Abstract

Legal aid had the meaning of access to justice, which was the ability of people to seek and obtain restoration of their rights only through formal and informal justice court. The provision of legal aid providers in Law Number 16 of 2011 was a guarantee of the constitutional rights for the person or group of people which were categorized as poor people. Political law was something which underlies the basic policy of the promulgation of a regulation and the basic policy of the enactment of a certain regulation in the national legal system. The regulation and enforcement of sharia banking regulations in Indonesia from a political perspective of Islamic law was to be understood worthily, the existence of sharia banking regulations in Indonesia currently strengthened the theory of positivism of Islamic law and strengthened the paradigm of prophetic legal in the national legal system. According to the authors, the regulations contained in Law Number 16 of 2011 concerning legal aid, the most important thing was to provide legal assistance as a tool in law enforcement and justice. The legal assistance can be carried out in existence when the subject of legal aid, law enforcers and law institutions of sharia arbitration (Basyarnas) was functioning properly. Occasionally, the political view of Islamic law which had the main objective was the formation of justice products based on the Qur'an, Al-Hadith, Ijma and Qias in the concept and practice levels. Then the implementation of Law Number 16 of 2011 concerning legal assistance by Shari'ah arbitration in resolving Islamic banking disputes, with clear processes or mechanisms and agreements, arbitration agreement clauses before or after related to the agreement from the beginning was to provide convenience in resolving banking disputes or non banking disputes.

Abstract

Bela Negara merupakan sikap, tindakan, dan perilaku yang dilakukan atas kesadaran diri sendiri dengan dilandasi pemikiran untuk melindungi dan menjaga kedaulatan serta eksistensi Negara Kesatuan Republik Indonesia yang berdasarkan Pancasila dan Undang-Undang Dasar 1945. Wujud bela negara ialah dengan nilai-nilai seperti cinta tanah air, kesadaran berbangsa dan bernegara,yakinakan kesaktian Pancasila, relaberkorban untuk bangsa dan negara,serta mempunyai kemampuan awal bela negara. Abstract

Partai politik dibentuk untuk menjalankan kekuasaan politik baik ketika membentuk pemerintahan atau ketika partai politik sebagai oposisi di dalam pemerintahan. Partai politik diadakan tidak lain untuk mencapai kekuasaan baik dilembaga eksekutif maupun lembaga legislatif. Salah satu fungsi dari partai politik adalah sarana rekruitmen politik yang dilakukan melalui   pemilu   yang   sudah   lazim   dilaksanakan   di   negara-negara   demokratis   untuk melahirkan pemimpin-pemimpin bangsa. Fungsi inilah yang dirasa belum maksimal karena pada proses pemilu serentak ini ada beberapa daerah yang memiliki kandidat tunggal kepala daerah, bahkan daerah yang memiliki dua sampai tiga calon pun dikhawatirkan pada akhirnya akan memunculkan juga kandidat tunggal dikarenakan banyak yang tidak lolos verifikasi. Hal ini pada akhirnya akan berdampak pada dipertanyakannya nilai-nilai demokrasi yang berlaku  di Indonesia  dan kinerja  partai politik  dalam  melahirkan  kader-kader  pemimpin bangsa.

Abstract

Tindak Pidana Pencemaran Nama Baik terjadi di wilayah hukum Pengadilan Negeri Gunung Sugih dalam Putusan Perkara Nomor 27/Pid.Sus/2019/PN.Gns. Terdakwa dijatuhi hukuman Pasal 27 Ayat (1) Jo. Pasal 45 Ayat (1) Undang-Undang Nomor 19 Tahun 2016 tentang Pencemaran Nama Baik dengan pidana penjara selama 2 (Dua) Tahun 6 (enam) bulan serta denda sejumlah Rp.100.000.000 (seratus juta rupiah. Penerapan Pasal 27 ayat (1) jo. Pasal 45 ayat (1) Undang-undang No.19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik sudah tepat mengingat pasal tersebut merupakan peraturan khusus atau Lex Specialis Derogat Legi Generalis (Peraturan Khusus mengenyampingkan peraturan yang umum),mengenai pertimbangan Hakim Pada Putusan Perkara nomor 27/Pid.Sus/2019/PN.Gns, telah mempertimbangkan Keadilan, Kemanfaatan, dan Kepastian Hukum baik bagi terdakwa, korban, masyarakat dan negara, serta pelaksanaan hukuman secara admnistratif dilakukan oleh kejaksaan dan secara operasional dilakukan oleh lembaga pemasyarakatan.

Abstract

Article 23 of the Commercial Code stipulates that registration shall be filed through the Registrar's Office of the District Court of the jurisdiction where the company is domiciled. Whereas in Article 3 Paragraph (2) Permenkumham No. 17 of 2018 says that registration is submitted through the Business Entity Administration System (SABU). Seeing this, the issue of the existence and binding force of the laws and regulations regulated in Article 8 paragraph (1) of Law no. 12/2011, including the Ministerial Regulation, does not only regulate the existence of laws and regulations on a delegation basis. issuance of a new regulation regarding the establishment and registration of limited partnerships/CV in the business entity administration system (SABU) in accordance with the provisions of Article 5 paragraph (1) of the Regulation of the Minister of Law and Human Rights Number 17 of 2018 concerning Registration of limited partnerships, firm partnerships and civil partnerships which previously was only regulated in the Criminal Code. This research uses normative juridical research methods. The first conclusion is drawn, with the enactment of Permenkumham No. 17 of 2018, CV registration is easier and more organized and this also makes it easier for investors to get information about CVs that have been registered on SABU. Problems with establishing a CV from Permenkumham No. 17 of 2018 is the first, the establishment of a CV must order a name first before finally registering the CV on SABU. Second, the place for CV registration is changed to SABU. Third, the establishment of a CV is required to use an authentic deed.
