Abstract

AbstrakPenelitian ini bertujuan untuk mengetahui penerapan asas proporsionalitas dalam pengaturan hak dan kewajiban antara kepala bidang Bina Marga Dinas Pekerjaan Umum Kabupaten Kebumen selaku Pejabat Pembuat Komitmen dengan CV. Metro Jaya selaku penyedia jasa. Untuk tercapainya penulisanhukum ini, digunakan metode penelitian hukum empiris yang bersifat eksplanatoris dengan pendekatan kualitatif. Jenis data yang digunakan adalah data primer yang diperoleh langsung dari lokasi penelitian dan data sekunder yang diperoleh dari bahan kepustakaan, sedangkan sumber data yang digunakanadalah sumber data primer yang diperoleh langsung dari para pihak dan sumber data sekunder yang diperoleh dari bahan hukum primer, sekunder, dan tersier. Teknik pengumpulan data yang digunakan adalah studi dokumen atau bahan pustaka dan wawancara, dengan model analisis interaktif sebagai teknikanalisis data. Berdasarkan hasil penelitian dan pembahasan dihasilkan kesimpulan pengaturan hak dan kewajiban antara Pejabat Pembuat Komitmen dengan penyedia jasa pada dasarnya sudah memenuhi asas proporsionalitas, namun dalam perumusan isi kontrak belum diterapkan. Kontrak kerja konstruksiideal berbasis Asas Proporsionalitas seharusnya mengatur pertukaran hak dan kewajiban para pihak sesuai proporsinya dari proses tahapan prakontraktual, pelaksanaan kontrak hingga pasca kontraktual.

Abstract

The Agreement on the Technical Barriers to Trade (TBT Agreement) WTO and The ASEAN Economic Community (AEC) The Blueprint envisions the transformation of the WTO and ASEAN region through the facilitation of the free flow of goods and services. With tariffs declining to near-zero levels, non-tariff barriers are increasingly focused on coordination by member-countries. However, the quality of goods / services becomes a central issue that determines the market entry. Therefore, TBT agreement and AEC Blueprint require fulfillment of Standards and Conformity Assessment to guarantee the quality of goods or services. On the one hand, the low level of compliance of business actors in applying SNI (Indonesian National Standards) represents of the low level of Indonesian industry competitiveness in international level. Thus, specific government’s policies are required, one of which is that dealing with the strategic roles of local government to support products manufactured by national industries to break through global markets. Some strategies for strengthening local policies in national standardization include: (a) constructing local regulations governing Standards and Conformity assessment; (b) implementing mandatory SNI to leading local products; (c) Strengthening mutual cooperation between local government and related stakeholders.

Abstract

The Security Law, which regulates the land mortgage has significance meaning to move real sector, thus it can support the development of national economy. In this case, the traders, on the one hand, need capital for business activities, while on the other side of the capital owners seek to profit from their investment. Bank as an intermediary is required to be careful. An implementation of the precautionary principle is to have collateral for loans to businesses. One of the collateral is immovable asset (land), which is secured by the Mortgage. In practice, stipulation of mortgage is still more in favor of the bank. If this is allowed, it can be conditions that would adversely affect the parties. Thus, we need to make updates Security Law that balances position of banks and businesses, which in accordance with the attitude of mutual cooperation with based on the fundamental values which are reflected in the philosophical basis of the Indonesian nation.
