Abstract

Kendati paham konstitusionalisme diterima sebagai konsep pembatasan kekuasaan secara universal, namun dalam praktik di suatu negara memiliki latar belakang yang berbeda-beda. Penelitian ini bertujuan untuk menganalisis praktik paham konstitusionalisme di Indonesia khususnya pasca amandemen UUD NRI 1945. Adapun rumusan masalah dalam penelitian ini adalah pertama, bagaimana praktik kultur paham konstitusionalisme di Indonesia ?. kedua, bagaimana Aktualisasi Paham konstitusionalisme dalam konstitusi pasca amandemen UUD 1945?. Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan historis dan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa pertama, kultur konstitusionalisme pada dasarnya sudah tumbuh sejak kemerdekaan yang ditandai dengan adanya maklumat Wakil Presiden Nomor X dan pengalih-fungsikan Komite Nasional Indonesia Pusat (KNIP). Namun dalam perkembangannya harus kandas dengan dikeluarkannya Dekrit 5 Juli 1959 yang menandai lahirnya otoritarianisme. Kedua, aktualisasi paham konstitusionalisme dalam konstitusi pasca amandemen UUD 1945 semakin mendapatkan tempatnya tatkala diubahnya Pasal 1 ayat (2). Perubahan ini berarti mengakui prinsip check and balances sebagai pembatasan antar kekuasaan antar cabang kekuasaan. Selain itu juga adanya penegasa Negara Hukum dalam Pasal 1 ayat (3).

Abstract

Penelitian ini bertujuan untuk menganalisis diskursus pembatalan Perda pasca dikeluarkannya putusan MK No. 137/PUU-XIII/2015 dan No. 56/PUU-XIV/2016 atas pengujian UU No. 23 Tahun 2014 terhadap UUD 1945 yang dibatasi dalam dua rumusan masalah. Pertama, bagaimana implementasi pengujian Perda pasca Putusan MK No. 137/PUU-XIII/2015 dan No. 56/PUU-XIV/2016?. Kedua, apakah dampak putusan MK No. 137/PUU-XIII/2015 dan No. 56/PUU-XIV/2016 terhadap perkembangan hukum pemerintah daerah? Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Data yang digunakan adalah data sekunder yang berupa bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian menunjukkan bahwa: pertama, pasca putusan MK pengujian Perda hanya dilakukan oleh sebuah lembaga yudisial melalui judicial review di Mahkamah Agung. Kedua, terdapat dua dampak penting atas dikeluarkannya putusan MK, pertama, dengan dibatalkannya Pasal 251 UU No. 23 Tahun 2014 maka hal ini mengakhiri dualisme pengujian Perda, karena Menteri tidak dapat lagi melakukan executive review. Kedua, putusan MK o. 137/PUU-XIII/2015 dan No. 56/PUU-XIV/2016 tidak menghapuskan pengawasan Pusat terhadap Perda karena masih dapat dilakukan pengawasan preventif melalui executive preview.This study aimed to analyze the discourse of cancellation after the issuance of local regulations following the Constitutional Court decision No. 137/PUU-XIII/2015 and No. 56/PUU-XIV/2016 on judicial review of Law No. 23 2014 towards the 1945 Constitution which are restricted in two formulation of the problem. First, how is the implementation of a post-test Constitutional Court Regulation No. 137/PUU-XIII/2015 and No. 56/PUU-XIV/2016? Second, what are the effects of the Constitutional Court decision No. 137/PUU-XIII/2015 and No. 56/PUU-XIV/2016 on the development of the local government law? This study is a normative with statute approach and case approach. The data used was secondary data in the form of primary, secondary, and tertiary legal materials. The results showed that: firstly, the following decision of the Constitutional Court about regional regulations review can only be conducted by a judicial body through a judicial review in the Supreme Court. Secondly, there are two important effects on the issuance of the decision of the Constitutional Court, first, by the cancellation of Article 251 of Law No. 23 year 2014 then the duality of local regulation testing is ended, because the Minister can no longer perform executive review. Second, the decision of the Constitutional Court No. 137/PUU-XIII/2015 and No. 56/PUU-XIV/2016 does not abolish the supervision of the Center Government because they do preventive supervision through executive preview.

