Abstract

Putusan verstek seringkali menimbulkan aspek tidak baik bagi perempuan dan anak pasca perceraian. Penelitian bertujuan mengkaji perlindungan hak perempuan dan anak, upaya yang dilakukan dan kebijakan hakim memutuskan perkara verstek. Peneliti menggunakan metode penelitian yuridis empiris. Bahan hukum primer dan sekunder menjadi bahan utama serta data primer diperoleh dengan wawancara. Analisis data dilakukan secara kualitatif. Hasil penelitian menunjukkan perlindungan perempuan dan anak dalam putusan verstek sangat rendah disebabkan tidak adanya tuntutan hak dari perempuan. Perempuan jarang melakukan upaya untuk menggugat kembali berkaitan hak untuk diri dan anaknya pasca perceraian. Kebijakan hakim dengan penggunaan hak ex officio bila perempuan tidak nusyuz.

Abstract

Until now there has not been an in-depth and comprehensive of spatial planning based on local wisdom as strengthening the specificity of the Aceh region based on Law Number 11 Year 2016 concerning Aceh Government and Qanun No. 4 of 2003 concerning the Mukim Government. The purpose of this study is to analyze the local wisdom of spatial planning for sustainable settlements in Aceh. This research is a normative-supported empirical law study. The results showed that in the preparation of the Rencana Tata Ruang Wilayah (RTRW) the Mukim/mukim was not involved. In fact, information regarding the RTRW documents was never shared with the Imeum Mukim. The results of research in the residential areas of Aceh Besar, Pidie Jaya and North Aceh districts found that generally Mukims submitted the same complaints where Mukim was not informed or involved in the preparation of the RTRW in their area. Mukim’s authority is only limited to the resolution of disputes arising among the residents of the village in the Mukim region.

Abstract

Traditional medicinal knowledge is part of traditional knowledge and is also recognized as communal intellectual property, as stipulated in Article 18B paragraph (2) of the Indonesian Constitution concerning the traditional rights of communities, and Article 28I paragraph (3) of the Constitution regarding respect for cultural identity and the rights of traditional communities.This study aims to analyze the protection of traditional medicinal knowledge as communal intellectual property in Aceh and the role of women in managing traditional medicinal knowledge in Aceh. This research employs a qualitative method with an empirical legal approach, using both primary and secondary data. Primary data were collected through structured interviews with respondents and informants.The findings indicate that there is currently no protection for traditional medicinal knowledge as communal intellectual property (CIP) in Aceh, as it has not yet been documented or recorded. The Acehnese community preserves traditional medicinal knowledge orally, passing it down to the next generation within their families particularly among women who manage herbal recipes making this knowledge highly vulnerable to loss and difficult to protect from biopiracy. Women hold a strategic role as managers, inheritors, and innovators in the development of traditional medicinal knowledge, whether through family healing practices, customary rituals, or community-based treatments.
