Abstract

Pandemi Covid-19 telah merugikan perekonomian masyarakat dan negara. Banyak perusahaan yang terdampak Covid-19 terpaksa memberhentikan karyawannya dan melakukan pemutusan hubungan kerja. Persoalannya, apakah perusahaan boleh berhenti bekerja karena Covid-19 dan apakah perusahaan bisa bangkrut karena tidak bisa menjalankan kewajibannya kepada pekerjanya. Metode penelitian yang digunakan adalah penelitian kepustakaan dengan menggunakan data sekunder dan jenis penelitiannya adalah kualitatif. Kesimpulannya, perusahaan dapat melakukan pemutusan hubungan kerja selama Covid-19 dengan alasan Overmacht apabila perusahaan dapat membuktikan bahwa akibat pandemi Covid-19 tidak mampu lagi menjalankan kewajibannya terhadap pekerja/buruh.

Abstract

To address this issue, some countries have implemented policies governing unpaid internships, including time limits and minimal financial compensation. This aims to protect the rights of young workers and prevent labor exploitation. On the other hand, there are also opinions that companies should be more responsible and value the contributions made by interns by providing reasonable financial incentives. Overall, Unpaid Internship has significant pros and cons. While it can provide valuable opportunities for students or recent graduates, there needs to be regulations and policies that recognize the need for fair financial incentives and increased protection for young workers. In a society that is increasingly moving towards inclusivity and equality, it is important to consider the balance between company interests and workers' rights.

Abstract

The Jiwasraya case is a fraud auditing legal case that has taken a lot of public attention and is particularly influential on capital market investors. This study aims to examine a case of financial statement manipulation or fraud that has occurred in Indonesia, namely PT. Asuransi Jiwasraya (Persero). This research used qualitative methods that produced data and/or results descriptive in the form of words in writing or oral forms from what the researchers observed. The results of this study show that PT. Asuransi Jiwasraya (Persero) has been proven to commit fraud by determining several aspects, such as fraud categories, analysis of the geographical locations or industries where fraud occurred, profile of victims and perpetrators of fraud, motive of the prepetrators, impact of fraud, and strategies in detecting fraud. The results indicate that fraud can involve and harm many parties, so this research is expected to motivate the company in improving the internal control of the fraud happened.
