Abstract

Poligami sebagai bentuk perkawinan yang diatur dalam sistem hukum Indonesia menghadapi kompleksitas ketika melibatkan Pegawai Negeri Sipil (PNS) wanita sebagai calon istri kedua, dimana terjadi pertentangan norma antara hukum perkawinan yang memperbolehkan poligami dengan syarat tertentu dan PP No. 45 Tahun 1990 yang secara tegas melarang PNS wanita menjadi istri kedua/ketiga/keempat dengan ancaman pemberhentian tidak hormat. Penelitian terhadap Putusan Pengadilan Agama Pekanbaru Nomor 1222/Pdt.G/2024/PA.Pbr menunjukkan bahwa meskipun Majelis Hakim mengabulkan permohonan izin poligami karena terpenuhinya syarat-syarat hukum perkawinan dan adanya kesediaan calon istri kedua menanggung risiko, putusan ini justru menciptakan ketidakpastian hukum bagi PNS wanita yang bersangkutan karena meskipun perkawinannya sah secara hukum perkawinan, namun tetap berpotensi dijatuhi sanksi disiplin berdasarkan ketentuan hukum kepegawaian yang berlaku.

Abstract

The main problem of this research is how to analyze the relationship between the level of knowledge of Muslim entrepreneurs and the success of a business (a case study of Muslim entrepreneurs in Benteng District, Selayar Islands Regency) The main problem is raised into several sub-problems or research questions, namely: how is the relationship between the level of knowledge of Muslim entrepreneurs and the success of a business. This type of research is classified as quantitative research is a research method that is inductive, objective, and scientific in which the data obtained is in the form of numbers (score, value) or statements that are scored, and analyzed by statistical analysis. The source of data for this research is the Muslim community who work as entrepreneurs. The data collection methods used are interviews and questionnaires. Data management and analysis techniques are carried out by validity test, reliability test, simple regression analysis, correlation coefficient, determination coefficient test (R2), and t-test (partial). The results of this study indicate that: the correlation coefficient is 0.561 this value can be interpreted based on the correlation coefficient guidelines, that the relationship between the two research variables is in the category of moderately correlated relationships. And the coefficient of determination (R2) of 0.35.9 which means that the explanation of variable X to variable Y is 35.9% and the rest is explained by other variables not examined by researchers. Although the correlation coefficient test states that the level of correlation is sufficient, the partial t-test still shows that the t-count value is 3.570 and the t-table value is 1.991, which means t-count > t-table with a significance value of 0.001

Abstract

Purchase Back Guarantee is an agreement made by the bank and developer to provide collateral for the mortgage to the developer. Article 8 Paragraph (1) of Law Number 7 of 1992 concerning Banking as Amended by Law Number 10 of 1998 (Banking Law) stipulates that bank credit distribution must be based on confidence in the debtor, which in the provisions explaining this confidence refers to the existence of credit guarantee. In addition, Article 11 of the Banking Law regulates the provisions for providing guarantees by Bank Indonesia. However, these articles do not further regulate the collateral that can be provided for bank credit. This shows that this regulation is still rigid and many problems arise due to the implementation and execution of the Buy Back Guarantee. The aim of this study is to examine and analyze the validity of the implementation of the Buy Back Guarantee and efforts to resolve disputes. This study uses normative legal research methods with a legislative and decision approach. The study results show that the implementation of the Buy Back Guarantee is valid if it is carried out in accordance with applicable regulations and the agreements made relating to the implementation of the Buy Back Guarantee are valid and made before a Notary. Dispute resolution can be done through litigation and non-litigation. Litigation can be taken through the courts, and non-litigation can be done through Alternative Dispute Resolution, namely arbitration, negotiation or mediation.

Abstract

Industrial relation between companies and employees are a fundamental factor in the world of employment that must be built on a sense of balance, fairness, and mutual respect. However, in practice, disputes between the two parties are not uncommon. The settlement of industrial relations disputes through mediation is a process in which the parties resolve their issues with the assistance of a neutral mediator. Mediation in the settlement of industrial relations disputes is an effective method because it provides the parties involved with greater access to the outcome compared to arbitration or court proceedings. This study aims to discuss the Procedure for Settling Industrial Relations Disputes and the Effectiveness of Mediation-Based Settlement of Industrial Relations Disputes by the All-Indonesia Workers Union as a mediator, using a case study at PT Sawit Panen Terus. The research method used is empirical juridical, namely a case study approach. The results of this study indicate that mediation is effective, as industrial problems are resolved peacefully. The agreements reached must be carefully implemented by both parties involved.
