Abstract

Tujuan penelitian menganalisis efektifitas penyelesaian sengketa pertanahan melalui mediasi pada Kantor Pertanahan Kota Makassar dan faktor-faktor yang mempengaruhi. Metode yang digunakan dalam penelitian ini adalah yuridis empiris. Hasil penelitian menunjukan bahwa efektivitas pelaksanaan mediasi dikantor pertanahan kota makassar belum efektif hal ini dapat dilihat dari jumlah kasus sengketa yang terselesaikan melalui mediasi masih minim. Faktor yang mempengaruhi efektivitas mediasi adalah substansi hukum, struktur hukum, budaya hukum, sarana dan prasarana dan kesadaran hukum masyarakat. Sementara efektivitas dari tingkat keberhasilan mediasi di kantor pertanahan kota makassar masih sangat rendah. The research objective to analyze the effectiveness of land dispute resolution through mediation at the Makassar City Land Office and the factors that influence it. The method used in this research is empirical juridical. The results show that the effectiveness of the implementation of mediation at the Makassar City Land Office has not been effective, this can be seen from the number of dispute cases resolved through mediation is still minimal. Factors that influence the effectiveness of mediation are legal substance, legal structure, legal culture, facilities and infrastructure and public legal awareness. Meanwhile, the effectiveness of the mediation success rate at the Makassar City Land Office is still very low.
