Abstract

As we know that the island of Bali is known as the Island of the Gods or the Island of a Thousand Temples. The majority of Balinese people are Hindus and they live in traditional village areas. Traditional villages in Bali have been heterogeneous from the start, when viewed in terms of caste/household, soroh or class. This heterogeneity is getting higher, due to the migration (migration) of non-Balinese ethnic groups to the Bali area. They carry customs, traditions, culture, religion, and other ethnic identities. With globalization, global culture can freely enter Bali. The existence of this condition certainly requires empowerment so that traditional villages still exist in the midst of the wave of globalization. The direction of empowerment is to develop the various capitals they have, without ignoring the normative principles that apply to the Unitary State of the Republic of Indonesia (NKRI), because Bali is part of the Republic of Indonesia. Likewise, global demands cannot be ignored, because Bali is part of the world. In this context, the principle of pluralism becomes very important for traditional villages in Bali.

Abstract

Kemajuan teknologi telah memberikan dampak positif dan dampak negatif terhadap perkembangan manusia dan peradabannya. Telepon cerdas (smartphone) adalah telepon genggam yang memiliki sistem operasi untuk masyarakat luas, fungsinya tidak hanya untuk SMS dan telepon saja tetapi pengguna dapat dengan bebas menambahkan aplikasi, menambah fungsi-fungsi atau mengubah sesuai keinginan pengguna. Tentu saja, hal ini telah menciptakan suatu persaingan yang tinggi bagi para distributor smartphone, sehingga beberapa pengusaha distributor banyak yang tidak mampu bersaing secara “sehat”, melakukan pendistribusian smartphone secara “ilegal”, seperti mendistribusikan dalam jumlah partai besar dengan cara menghindari pajak. Salah satu cara ini, dapat memberikan manfaat bagi distributor. Pemerintah telah memberikan larangan serta batasan terhadap barang-barang tertentu yang menimbulkan penyelundupan smartphone tersebut, karena smartphone tersebut dianggap melanggar lisensi atau Hak Kekayaan Intelektual suatu perusahaan yang memiliki merk tersebut sehingga hal tersebut menjadikan dasar hukum pemerintah untuk melarang smartphone ilegal tersebut masuk kedalam wilayah Indonesia. Ironisnya, banyak konsumen Indonesia tidak memiliki kesadaran hukum yang baik sehingga lebih memilih untuk membeli smartphone ilegal dengan harga murah tersebut dibandingkan harus membeli produk smartphone legal yang kualitasnya sudah terjamin.
