ABSTRAK Berdasarkan data Kementerian Ketenagakerjaan Republik Indonesia (Kemnaker RI) per 1 Mei 2020, jumlah pekerja sektor formal yang telah dirumahkan akibat pandemi Covid-19 sebanyak 1.032.960 orang dan pekerja sektor formal yang di-PHK sebanyak 375.165 orang. Sedangkan pekerja sektor informal yang terdampak Covid-19 sebanyak 314.833 orang. Total pekerja sektor formal dan informal yang terdampak Covid-19 sebanyak 1.722.958 orang. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana perlindungan hukum bagi buruh yang di PHK akibat pandemic COVID-19 serta upaya hukum yang dapat dilakukan oleh tenaga kerja terhadap perusahaan yang merugikannya. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan konsep dan pendekatan undang-undang. Kesimpulan dalam penelitian ini adalah pengusaha wajib memberikan uang pesangon bagi tenaga kerja yang di PHK sesuai dengan Pasal 156 UndangUndang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan sebagai bentuk perlindungan hukum. Upaya hukum yang dapat dilakukan tenaga kerja yang merasa dirugikan akibat dirumahkan dan di PHK adalah upaya hukum litigasi dan non litigasi. The purpose of this study is to find out how legal protection is for workers who have been laid off due to the COVID-19 pandemic as well as legal remedies that can be taken by workers against companies that harm them. This research is a normative legal research with a concept approach and a law approach. The conclusion in this study is that employers are obliged to provide severance pay for workers who have beenĀ laid off in accordance with Article 156 of Law Number 13 of 2003 concerning Manpower as a form of legal protection. Legal remedies that can be taken by workers who feel aggrieved due to being laid off and laid off are litigation and non-litigation legal remedies.Keywords: Legal protection, Labor, layoffs
