Abstract

Traditional fishermen feel the impact of the damage of marine ecosystems and fisheries. The damage is not only caused by the consumption aspect, but also due to the government policy. Although it has great potential, but most of the traditional fishing communities are poor. This study seeks to answer three questions, namely: how to protect traditional fishermen in Aceh in connection with the consumption of fishery resources? What factors cause justice to be important in the context of the protection of traditional fishermen? How does the development of the law is supposed to do to protect traditional fishing? This study examines the law in non-doctrinal perspective with socio-legal approach. The third source of information is the Bureau of Maritime Affairs and Fisheries, FAO staff, the community of fishermen, fishery-environmental NGOs, and academics marine, fisheries, and the customary law of the sea. Protection of traditional fishermen is very important undertaken by the country in the consumption of fishery resources due to the presence of traditional fishermen in exploiting fisheries resources not only as an economic activity, but also related to culture. Fairness factor in the protection of traditional fishermen need to be explored to remember a few things, namely poverty, access, utilization, ease of access to markets, and access management. Development protection laws in connection with the issue of fishermen should be the most important principle, which is to bring the state in providing basic rights as outlined in the Constitution. Access restrictions or lack of interest will basically lead a traditional fishing in marginal conditions either political, social, cultural, or economic. This study suggests that in order to restore the traditional fishermen, it is important to conduct study on the various legislations, ranging from legal to technical regulations, to find a map of the position of traditional fishermen in Indonesia. Based on these maps, traditional fishing is authorized with the participation of various sectors of the program provided for the fishing communities.

Abstract

Peraturan Mahkamah Agung (PERMA) Nomor 1 Tahun 2016 tentang Prosedur Mediasi menjadi upaya penyelesaian perkara perceraian, karena dapat merundingkan keinginan para pihak dengan jalan perdamaian.  Upaya mediasi tentunya akan menguntungkan pula bagi pengadilan karena penggunaan mediasi diharapkan dapat mengatasi masalah penumpukan perkara. Namun dalam praktik banyaknya kegagalan dalam mediasi di Mahkamah Syar’iyah Sigli dan Mahkamah Syar’iyah Jantho. Penelitian ini bertujuan untuk mengetahui dan menganalisis proses mediasi yang dilakukan oleh mediator dalam penyelesaian perkara cerai gugat di Mahkamah Syar’iyah Sigli dan Mahkamah Syar’iyah Jantho. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian yuridis empiris. Hasil penelitian menunjukkan pelaksanaan mediasi di Mahkamah Syar’iyah Sigli dan Mahkamah Syar’iyah Jantho sudah sesuai dengan Perma Nomor 1 Tahun 2016, namun belum efektif. Hambatan bagi mediator dalam penyelesaian perkara cerai gugat di Mahkamah Syar’iyah Sigli dan Mahkamah Syar’iyah Jantho adalah adanya sarana belum memadai, keterbatasan mediator, tidak ada itikad baik salah satu pihak atau para pihak, keinginan kuat para pihak untuk bercerai, sudah terjadi konflik berkepanjangan dan adanya kekerasan dalam rumah tangga. Upaya penyelesaian hambatan melalui pendekatan psikologis, meningkatkan kemampuan mediator dan itikad baik dari para pihak.

Abstract

Abandoned land is land that has been granted rights by the state in the form of Ownership Rights, Business Utilization Rights, Building Use Rights, Use Rights and Management Rights, or basic control over land that is not cultivated, not used, or not utilized in accordance with the circumstances or the nature and purpose. granting rights or the basis for their control. The definition of abandoned land is not regulated in Government Regulation of the Republic of Indonesia Number 11 of 2010 concerning Control and Utilization of Abandoned Land (“PP No. 11/2010”). However, it is regulated in Article 1 point 6 of the Regulation of the Head of the National Land Agency of the Republic of Indonesia Number 4 of 2010 concerning Procedures for Controlling Abandoned Land.The results of the study explain that the judge with his considerations in the case related to the transfer of rights to abandoned land belonging to state-owned enterprises in the decision Number: 3/Pdt.G/2011/PN-Lsm The judge considered that the problem in the abandoned domain was absolutely not the authority of the lhokseumawe district court. However, in the State Administrative Court, because the plaintiff in his case mentioned the ownership assets of the land. Thus, the judge rejected all of the plaintiffs' claims.

