<![CDATA[Tujuan penelitian menganalisis penerapan sanksi pidana terhadap pelaku penyerobotan hak atas tanah dalam proses penyidikan pada Polrestabes Makassar dan faktor-faktor yang mempengaruhi. Tipe yang digunakan dalam penelitian ini adalah penelitian hukum sosiologis dengan tujuan untuk mengetahui dan menganalisis penerapan sanksi pidana terhadap pelaku penyerobotan hak atas tanah dalam proses pada penyidikan pada Polrestabes Makassar terhadap pelaku penyerobotan hak atas tanah. Hasil penelitian telah menemukan fakta bahwa penegakan hukum pidana terhadap pelaku penyerobotan hak atas tanah kurang efektif dalam proses penyelidikan maupun penyidikan pada Polrestabes Makassar. Faktor-faktor yang mempengaruhi dalam penegakan hukum pidana oleh penyidik Polrestabers Makassar terhadap pelaku penyerobotan hak atas tanah, yaitu faktor substansi hukum, faktor struktur hukum, faktor sarana dan fasilitas serta faktor kesadaran hukum. The research objective to analize the application of criminal sanctions against perpetrators of usurping land rights in the investigation process at the Makassar Police and the influencing factors. The type used in this research is sociological legal research with the aim of knowing and analyzing the application of criminal sanctions against perpetrators of usurping land rights in the investigation process at the Makassar Police Station against perpetrators of usurping land rights. The results of the study have found the fact that criminal law enforcement against perpetrators of usurping land rights is less effective in the process of investigation and investigation at the Makassar Polrestabes.
