Abstract

Kewajiban member nafkah anak terletak pada ayah sebagai kepala keluarga.Apabila kedua orangtua bercerai, maka kewajiban nafkah anak tetap melekat pada ayah, meskipun hak asuh ada pada ibu.Namun demikian, faktanya ada beberapa kasus di Pengadilan Agama (PA) Ponorogo, yang apabila ayah dan ibu bercerai, sedangkan anak diasuh oleh ibunya, maka hak nafkahanak jarang diberikan sesuai dengan putusan majelis hakim.Bahkan ada anak yang tidak pernah mendapatkan hak tersebut sampai dia dewasa.Ada2 (dua) putusan yang diteliti di dalam penelitian ini, yaitu putusan pertama nomor1064/Pdt.G/2014/PA.Po dan putusan kedua nomor 1467/Pdt.G/2014/PA.Po.Dalam putusan pertamasi ibu(si isteri) sudah meminta PA Ponorogo sebanyak 2 (dua) kali untuk melakukan eksekusi hak hadanah anak. Sedangkan dalam putusan yang kedua si ibu baru sekalimengajukan eksekusi.Dengan beberapa alasan, Pengadilan tidak dapat melakukan eksekusi, padahal dari kedua putusan tersebut hadanah anak wajib diberikan si ayah kepada anaknya setiap bulan sampai si anak dewasa. Hal ini pun pada akhirnya menimbulkan keresahan dan pertanyaan di kalangan akademisi maupun masyarakat, apakah pengadilan hanya sebatas memutus perkara saja, sehingga putusannya tidak perlu dilaksanakan. Penelitian ini menawarkan suatu alternatif hukum, agar suatu putusan pengadilan, khususnya permasalahan hadanah anak, dapat benar-benar terlaksana, karena menyangkut masalah kesejahteraan dan tumbuh kembang seorang anak yang menjadi korban perceraian ayah dan ibunya.

Abstract

Criminal act of rape is one type of violent crime to woman. In the development of this crime is no longer seen as solely a moral offence. But inside it has touched on the anger and violence problem which is considered a violation and negation HAM. Based on the development this, planner group new penal code in looking need to quicly change formulation a criminal act of rape. That is no longer the sense as in the formulation Section 28 penal code (WvS), but expanded in accordance with the development and future state. Through political policy or criminal law, formulations have been made a criminal act of rape is more appropriate to contemporary situations and this formula has been placed in section 423 hhe draft new penal code  which is currently awaiting approval from the legistilative assembly.

Abstract

This study aims to analyze the role of criminal aspects in overseeing capital market activities to create a fair and transparent system. The method used is qualitative with a normative-juridical approach, through a literature review of capital market legal regulations and cases of violations that have occurred. The results show that criminal instruments have an important role in preventing and prosecuting violations, such as insider trading, market manipulation, and the dissemination of misleading information. The application of criminal sanctions in capital market regulations aims to increase legal certainty, protect investors, and maintain economic stability. This study confirms that strengthening criminal aspects, including more assertive law enforcement, is necessary to create a healthier, more integrated, and sustainable capital market.

Abstract

This study aims to analyze the role of law enforcement in overseeing business competition to keep it healthy and fair. Uncontrolled business competition can lead to monopolies, cartels, and abuse of dominant positions that harm small businesses and consumers. This study uses a qualitative method with a literature study approach, examining regulations such as Law No. 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition and the role of the Business Competition Supervisory Commission (KPPU). The results show that the enforcement of business competition law still faces challenges, such as weak sanctions, lack of inter-agency coordination, and obstacles in proving cases. This study emphasizes that effective law enforcement in business competition requires strict regulations, tight supervision, and legal awareness among business actors in order to create a healthy and competitive business ecosystem.

Abstract

This study aims to analyze the protection of women's activities in politics and labor in the context of law and policy in Indonesia. Using a qualitative method with a juridical-sociological approach, this study examines regulations that guarantee gender equality and the structural obstacles faced by women. The results show that despite various regulations such as Law Number 7 of 1984 concerning the Ratification of the CEDAW Convention and the Manpower Act, their implementation is still not optimal. Women still face discrimination, limited access, and gender stereotypes in both politics and the job market. This study emphasizes the importance of consistent law enforcement, gender education, and policy reform to create a fair and equal space for women's participation.
