Abstract

Indonesia is a sovereign country. Sovereign does not only mean "denotation"; which is the state has the power of government that is not subject to other state power. Implementation of the state intended to realize the peoples welfare. If it is associated to the competition with other countries, then, we will know more about the role of the state in protecting its citizens in order to avoid "homo homini lupus" as what Hobbes said. So, this is the challenge of the welfare state, wherein it should not fail. The existence of state failure cases in providing protection for its citizens, especially in free trade has become a scourge for the people. Those people who are not able to compete in free trade, in the end, they will only be a spectator and do not have any role in AEC 2015. State efforts to protect people among others: increasing competitiveness and export volume, then, prioritizing the use of the goods / services in the country. In the regulation, it needs to set rules on the security measures of domestic products and supervision over circulation of goods and services, and by applying the Early Warning System to the possibility of a surge in imports. Keywords: Sovereign, Welfare State, Competitiveness, ASEAN Economic Community 2015

Abstract

As a fiscal policy within the framework of regional autonomy, the allocation of DAU is an act that very important. It was meant to address financing capability gap between regions. The reason is because the DAU is the largest component of balance funds, namely the lack of 26% of the net domestic income in the state budget the amount of DAU scheme is not limiting, because it can only grow with the size of the authority delegated to the regions. DAU legal standing as a regional income in the financial relationship between the center and the regions based on the principle of autonomy is as a subsidy coming from the state revenue in the state budget that is allocated to local revenue in the budget based on fiscal decentralization. Keywords: General Allocation Fund, autonomy, regional autonomy

Abstract

Penelitian ini bertujuan untuk menganalisis diskursus pembatalan Perda pasca dikeluarkannya putusan MK No. 137/PUU-XIII/2015 dan No. 56/PUU-XIV/2016 atas pengujian UU No. 23 Tahun 2014 terhadap UUD 1945 yang dibatasi dalam dua rumusan masalah. Pertama, bagaimana implementasi pengujian Perda pasca Putusan MK No. 137/PUU-XIII/2015 dan No. 56/PUU-XIV/2016?. Kedua, apakah dampak putusan MK No. 137/PUU-XIII/2015 dan No. 56/PUU-XIV/2016 terhadap perkembangan hukum pemerintah daerah? Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Data yang digunakan adalah data sekunder yang berupa bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian menunjukkan bahwa: pertama, pasca putusan MK pengujian Perda hanya dilakukan oleh sebuah lembaga yudisial melalui judicial review di Mahkamah Agung. Kedua, terdapat dua dampak penting atas dikeluarkannya putusan MK, pertama, dengan dibatalkannya Pasal 251 UU No. 23 Tahun 2014 maka hal ini mengakhiri dualisme pengujian Perda, karena Menteri tidak dapat lagi melakukan executive review. Kedua, putusan MK o. 137/PUU-XIII/2015 dan No. 56/PUU-XIV/2016 tidak menghapuskan pengawasan Pusat terhadap Perda karena masih dapat dilakukan pengawasan preventif melalui executive preview.This study aimed to analyze the discourse of cancellation after the issuance of local regulations following the Constitutional Court decision No. 137/PUU-XIII/2015 and No. 56/PUU-XIV/2016 on judicial review of Law No. 23 2014 towards the 1945 Constitution which are restricted in two formulation of the problem. First, how is the implementation of a post-test Constitutional Court Regulation No. 137/PUU-XIII/2015 and No. 56/PUU-XIV/2016? Second, what are the effects of the Constitutional Court decision No. 137/PUU-XIII/2015 and No. 56/PUU-XIV/2016 on the development of the local government law? This study is a normative with statute approach and case approach. The data used was secondary data in the form of primary, secondary, and tertiary legal materials. The results showed that: firstly, the following decision of the Constitutional Court about regional regulations review can only be conducted by a judicial body through a judicial review in the Supreme Court. Secondly, there are two important effects on the issuance of the decision of the Constitutional Court, first, by the cancellation of Article 251 of Law No. 23 year 2014 then the duality of local regulation testing is ended, because the Minister can no longer perform executive review. Second, the decision of the Constitutional Court No. 137/PUU-XIII/2015 and No. 56/PUU-XIV/2016 does not abolish the supervision of the Center Government because they do preventive supervision through executive preview.

Abstract

Purpose: Realizing good local government governance and ensuring the availability of professional civil servants require planned and measurable human resource management. Therefore, the Pagar Alam City Government issued Pagar Alam Mayor Regulation No. 24 of 2021 concerning the Policy for Implementing the Civil Servant Talent Pool System within the Pagar Alam City Government. To realize good local governance and ensure the availability of professional civil servants. Method: Normative and empirical methods were employed. Data collection was carried out using field and literature studies. The data analysis was qualitatively descriptive. Result: Implementation of the Talent pool System as a strategy of the Pagar Alam city government to realize the professionalism of the performance of the state civil apparatus, the Pagaralam city government participated in a series of events held at the Regional VII Agency of the State Civil Service Agency (BKN) Palembang by sending 9 (nine) participants. However, the mayor’s regulation has not been fully and maximally realized within the Pagar Alam City government. Limitations: The factors that hinder the implementation of the talent pool system within the scope of the Pagar Alam city government are a lack of human resource participation and budget factors that have not been fully explained. Contribution: Implementation of the Talent pool system as a strategy of the Pagar Alam city government to realize professionalism in the performance of the state civil apparatus.

