<![CDATA[Tujuan penelitian menganalisis cara Pemilihan Khalifah dalam Negara Khilafah Islamiyah; dan menganalisi Belajar dari Sejarah Hukum yang diteliti untuk pembenahan Hukum di masa mendatang. Metode penelitian menggunakan metode penelitian hukum Normatif. Hasil penelitian bahwa Proses pemilihan Khalifah dalam Negara Khilafah tergantung kepada deskripsi para ulama’. Proses pemilihan Khalifah diawali dengan pemilihan kandidat oleh Ahlul halli wal aqdi (Majelis Umat), para kandidat diseleksi berdasarkan kriteria yang telah ditentukan secara Syar’I hingga menyisakan satu orang saja. Calon Kholifah ini dibaiat boleh Ahlul halli wal aqdi (bay’at in ‘iqad), akhirnya umat pun membay’atnya (bay’at ta’at). Bay’at inilah yang menandai terangkatnya Khalifah dalam Negara Khilafah. The research objective was to analyze the method of selecting the Caliph in the Khilafah Islamiyah State; and analyzing learning from the history of law under study for future legal reform. The research method uses Normative legal research methods. The research result shows that the process of selecting the Caliph in the Khilafah State depends on the descriptions of the scholars'. The process of selecting the Khalifah begins with the selection of candidates by Ahlul halli wal aqdi (Assembly of the Ummah), candidates are selected based on criteria that have been determined by Syar'I, leaving only one person. This candidate for the Kholifah may take allegiance to Ahlul halli wal aqdi (bay'at in 'iqad), in the end the people took him (bay'at ta'at). Bay'at is what marks the appointment of the Caliph in the Khilafah State.]]>
