Abstract

Regarding labour protection, therefore the Law Number 13 of 2003 concerning Manpower,Article 86 Paragraph (1) Letter a and Paragraph (2) states that:"Every worker/labourer has the right to receive protection on occupational safety and health". Then, the researchers will discuss the implementation of article 86 of law number 13 of 2003 concerning Manpower, occupational safety and health toward an operator of the gas station number 21.381.09 at RawaMakmurof Bengkulu City. The aim of this research was to know the implementation ofarticle 86 of Law Number 13 of 2003 concerning Manpower toward the operator of gas station number 21.381.09 atRawaMakmurof Bengkulu City. This research was an empirical study of qualitative research. The data sources used were secondary and primary data sources. In collecting the data, the researcher used interview, observation and documentation. After doing research, it can be concluded the following: Legal Protection at the gas stationare done by using Security Administration Body for Employment (BPJS Ketenagakerjaan) and Healthcare Security (BPJS Kesehatan), and conducted directly protection by the company by providing sweetened condensed milk as a neutralizing immune system, protective footwear shoes, and fire extinguishers as firefighters.

Abstract

This study aimed to determine and analyze the implementation of the cooperation contract between the Regional Government of Central Bengkulu Regency and advocates in the field of providing legal aid and to find out and analyze the settlement in the event of a dispute in the implementation of a cooperation contract between the Regional Government of Bengkulu Tengah Regency and an advocates in the field of providing legal aid. This research was an empirical research and the data analysis used was qualitative with deductive-inductive thinking method. The results showed that the cooperation contract between the Regional Government of Bengkulu Tengah Regency and advocates in the field of providing legal assistance was carried out through a written agreement. The legal basis for the cooperation contract was based on Article 9 letter a and b of Law Number 16 of 2011 concerning Legal Aid, specifically stipulated by the Decree of the Regent of Central Bengkulu Number 3 of 2013 concerning the Stipulation of Advocates/Lawyers in the Context of Resolving Legal Problems for Civil Servants/Apparatus in the Regional Government of Central Bengkulu Regency in 2013 and all costs in the implementation of the cooperation contract for the provision of legal assistance were borne by the Regional Government of Central Bengkulu Regency through Number DPA 1.20 (1.20.03) .20.09.5.2. Whereas the obstacles in implementing the cooperation contract between the Regional Government of Central Bengkulu Regency and advocates in the field of providing legal assistance included the payment of honorariums to lawyers who were often late or paid once every three months, as a result lawyers could not carry out their duties and functions properly. The settlement of these obstacles by both parties agreed to do non-litigation, which was negotiations, so that the cooperation agreement would not be broken.

