Abstract

The development of leasing in Indonesia was in line with the development of banking, both bank and non-bank institutions. This development was certainly inseparable from the demands and needs of the community that they cannot fulfil on their own. The emerging financing institutions carry out activities in the form of providing funds or capital goods by not withdrawing funds directly from the public. The existence of leasing as a means for developing investment financing and empowering the community's economy was still considered to have several problems. Although the practice of leasing in Islamic law was equated with the contract of ijarah vomitiyah bi at-tamlik, in practice in Indonesia the process of leasing agreement was considered fasid, because there was an element of ambiguity in the contract agreement as regulated in the provisions of multi-aqad agreements, both conventional and sharia. This research will discuss the practice of financing in the community categorized as leasing under the provisions of applicable law and a review of Islamic law on the implementation of such leasing.

Abstract

The widespread reality of poverty in Latin America prompted the emergence of liberation theology as a theological response to systemic injustice. Gustavo Gutierrez, one of the central figures in this movement, emphasized the strategic role of religion in dismantling oppressive structures and advocating for the liberation of the poor. This article aims to examine the role of religion in poverty alleviation through the lens of Gutierrez’s liberation theology. The study employs a qualitative approach using a descriptive-analytical method based on literature review. The findings reveal that Gutierrez distinguishes between two types of poverty: individual and structural. Individual poverty can be addressed through transformation of mindset, work ethic, and education. In contrast, structural poverty—which stems from systemic inequality and domination—requires radical social change grounded in principles of justice. Within this framework, religion is not merely a system of transcendental beliefs, but a liberative praxis capable of challenging injustice and advocating for the marginalized. This article affirms that liberation theology remains relevant not only as a matter of faith, but also as a critical framework for strengthening the role of religion in promoting social justice and siding with the oppressed.

Abstract

Contemporary Islamic thought is marked by an awareness of the coexistence of tradition (turath) on one side and modernity (hadathah) on the other. Syahrur introduces a new approach that emphasizes rationality and contextuality in understanding religious texts, especially in the field of Islamic law. This study aims to analyze the construction of Syahrur’s thought through methods of defamiliarization, rejection of synonymity, and the hudud (limits) theory as an effort to renew Quranic understanding in line with contemporary contexts. The research method used is a literature study with a qualitative descriptive approach, examining various concepts and Syahrur’s critiques of contemporary Islamic thought. The results indicate that Syahrur offers a flexible Quranic interpretation method, rejects classical literature, prioritizes an objective-positivistic approach, and employs mathematical principles to interpret law in a flexible manner. Syahrur believes that the Quran is sufficient as the primary source of law without reliance on the Sunnah. Although his views are controversial and opposed by traditional scholars, Syahrur is confident that his approach opens opportunities for Islamic legal reform relevant to the demands of the times.

Abstract

This research discusses the application and challenges of Islamic law (sharia) in Aceh, particularly the lack of socialization and limited participation of the community in filling the open corners of Islamic law implementation. This study employs a qualitative descriptive method. The obtained results indicate that the programs for the implementation of sharia have not been well integrated into the education curriculum and social order of the community. Despite having a strong legal foundation through legislation, thorough preparation and effective management are required to achieve successful implementation. Islamic law is considered as divine regulations that encompass all aspects of the lives of Muslims. In this research, the theory of religious sociology is utilized to analyze the formalization of the application and implementation of Islamic law in Aceh and its impact on the community. The religious sociology approach provides a deeper understanding of the formalization process and its implications for the Acehnese society.AbstrakPenelitian ini membahas penerapan dan tantangan syariat Islam di Aceh, terutama kurangnya sosialisasi dan keterbatasan partisipasi masyarakat dalam mengisi sudut-sudut terbuka pelaksanaan syariat Islam. Penelitian ini menggunakan metode deskriptif kualitatif. Adapun hasil yang diperoleh, bahwa program-program penerapan syariat belum terintegrasi dengan baik dalam kurikulum pendidikan dan tatanan sosial masyarakat. Meskipun undang-undang telah memberikan dasar hukum yang kuat, persiapan yang matang dan pengelolaan yang baik diperlukan untuk mencapai implementasi yang efektif. Syariat Islam dianggap sebagai peraturan ilahiah yang mencakup semua aspek kehidupan umat Islam. Dalam penelitian ini, teori sosiologi agama digunakan untuk menganalisis formalisasi penerapan dan pelaksanaan syariat Islam di Aceh dan dampaknya terhadap masyarakat. Pendekatan sosiologi agama memberikan pemahaman yang lebih mendalam tentang proses formalisasi dan implikasinya bagi masyarakat Aceh.

Abstract

The implementation of Islamic law (Sharia) in Aceh has led to a dual legal system, but its effectiveness is often challenged by a disconnect between the formal legal framework and the community's legal culture. This article argues that a purely legal-positivist approach, which relies heavily on state-enforced qanuns, is insufficient. A more effective strategy requires a responsive legal development model that integrates Sharia with deeply rooted local wisdom. This study, utilizing a descriptive-qualitative approach based on a literature review, examines the potential of the pageu gampong system—a traditional village-level institution for social and moral harmony—as a strategic solution. Our analysis shows that revitalizing pageu gampong can bridge the gap between formal law and community practice by functioning as both a preventive and repressive mechanism. By fostering community participation and leveraging the legitimacy of customary leaders, this system not only addresses the challenges of enforcement but also strengthens public trust and combats the rise of individualism, thereby making Sharia implementation more sustainable and effective
