Tujuan Penelitian menganalisis perlindungan hukum pihak ketiga terhadap jaminan kebendaan yang dimasukkan sebagai harta pailit di dalam kepailitan dan kedudukan jaminan kebendaan pihak ketiga di dalam kepailitan. Tipe penelitian menggunakan pendekatan normatif yang bersifat kualitatif. Hasil penelitian bahwa Perlindungan hukum pihak ketiga terhadap jaminan kebendaan yang dimasukkan sebagai harta pailit di dalam kepailitan secara preventif, yakni kurator mesti memperhatikan alas hak yang dijadikan jaminan. Kedudukan jaminan kebendaan pihak ketiga di dalam kepailitan mengacu pada ketentuan Pasal 21 UU Kepailitan dan PKPU dinyatakan bahwa Kepailitan meliputi seluruh kekayaan Debitor pada saat putusan pernyataan pailit diucapkan serta segala sesuatu yang diperoleh selama kepailitan. Frasa seluruh kekayaan debitor pada UU Kepailitan dan PKPU dikaitkan dengan Pasal 1131 KUHPerdata berarti semua kebendaan si berutang, baik yang bergerak maupun yang tidak bergerak, baik yang sudah ada maupun yang baru akan ada di kemudian hari. The research objective is to analyze the legal protection of third parties against property collateral that is included as bankruptcy property and the position of third party property collateral in the bankruptcy. This type of research uses a qualitative normative approach. The results of the study show that the legal protection of third parties against property guarantees that are included as bankruptcy assets in bankruptcy is preventive, namely the curator must pay attention to the basis of the rights that are used as collateral. The position of the third party's property guarantee in bankruptcy refers to the provisions of Article 21 of the Bankruptcy Law and PKPU states that Bankruptcy covers all assets of the Debtor at the time the bankruptcy declaration was pronounced as well as everything obtained during the bankruptcy. The phrase all debtor's assets in the Bankruptcy and PKPU Law associated with Article 1131 of the Civil Code means that all objects of the debtor, both movable and immovable, both existing and new, will exist at a later date.