Abstract

The concept of legal protection in bankruptcy has so far been seen as a way out of the problem of accounts receivable debt which coincides with a bankrupt debtor, where the debtor no longer has the ability to repay the debts which are past due to their creditors, so that the steps to submit a request for the determination of bankruptcy status by the Court Commerce of the debtor is a possible step to resolve the bankruptcy case. Bankruptcy was originally regulated in Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations (UUK and PKPU). Furthermore, if the parties submitting bankruptcy applications, the Commercial Court Judges at the District Court are required to examine and hear the case being submitted. The research method used is the normative legal research method or library research with the statute aprroach approach and the case aprroach approach. Based on the results of the study, it is known that the form of legal protection for creditors against paying off debts from bankrupt assets in the Supreme Court Decision Number 511 / K / Pdt. Yinchenindo Mining Industry (in bankruptcy) by law becomes a guarantee for its debts to preferred creditors, in this case the Head of the Second Foreign Capital Investment Service Tax Office. Furthermore, the UUK and PKPU also guarantee the rights of creditors in bankruptcy, especially the rights of preferred creditors who have a special position with peace efforts and the postponement of obligations to pay debts of bankrupt debtors to their creditors as stipulated in Article 222 of the UUK and PKPU. The concept of the distribution of bankrupt assets distributed to preferred creditors after deducting bankruptcy fees and compensation for curatorial services where the payment process is settled based on the principle of fairness and balance set forth in Article 265 of the UUK and PKPU, where the preferred creditor parties receive the remaining payment of the receivables amounting to 62.5% ( sixty two point five percent) of the bankruptcy assets.It is expected that the Judges of the Commercial Court and the Court of Appeals at the Supreme Court consider the rights of preferred creditors who pay off their receivables first. The Debtor should be able to immediately submit a request to postpone the debt payment obligation so that the remaining outstanding debt receivables cannot be paid off to the preferred creditors through the sale of free assets. Abstract

Perjanjian penitipan barang dapat terjadi bila terdapat kata sepakat antara pihak yang mendapatkan barang dari orang lain untuk menyimpannya dan mengembalikan barang tersebut pada keadaan yang sama. Pelaksanaan perjanjian penitipan uang antara kedua belah pihak dalam kasus ini tidak berjalan sesuai dengan apa yang telah disepakati. Kasus ini terdaftar dengan nomor register 32/pdt.g/2019/pn.bna. Namun setelah adanya proses di pengadilan, pihak dari tergugat juga tidak dapat menyerahkan kembali uang titipan dari penggugat. Hal ini berkaitan dengan bagaimana terjadinya wanprestasi berdasarkan putusan nomor 32/pdt.g/2019/pn.bna, lalu faktor yang menyebabkan terjadinya wanprestasi, serta upaya yang ditempuh dalam penyelesaian wanprestasi dalam perkara perjanjian penitipan uang. Penelitian ini bertujuan untuk menganalisis pelaksanaan perjanjian penitipan uang yang mengindikasikan terjadinya wanprestasi pada putusan nomor 32/pdt.g/2019/pn.bna, faktor yang menyebabkan wanprestasi, dan upaya upaya yang dilakukan untuk penyelesaian wanprestasi dalam perjanjian penitipan uang. Metode penelitian yang digunakan ialah metode yuridis empiris yang menggunakan pendekatan kepustakaan dan pendekatan lapangan. Pendekatan lapangan dilakukan dengan menggunakan cara wawancara responden dan informan. Disarankan untuk dapat melakukan pengawasan kepada pihak tergugat dengan cara laporan secara rutin agar pihak tergugat dapat menjalankan hukumannya untuk menyerahkan kembali uang titipan dari Abdul Jabar. Kata kunci: Perjanjian, Penitipan Uang, Wanprestasi.