Abstract

The focus of this study is to analyze the political direction of the law of the Constitutional Court Number 100 / PUU-XIII / 2015 on a single candidate and the implications for the elections simultaneously. The formulation of the problem is first, how the legal political direction single candidate in the decision of the Constitutional Court? Second, what are the implications of the decision of the Constitutional Court against the election system simultaneously ?. Diingin achievable goal is to determine the political direction of the single candidate of law in the Constitutional Court decision and the implications of the decision of the Constitutional Court against the election system simultaneously. This research is a normative approach cases and legislation. Due to the normative research used secondary data in the form of primary legal materials, secondary law and tertiary legal materials. The study concluded that the political direction of the legal decision of this Court is to ensure the constitutional rights of citizens and to use the mechanism of "agree" and "disagree". While the implication is direct implications in the form of their new mechanisms in the implementation of the upcoming election and the Commission must simultaneously make PKPU to provide arrangements regarding the model of ballots, campaign mechanism and the mechanism of logistics division. While the indirect impact in the form of a vacuum in the law for a single candidate in the elections in order laksanan quo law and legal vacuums settings for a single candidate election disputes

Abstract

In the representation system, the Regional Representative Assembly (DPD) has an important role to articulate regional interests in state and government practices. Therefore, the DPD has an equal position with the DPR. This paper aims to determine the implications of the Constitutional Court's decision No. 30/PUUXVI/2018 on electoral developments in Indonesia especially the general election of DPD members which is limited to two main issues. First, what are the legal implications of the Constitutional Court's decision No. 30/PUU-XVI/2018 on the nomination of DPD and, second, what is the urgency of affirming DPD RI Members to be free from members of political parties? The results of the study indicate that the legal implications arising after the issuance of the Constitutional Court's decision No. 30/PUU-XVI/2018 happened to change the mechanism of registration of candidates for election candidates for DPD members and the urgency of affirming DPD members to be free from political parties is to avoid double representations and to strengthen the principle of checks and balances between the DPD and the DPR.

Abstract

Legal aid and protection for disabled people are still difficult to get. Worse, there are not any legal institutions which protect them. The problems discussed in this research are: first, how is the issue of legal aid to disabled people as criminal victims and its challenges? Second, what kinds of legal aid that should be given to disabled people as criminal victims in order to bring access to justice? This was an empirical and normative legal research. The research findings show that: first, the advocacy of disabled people as the victims of violence has been handled by several LSM (Non-Governmental Organizations) in the field of legal aid. Most of the handled cases are discontinued in the middle of the process due to some issues regarding the legal aids, such as issues related to legal aid agencies, disabled victims, victims, and law enforcement apparatus. Second, the ideas suggested to legal aid agencies are to provide supervision from psychologists, translators, and special advocates to handle disabled victims. The ideas suggested to the police are to provide special investigating officers for disabled people, such as assigning police woman for rape and violence cases involving disabled woman victims; and in the judicial proceedings i.e. by one time investigation system in the investigation step in which judges review the victims’ testimony based on police investigation report in the investigation step.

Abstract

Despite the fact that reformation has been running for 16 years, the idea of strengthening the Presidential System remains a discourse and even worse, it is getting weaker and causing anomalies or irregularities here and there. The first research problem is what is the cause of the anomaly in government presidential system after the amendment of Law of 1945? Second, how to establish an effective government presidential system for the benefit of government in Indonesia? This is a normative research with legal and conceptual approaches. The study discovers that the first anomaly presidential system following the amendment of the 1945 Constitution is influenced by three reasons: (i) a blend of a multiparty system with a presidential system, (ii) the occurrence of a coalition in a presidential system, and (iii) the reduction of presidential powers after the amendment. Second, it requires several steps to establish a presidential system: (i) simplification of political parties; (ii) strengthening the functions and performance of the political parties; (iii) forming a permanent coalition of political parties; (iv) revoking legislative authority of the president; (v) authorizing the presidential veto in the passage of legislation; (vi) depending on leadership style of the president; vii) implementing a district election system.

Abstract

Penelitian ini bertujuan untuk mengkaji dan mengetahui persyaratan dan mekanisme pemilihan calon Ketua Partai Golkar dan PPP, sekaligus mengevaluasi mekanisme dan persyaratan suksesi kepemimpinan dalam Partai Golkar dan PPP agar dapat memberikan kelancaran dalam proses suksesi kepemimpinan guna menghindari terjadinya dualisme kepengurusan. Fokus penelitian ini adalah (1) Bagaimanakah mekanisme dan persyaratan suksesi kepemimpinan dalam Partai Golongan Karya dan Partai Persatuan Pembangunan? (2) Apakah mekanisme dan persyaratan suksesi kepemimpinan dalam Partai Golongan Karya dan Partai Persatuan Pembangunan tersebut sudah memberikan kepastian hukum guna menghindari terjadinya dualisme kepengurusan? Penelitian ini adalah yuridis normatif dengan pendekatan perundang-undangan (statute approach). Data yang digunakan adalah data sekunder yang terdiri atas bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian menunjukkan bahwa baik Partai Gokkar maupun PPP telah mengatur secara rinci persyaratan dan mekanisme suksesi kepemimpinan dalam Anggaran Dasar dan Anggaran Rumah Tangga Partai. Sehingga dari aspek legal-formal, AD/ART partai telah cukup memadai untuk dijadikan sebagai aturan main (rule of the game) dalam suksesi kepemimpinan. Namun demikian, perilaku sebagian elit partai yang tidak mau mematuhi aturan main tersebut telah menyebabkan lahirnya konflik. Sehingga dualisme kepengurusan partai pun tidak dapat dihindarkan.

