Abstract

This study discusses specifically about the Lame Duck Session period that occurred in Indonesia, Lame Duck can be said to be a situation where officials who are not re-elected but still sit in office until new officials are sworn in, the phenomenon arises because of a long time lag between polling day to inauguration day. this research aims to find out and analyze specific rules, as well as the political strategy of state law in overcoming and controlling the Lame Duck Session after the general election. The method used in this research is a type of normative legal research with a statutory approach and comparative legal sourced from secondary data, literature data by being analyzed qualitatively. The urgency of legal regulation regarding Lame Duck Session in Indonesia needs to be regulated, especially in the constitution of the 1945 Constitution, this is because there is no clear regulation compared to several other countries that have been contained in the highest constitution. However, in the constitutional system, not only law but politics or power is also an important instrument in the formation and exploration of law, especially in the constitutional law system to overcome a phenomenon such as the Lame Duck Session

Abstract

Putusan Mahkamah Konstitusi Nomor 1/PHPU.PRES-XXII/2023 terkait sengketa Pemilihan Presiden menandai keputusan bersejarah karena merupakan pertama kalinya dalam sejarah Indonesia terdapat dissenting opinion. Dari delapan hakim yang memutus sengketa ini, tiga hakim tidak setuju. Hakim Saldi Isra, Enny Nurbaningsih, dan Arief Hidayat menyoroti peran Presiden Joko Widodo dalam bantuan sosial yang berpotensi mempengaruhi elektabilitas salah satu paslon, pengerahan aparatur negara, dan keterlibatan langsung Presiden. Dissenting opinion berfokus pada peran Presiden dalam Pemilu 2024. Tujuan penelitian ini adalah mengkaji peran Presiden dalam Pemilu 2024 dari perspektif politik hukum berdasarkan Putusan Mahkamah Konstitusi Nomor 1/PHPU PRES-XXII/2024 serta mengetahui urgensi pembentukan Rancangan Undang-Undang tentang Lembaga Kepresidenan untuk mengatur norma etika menurut teori konstitusi. Penelitian ini menggunakan pendekatan undang-undang dan konseptual dengan sumber data sekunder seperti literatur hukum, peraturan, dan putusan pengadilan sebelumnya. Tindakan Presiden Joko Widodo selama Pemilu 2024 telah menimbulkan perdebatan dan kontroversi di masyarakat, menekankan perlunya kerangka hukum yang jelas. Hasil penelitian menunjukkan bahwa pembentukan undang-undang khusus tentang Lembaga Kepresidenan sangat penting untuk memastikan rule of ethics Presiden dan menegakkan prinsip-prinsip demokrasi.

Abstract

The purpose of this research is to know  the thinking processed of student’s  mathematical literacy abilities in terms of auditory, visual and kinesthetic learning styles. This research is an exploratory study with a qualitative approach. This research was conducted in Junior High Schools classified as Excellent in Meulaboh Regency. The subjects in this study were students of class IX MTsN 3 Aceh Barat  who had the high-level ability and were able to solve math literacy problems, besides the subject was also chosen based on learning styles. The results showed that there was no significant difference in students  mathematical literacy thinking processes based on visual learning styles is the process of assimilation and abtarksi thinking. Subjects with auditory learning styles, the thought processes of accommodation and abstraction  for the kinesthetic learning styles, the processes of thinking, assimilation and abstraction.