Abstract

General Election is a means of implementing people's sovereignty which is carried out directly, freely, secretly, honestly and fairly based on the Pancasila and the 1945 Constitution of the Republic of Indonesia. Implementation of Elections is the implementation of the stages of elections which are carried out freely, fairly, and honestly.   The purpose of this study is to analyze the principle of justice in the requirements to become a legislative member for the Village Head based on Law Number 7 of 2017 and Election Commission Regulation Number 20 of 2018. The results of the study showed that the first election held in 2019 did not implement the principles of justice in terms of the legislative candidate for the Village Head. The public can provide legal certainty for the implementation of the 2019 Election law. It is recommended to the General Election Commission to revise the Election Commission Regulation regarding the nomination of members of the DPR, Provincial DPRD, and Regency / City DPRD specifically in the requirements for candidates for the Village Head in Article 8 paragraph 1 letter b number 6 point b, to guarantee the rights of citizens and fulfill the principles of justice.

Abstract

The province of North Kalimantan is the youngest province in Indonesia, located in the northern part of Kalimantan Island. Northern Kalimantan Province is established based on Law No. 20 of 2012 establishing the Northern Kalimantan Province. Nunukan Regency is one of five districts / cities in the province of North Kalimantan covering an area of ​​14,263.68 km2. Geographically, Nunukan Regency is located in the northernmost region of Kalimantan, which borders directly with a neighboring country, Sabah-Malaysia. The legal status of the land becomes a written proof that is legally recognized. All land rights are recorded in the form of National Land Agency (BPN) certificates. BPN creates duplicates of landowners to avoid future risks, such as: B.: Lost certificates, burned certificates and duplicate certificates. In Indonesia, land ownership status is governed by the Basic Law of Agriculture (UUPA) No. 5 of 1960 on Agricultural Principles. Rural residents living in the Border Coast, especially in the Nunukan Subdistrict, Nunukan Utara district, is the Nunukan Regency, a leased land owned by PT. Inhutani as the de facto landlord (HGU), above the property for PT. Inhutani in the Nunukan district, Nunukan district, Nunukan Utara district stands thousands of buildings owned by both the community and the government, where the majority have no legal proof of domination. The problem in this study is the legal status of the ownership of land in the border coastal areas and the policy of the local government in providing legal solutions to control the use of land in coastal areas. Based on the results that concludes the legal status of the land of coastal residents who live in the region as the right boundary, as the conversion of Hak Guna Usaha (HGU) by PT.Inhutani is used, that researchers know ended Hak Guna Usaha ( HGU) was on the ground since 2009. But it was extended to 2038. While the legal solution for providing legal certainty of the owner of the building in the country of PT. Inhutani receives until the bleaching of the rights building use rights (HGB) to the community, because PT. Inhutani is no longer productive / operates and produces forest products, in Nunukan sub-district, Nunukan Utara village, but only the establishment of settlements and thousands of municipal and state buildings.

Abstract

Berdasarkan Qanun Aceh Nomor 9 Tahun 2008 tentang Lembaga Adat. Panglima Laut memiliki kewenangan yaitu bidang pengembangan dan penegakan adat laut, peraturan-peraturan di laut, dan pemanfaatan sumber daya kelautan dan peradilan adat laut. Panglima Laot adalah suatu lembaga yang memimpin adat istiadat, kebisaaan-kebisaaan yang berlaku dibidang penangkapan ikan, dan penyelesaian sengketa antar nelayan. Hasil penelitian menunjukkan bahwa: penyelesaian sengketa antara nelayan berdasarkan hukum adat laut melalui peradilan adat laut dilaksanakan secara tertutup di balai nelayan setempat dengan musyawarah dan semangat kekeluargaan masih relevan dilaksanakan demi menjaga kearifan lokal, namun belum terdokumentasi dengan baik

Abstract

In the context of Aceh, its society and social-ecnonomic development, based on a number of literatures, the meaning of local wisdom can be drawn from the values, norms, laws and knowledge formed by religious teachings, beliefs, traditional values and experiences inherited from ancestors ultimately forming a local knowledge system that is used to solve everyday problems by the community. Aceh, as a region, in addition to following national law practices and provisions, also has customary institutions and traditional / cultural values with its own management that involves community leaders who know a great deal about local wisdom in the region. This is where the roles of traditional leaders, religious leaders and socio-cultural figures are considered important in harmonizing local wisdom with spatial regulation and environmentally sustainable development
