia, state law, and customary law through institutional reform, strengthening the rule of law, and ensuring protection for vulnerable groups. This study also recommends a reconstructive approach that incorporates local values and modern legal standards to build a more inclusive, adaptive, and resilient legal system for Yemen.

Abstract

Islamic law in Indonesia experienced significant development during the New Order era, when the government began integrating various aspects of Islamic law into the national legal system despite maintaining restrictions on Islamic political activities. This integration was realized through the enactment of several important regulations, such as Law Number 14 of 1970 on the Basic Provisions of Judicial Power, Law Number 1 of 1974 on Marriage, Government Regulation Number 28 of 1977 on the Endowment of Owned Land, Law Number 7 of 1989 on Religious Courts, and Presidential Instruction Number 1 of 1991 on the Compilation of Islamic Law. These regulations demonstrate that Islamic law was no longer merely a moral religious norm but had gained legitimacy as an integral part of Indonesia’s positive legal system.This study employs a library research method with a descriptive qualitative approach. Data were collected from literature, journals, statutory documents, and scholarly opinions, then analyzed qualitatively to describe the processes, policies, and dynamics of Islamic law integration during the New Order era. The findings indicate that the integration of Islamic law in this period was pragmatic and state-controlled, with Islamic legal provisions accommodated as long as they supported national stability and development agendas. Nevertheless, this era became an essential foundation for the advancement of Islamic law in Indonesia, particularly in strengthening religious courts, codifying family law, and structuring national endowment (waqf) administration.Keywords: Islamic Law, New Order, Legal Integration, Religious Courts, Compilation of Islamic Law

Abstract

Artikel ini membahas tentang peradilan agama di Turki serta transisinya dari sistem hukum tradisional berbasis syariat menuju sistem hukum sekuler. Tujuan utama penelitian ini adalah untuk memahami bagaimana peradilan agama berfungsi dalam sistem hukum tradisional, perubahan yang terjadi selama masa transisi menuju sekularisme, serta pengaruh warisan agama terhadap sistem hukum dan masyarakat Turki kontemporer. Metode penelitian yang digunakan adalah studi kepustakaan (penelitian perpustakaan), dengan mengandalkan data sekunder berupa buku, jurnal, dan artikel ilmiah yang relevan. Data dikumpulkan kemudian dianalisis secara deskriptif, Kajian ini menelaah ulang dinamika peradilan agama di Turki serta transisinya dari sistem hukum tradisional berbasis syariah pada era Kesultanan Utsmaniyah menuju sistem hukum sekuler modern. Fokus analisisnya terletak pada perubahan struktur, fungsi, dan pergerakan agama akibat kebijakan modernisasi hukum yang dilakukan oleh negara. Temuan menunjukkan bahwa meskipun peradilan agama telah dihapus secara formal, warisan dan nilai-nilai hukumnya masih memberi pengaruh dalam praktik hukum dan kehidupan sosial di Turki kontemporer.

Abstract

The development of National Strategic Projects (NSP) requires a substantial amount of land. However, the land acquisition process in Indonesia often encounters the complexity of legal pluralism, particularly in regions where customary law remains deeply rooted, such as West Sumatra, Jambi, and Riau. In West Sumatra, communal and sacred ulayat rights pose significant challenges to the implementation of land acquisition under Law No. 2 of 2012. Similarly, in Jambi and Riau, various forms of customary land rights remain fundamental to local decision-making, which often diverges from state law. This study examines the dynamics of interaction between state law and customary law in NSP land acquisition through a comparative approach. The findings reveal that disharmony between these two legal systems can trigger agrarian conflicts and social resistance, potentially obstructing development. Nevertheless, legal pluralism also provides opportunities for negotiation, adaptation, and the creation of more inclusive models of legal harmonization. This study emphasizes the importance of participatory and responsive approaches in national agrarian policy to ensure that NSP development proceeds in a just manner while respecting local wisdom.
