Abstract

Tujuan penelitan menganalisis pengaturan hukum, hak dan kewajiban pekerja serta kendala pekerja dalam menjalankan hak dan kewajibannya selama dirumahkan akibat dari pandemi Covid-19. Populasi penelitian ini adalah beberapa karyawan PT. Yuma Saranakarya (Upnormal Coffee Roaster Nipah Mall Makassar) dan CV. Tang Food Indonesia. Hasil penelitian menunjukkan bahwa di Kota Makassar khususnya PT. Yuma Saranakarya dan CV. Tang Food Indonesia menerapkan peraturan yang dibuat oleh Menteri ketenagakerjaan melalui Surat Edaran Nomor M/3/HK.04/III/2020 Tahun 2020 dengan kebijakan bagi karyawan yang dirumahkan selama masa pandemi Covid-19 akan diberlakukan unpaid leave (upah tidak berjalan) sehingga hak dan kewajibannya tidak berjalan, namun bagi karyawan yang tetap bertugas selama masa pandemi Covid-19 maka akan menerima upah berupa daily rate (upah harian) sehingga karyawan tetap mendapatkan haknya dan menjalankan kewajibannya sesuai ketentuan perusahaan yang berlaku. The Research objective to analyze legal arrangements, workers' rights and obligations as well as workers' obstacles in carrying out their rights and obligations while being dismissed as a result of the Covid-19 pandemic. The population of this study were several employees of PT. Yuma Saranakarya (Upnormal Coffee Roaster Nipah Mall Makassar) and CV. Tang Food Indonesia. The results showed that in Makassar City, especially PT. Yuma Saranakarya and CV. Tang Food Indonesia applies regulations made by the Minister of Manpower through Circular Number M/3/HK.04/III/2020 of 2020 with a policy for employees who are laid off during the Covid-19 pandemic, unpaid leave will be applied so that their rights and their obligations do not run, but for employees who remain on duty during the Covid-19 pandemic, they will receive wages in the form of a daily rate (daily wages) so that employees continue to get their rights and carry out their obligations according to applicable company regulations.