Abstract

Pandemi Covid 19 yang dialami Indonesia sejak bulan Maret 2020, sampai saat ini telah merusak seluruh sendi sendi perekonomian. Dengan pertumbuhan ekonomi di bawah minus 2,07% menyebabkan Indonesia menghadapi krisis multi dimensi yang akhirnya bermuara pada tingginya angka kemiskinan. Berbagai upaya telah dilakukan pemerintah dalam mengatasi dampak Pandemi ini, anggaran 1.035,25 Trilliun yang diperuntukkan bagi pengadaan alat kesehatan, obat-obatan dan vaksin serta stimulus Bansos ditujukan untuk pemenuhan kebutuhan masyarakat. Sedangkan penghapusan PPnBM ditujukan untuk industry otomotif, adapun bagi pelaku Usaha Mikro Kecil Menengah (UMKM), pemerintah mengeluarkan regulasi Kridit Usaha Rakyat (KUR) dengan plapon pinjaman dua kali lipat dari sebelumnya Rp 50 jt menjadi Rp 100 jt, serta pinjaman KUR bagi masyarakat belum menikah dengan plapon pinjaman maksimal Rp. 10jt. Kebijakan pemerintah ditujukan agar para pelaku UMKM mampu bertahan dari keterpurukan usaha yang dijalaninya selama ini. Selanjutnya dikeluarkan lagi Peraturan Menteri Koordinator Bidang Perekonomian Republik Indonesia Nomor 6 Tahun 2020 tentang Perlakuan Khusus Bagi Penerima Kredit Usaha Rakyat Terdampak Pandemi Corona Virus Disease 2019. Suku bunga/marjin ditetapkan sebesar 6 % efektif pertahun diberikan kepada KUR mikro,KUR kecil, KUR penempatan tenaga kerja Indonesia, KUR khusus dan KUR super mikro. ABSTRACTThe Covid 19 pandemic that has been experienced by Indonesia since March 2020 has damaged all aspects of the economy. With economic growth below minus 2.07%, Indonesia is facing a multi-dimensional crisis that eventually leads to poverty. Various efforts have been made by the government to overcome the impact of this pandemic, a budget of 1,035.25 trillion is needed for the procurement of medical devices, medicines and vaccines as well as the social assistance stimulus aimed at meeting the needs of the community. While the abolition of PPnBM is aimed at the automotive industry, as for Micro, Small and Medium Enterprises (MSMEs), the government issued a regulation on People's Business Credit (KUR) with a credit ceiling that was doubled from the previous Rp 50 million to Rp 100 million, and KUR credit for the community has not yet been completed. married with a maximum credit ceiling of Rp. 10 million. The government's policy is intended so that MSME actors are able to survive the downturn in their business so far. Furthermore, Regulation of the Coordinating Minister for Economic Affairs of the Republic of Indonesia Number 6 of 2020 concerning Special Treatment for People's Business Credit Recipients Affected by the Corona Virus Disease 2019 Pandemic was issued. The interest rate/margin is set at 6% effective per year given to micro KUR, small KUR, KUR placement of workers Indonesian work, special KUR and super micro KUR.

Abstract

T Penelitian ini bertujuan untuk mengetahui bagaimana pelaksanaan perjanjian kerjasama antara Bank BRI dengan Agen BRILink, dan untuk mengetahui apa permasalahan dan hambatan pelaksanaan perjanjian kerjasama antara Bank BRI dengan Agen BRILink dalam rangka pemberdayaan UMKM di Kota Bengkulu. Penelitian ini adalah penelitian hukum empiris dengan Teknik penentuan sampel yaitu purposive sampling. Analisis dilakukan dengan menggunakan metode analisis kualitatif. Hasil Penelitian menunjukkan bahwa Perjanjian kerjasama juga merupakan dokumen yang berisikan hak dan kewajiban BRI dan agen BRILink yang disetujui dan ditandatangani oleh kedua belah pihak sebelum menjalankan kegiatan yang dimaksud didalamnya. Bank BRI yang telah memberikan kewenangannya kepada agen BRILink untuk melakukan kegiatan atau transaksi perbankan terhadap nasabah BRI. Terdapat beberapa masalah yang muncul dalam pelaksanaan perjanjian kerjasama antara BRI dan agen BRILink, seperti adanya agen BRILink yang wanprestasi, adanya penipuan dari nasabah yang dialami agen BRILink, dan masalah lainnya. Adapun hambatan dalam perjanjian antara BRI dengan agen BRILink, yaitu: sering terjadi gagal transaksi yang terkendala oleh gangguan jaringan, kemudian tidak tercapainya target yang telah disepakati, serta hambatan lain yaitu sharing fee atau pembagian hasil yang diberikan oleh pihak BRI.

Abstract

This community service program aims to raise awareness among dried fish business operators in Teluk Sepang Village, Kampung Melayu District, Bengkulu City, about the importance of branding in trading businesses. Additionally, it seeks to disseminate information regarding the scope and regulations of the Trademark Law to the community of dried fish business operators in the mentioned village and district. The program involves the dissemination and motivation of dried fish business operators/traders in Teluk Sepang Village, Kampung Melayu District, Bengkulu City. Based on the conducted activity, it was found that the operators lacked awareness of the law, primarily due to reluctance in trademark registration. They cited reasons such as operating in rented premises on a monthly basis and the possibility of relocating their businesses. Moreover, most traders do not have their own kiosks, and they rarely receive guidance from relevant agencies. Through this program, the aim is to motivate dried fish traders to establish their own business brands, thereby enhancing the economic value of their products.

