Abstract

This research aims to explore the integration of recidivism risk assessment in Indonesia's punishment system with a more objective and data-based approach. The method used is normative research with a comparative legal approach, which compares the implementation of recidivism risk assessment systems in other countries with the practice in Indonesia. The results show that although recidivism risk assessment has the potential to improve justice and criminal justice effectiveness, there are major challenges in the form of inconsistency in the definition of recidivism, lack of clear time standards, and unfairness in rehabilitation assessment. Therefore, deep legal reforms and the use of data-driven methods balanced with humanitarian aspects are needed to create a more transparent and fair system. Suggestions from this research include the importance of developing clear standards regarding recidivism and increasing the capacity of judicial officers through training. In addition, the development of an objective data-based recidivism risk assessment system and strengthening collaboration between the public and private sectors in social reintegration are needed to achieve a more effective and fair criminal justice system.

Abstract

This study analyzes the implementation of correctional guidance and security functions by the Regional Office of the Directorate General of Corrections in Bengkulu from the perspective of positive law. These functions are an integral part of the correctional system, aimed at developing the personality, independence, and social reintegration of inmates, while simultaneously maintaining the security and order of correctional facilities. The study employs a normative juridical approach using a statute approach, analyzing the prevailing legislation as the legal basis for the implementation of correctional guidance and security functions. The findings indicate that the Bengkulu Regional Office implements guidance functions through programs for developing inmates’ independence, vocational training, and virtual exhibitions of inmates’ work, while security functions are actualized through supervision, patrols, control measures, and coordination among correctional units. These functions are carried out in accordance with valid legal foundations, including Law Number 22 of 2022 on Corrections, Government Regulation Number 31 of 1999, and Minister of Immigration and Corrections Regulation Number 4 of 2024. The study recommends enhancing human resource capacity, routinely evaluating guidance programs, and developing innovative approaches to ensure that correctional operations are effective, secure, and beneficial to society.

Abstract

This study analyzes the trafficking of Indonesian Migrant Workers (TKI) and Female Migrant Workers (TKW) abroad as a social pathology and the effectiveness of legal protection. Despite regulations such as Law No. 21 of 2007 and Law No. 18 of 2017, illegal agents, non-procedural departures, exploitation, and limited victim access to legal protection remain. This normative study uses literature and legal document analysis to identify gaps between regulation and implementation in the socio-economic context of migrant workers. Findings show TKI atau TKW trafficking is a systemic social issue influenced by poverty, low education, and limited employment alternatives. Effective legal protection requires strengthened regulations, agent supervision, public education, capacity building, international intervention, and socio-economic rehabilitation for victims. The study provides policy recommendations to enhance migrant worker protection and sustainably prevent human trafficking.