Abstract

This study aims to find the problem of law enforcement in Indonesia through social analysis and using the progressive legal as a new paradigm in law enforcement in Indonesia. So the assumption used is to make the law a social phenomenon. The formulation of the problem in this research are what the problem in law enforcement against respect for human dignity is, and how the progressive law provide a new paradigm in law enforcement so as not to deviate from the values ​​that live in society. This study uses the socio-legal research method using social approach methods and normative juridical approaches. This article concludes, first, the problem of law enforcement is caused by the strong influence of the positivistic legal paradigm to make values ​​in society hit and ignored; errors in interpreting the law which is interpreted in a letter from the written articles; and the lack of strictness of a provision contained in legislation that opens the gap for the possibility of deviation by the implementers. Second, progressive law can be an alternative as well as a solution in law enforcement that reflects the values ​​of justice in society. With progressive law, actors in law enforcement must have a progressive perspective so that they are not confined to legal formalism in order to uphold the values ​​of justice in society, including through “the law makes happiness”, “punishing it reconciles”, “seeing the context behind the text”; and “using conscience in law enforcement”. Abstrak Penelitian ini bertujuan untuk menemukan problematika penegakan hukum di Indonesia melalui analisa sosial dan menggunakan hukum progresif sebagai paradigma baru dalam penegakan hukum di Indonesia. Asumsi yang digunakan adalah menjadikan hukum sebagai gejala sosial. Rumusan masalah dalam penelitian ini adalah apa yang menjadi problem dalam penegakan hukum terhadap penghormatan martabat manusia, dan bagaimana hukum progresif memberikan paradigma baru dalam penegakan hukum agar tidak menyimpang dari nilai-nilai yang hidup dalam masyarakat. Penelitian ini menggunakan metode sosio-legal dengan pendekatan sosial dan yuridis normatif. Artikel ini menunjukkan, pertama, problematika penegakan hukum disebabkan kuatnya pengaruh paradigma legal positivistik sehingga nilai-nilai di masyarakat menjadi ditabrak dan diabaikan; kekeliruan dalam menafsirkan hukum yang dimaknai secara tekstual dari pasal-pasal yang tertulis; dan kurang tegasnya suatu ketentuan dalam peraturan perundang-undangan sehingga membuka celah kemungkinan penyimpangan oleh para pelaksananya. Kedua, hukum progresif bisa menjadi alternatif sekaligus solusi dalam penegakan hukum yang mencerminkan nilai-nilai keadilan dalam masyarakat. Dengan hukum progresif, penegak hukum harus mempunyai cara pandang progresif agar tidak terkungkung pada formalisme hukum demi menegakkan nilai-nilai keadilan dalam masyarakat, antara lain melalui “hukum membuat bahagia”, “menghukum itu mendamaikan”, “melihat konteks di balik teks”; dan “menggunakan hati nurani dalam penegakan hukum”.

Abstract

AbstractThis study aims to determine the policy of regulation of village autonomy post reform. This study discussed the political law of village autonomy since post-reform and its relevance to the administration of village government. This is a normative research that uses statute approach. The result indicates that the politics of law in the fluctuation of the policy regulated in some legislation concerning the existence of village administration which is now covered by Act no. 6 year 2014 on village has provided a stronger legal basis, but the village that is not mentioned in the constitution still raises concerns, for it could possibly be changed again. The regulation thourgh the act is very dependent on the political configuration.AbstrakPenelitian ini bertujuan untuk mengetahui kebijakan pengaturan otonomi desa pasca reformasi. Penelitian ini mengkaji politik hukum otonomi desa pasca reformasi dan relevansinya terhadap penyelenggaraan pemerintahan desa. Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa politik hukum dalam fluktuasi kebijakan yang diatur dalam beberapa peraturan perundang-undanganmengenai eksistensi otonomi desa dalam menyelenggarakan pemerintahannya mengalami kondisi yang tidak stabil. Kendatipun pada saat ini pemerintahan desa sudah dinaungi dengan UU No. 6 tahun 2014 tentang Desa sudah memberikan payung hukum yang lebih kuat, akan tetapi desa yang tidak disebutkan dalam konstitusi masih menimbulkan kekhawatiran, karena akan sangat dimungkinkan dapat diubah lagi, pengaturan melalui undang-undang sangat bergantung dengan konfigurasi politik.