Abstract

Mortgage Loan Agreements in Indonesian banking practice are generally drafted in the form of standard contracts containing exoneration clauses, which limit or transfer the bank’s legal liability to debtors as consumers. Such clauses may create an imbalance in the legal position of the parties and potentially harm the rights of debtors. In this context, notaries, as public officials authorized to draw up authentic deeds, play an important role in ensuring legal certainty and legal protection for the parties. This study aims to analyze the forms of legal protection available to debtors as bank customers against harmful exoneration clauses in mortgage loan agreements and to examine the responsibility of notaries in drafting credit agreements that contain exoneration clauses. This research employs a normative legal research method using statutory and case approaches. The results of the study indicate that legal protection for debtors against exoneration clauses can be provided through preventive and repressive measures as regulated under Article 18 of Law Number 8 of 1999 concerning Consumer Protection. Furthermore, notaries bear legal responsibility in the preparation of mortgage loan deeds to act honestly, carefully, independently, and impartially in accordance with the Notary Law. Notaries should refuse, explain, or correct exoneration clauses that conflict with prevailing laws in order to ensure fairness, balance, and legal certainty for all parties.

Abstract

This study examines the provisions on prisoners' rights in Law Number 22 of 2022 concerning Corrections and their compliance with the principles of criminal law, namely proportionality, human dignity, and the rule of law. The research background stems from various correctional problems in Indonesia, such as overcrowding, violence, discrimination, and lack of access to basic services, which often result in violations of prisoners' rights. This study uses normative legal methods by examining statutory regulations, criminal law principles, and correctional theory. The results show that Law Number 22 of 2022 regulates prisoners' rights more comprehensively through Articles 9 and 10, covering basic rights and integration rights, with the aim of supporting rehabilitation and social reintegration. Furthermore, the provisions in the law align with the principle of proportionality through measurable rights restrictions, the principle of human dignity through guarantees of humane treatment and prohibitions on violence, and the principle of the rule of law through clear legal procedures and oversight mechanisms. However, the implementation of the regulations still faces structural challenges in the field, necessitating the need for comprehensive strengthening of the correctional system

Abstract

This study analyzes the implementation of correctional guidance and security functions by the Regional Office of the Directorate General of Corrections in Bengkulu from the perspective of positive law. These functions are an integral part of the correctional system, aimed at developing the personality, independence, and social reintegration of inmates, while simultaneously maintaining the security and order of correctional facilities. The study employs a normative juridical approach using a statute approach, analyzing the prevailing legislation as the legal basis for the implementation of correctional guidance and security functions. The findings indicate that the Bengkulu Regional Office implements guidance functions through programs for developing inmates’ independence, vocational training, and virtual exhibitions of inmates’ work, while security functions are actualized through supervision, patrols, control measures, and coordination among correctional units. These functions are carried out in accordance with valid legal foundations, including Law Number 22 of 2022 on Corrections, Government Regulation Number 31 of 1999, and Minister of Immigration and Corrections Regulation Number 4 of 2024. The study recommends enhancing human resource capacity, routinely evaluating guidance programs, and developing innovative approaches to ensure that correctional operations are effective, secure, and beneficial to society.

Abstract

Micro, Small, and Medium Enterprises (MSMEs) play a vital role in the Indonesian economy by absorbing labor, creating jobs, and supporting economic growth, particularly in coastal market areas such as Malabero Village, Bengkulu City. This research aims to analyze the utilization of People’s Business Credit as a government-supported micro-credit program and its role in supporting business development among MSMEs in the coastal market area of Malabero Village. This research employed an empirical legal research approach using field data as the primary source, collected through interviews with MSME actors in the Malabero coastal market area. The findings indicate that the utilization of micro-credit remains relatively low, as only a small proportion of business actors have accessed the program, mainly those with higher capital needs, while limited information, low financial literacy, and fear of debt hinder wider participation. The research concludes that strengthening financial literacy, improving program socialization, and providing continuous assistance are essential to enhance effective micro-credit utilization and promote sustainable MSME development in coastal areas.