Abstract

Cyberbullying merupakan aksi di mana pelaku bertindak di luar batas kepada orang lain dengan cara mengirim atau mengunggah materi yang dapat merusak kredibilitas, menghina atau melakukan serangan sosial dalam berbagai bentuk, dengan memanfaatkan internet atau teknologi digital lainnya sebagai medianya. Pelaku dan korban dari cyberbullying itu sendiri kebanyakan terjadi pada anakanak. Sifat dari anak-anak yang kebanyakan ingin berkuasa atau senang mendominasi. Anak-anak ini biasanya merasa lebih hebat, berstatus sosial lebih tinggi dan lebih populer dikalangan teman-teman sebayanya. Kejahatan intimidasi sendiri telah diatur di dalam aturan perundang-undangan di Indonesia, yaitu di dalam KUHP maupun Undang-Undang ITE untuk kejahatan Cyberbulyying. Dalam KUHP diatur Pasal 310 ayat (1), (2), (3) KUHP. Cyberbullying pada UU ITE diatur pada Pasal 27 ayat (3) yang berbunyi “Setiap orang dengan sengaja dan tanpa hak mendistribusikan dan/atau mentransmisikan dan/atau membuat dapat diaksesnya Informasi Elektronik dan/atau Dokumen Elektronik yang memiliki muatan penghinaan dan/atau pencemaran nama baik, tak terkecuali dalam UU No. 35 Tahun 2014 tentang Perlindungan Anak di  SMP Negeri 15 Bandar Lampung.  Tujuan dari kegiatan ini adalah agar Siswa /i di SMP Negeri 15 Bandar Lampung mengetahui tentang Undang-Undang Perlindungan Anak Terhadap Cyberbullying, mengetahui Aspek pidana yang mengatur mengenai Intimidasi melalui media sosial (Cyberbullying), dan mengetahui upaya apakah yang dapat dilakukan dalam meningkatkan pengetahuan dan pemahaman mereka khususnya tentang Undang-Undang Perlindungan Anak Terhadap Cyberbullying.

Abstract

The purpose of this study is to analyze the effect of Performance Measurement System to Managerial Performance with mediation variables Role Ambiguity and Psychological Empowerment. This type of research is causality. This research was conducted on non-profit organization that is 7 Private University in Malang. The sample in this study the educational staffequivalent to the manager, the number of samples in this study was 79. The data analysis method used in this study is SEM PLS using WarpPLS 5.0 software. The results of this study indicate that the Performance Measurement System has a positive effect on Managerial Performance through mediation variables Role Ambiguity and Psychological Empowerment. Performance Measurement System has a positive and significant effect on managerial performance. The Performance Measurement System has an indirect relationship with Managerial Performance through Psychological Empowerment. The conclusion is that this study supports the hypothesis developed by Marginson, et al. (2015), but there are some unsupported hypotheses because of the different research objects that each type of organization has different characteristics.

Abstract

Extracurricular activities which are supplements and complements of the curriculum have been planned in the educational calendar of a school. Although these activities are outside the curriculum, whether they are compulsory or optional activities, they play an important role in personality development and discovering student talents. Learning educational games at SMP YPK Malang is carried out in community service for the 2019/2020 period. The material uses object-oriented programming with the Greenfoot platform. The results of this extracurricular learning are evaluated with a qualitative assessment of the domain of acting skills. The assessment techniques used include practices, products, and projects. The results of the evaluation show that the aspects of student diligence and the selection of suitable materials are the dominant factors in the success of students in producing game products.

Abstract

The market discipline is considered an important element for creating a sound and efficient operation ofthe banking industry. It can be shown by the response of investors and depositors of the business operationsand management in relation to the risk of a bank. Theoretically, there are hypotheses must be accomplishedin order to effectively market discipline occurs. The first hypothesis, whether the marketdiscipline provides a signal for of banks regarding the existence of a certain conditions which is inconsistentwith sound and efficient bank and business operation (Disciplining Signal Hypotheses; DSH).The second, bank management will respond to the signal by making efforts towards the implementationfor correction on the business in line with expectations (Corrective Response Hypotheses; CRH). Theverification used the empirical accounting data and market commercial banks with a total of 110 frequencyof semester 2000-2010 (panel data, 1843 observations). Empirical analysis model used regressionpanel data. The estimation results indicate that DSH gained strong empirical support. On the otherhand, the result of estimation involved in CRH is still significantly weak. This indicates that the marketdiscipline mechanism has not operated optimally in Indonesian banking industries. Therefore, correctionis required especially on regulatory mechanisms to improve the quality of banking.

Abstract

Lampung governor election on 2008 executed under article  233  (2) of act  Number  32/2004 cencerning local government, on the other hand  its implementation process is referred to act number 12 / 2008 concerning second ammendment of act number  32/2004 concerning local government. Governor election invites controversy both theoretically and practically. The research explores merely on the woman participation. Research method applies normative research that using secondary data deriving from primary, secondary and tertiary legal sources. The research shows that in governor election  2008 executed under article 233 (2) act number 32/2004 concerning local government and its implementation process based on act number  12/2008 , the fact show that from  5,36 milion voters, male voters reached of  2.778.763 voters, female was   2.587.978 voters,  sehinso the total number was 5.366.741 voters. In sum, male voters was 51,77 %, and female voters was 48,33 %. This means that woman participation in governor election was  48,33 %. In another word, without woman participation, there is no one candidate can be stipulated as elected candidate. Keywords: governor election, woman participation
