All this time, the explanation being used that ineffectiveness of AATHP implementation caused by Indonesia who not ratified yet its agreement. It considered as logic because Indonesia is the primary cause of smog that will be tackled by AATHP. The writer’s main argument is ineffectiveness of AATHP influenced by non-interference principle on ASEAN, which really strong and reflected in the content of the agreement which made AATHP legalization is low (soft law). Therefore, with the weak legally binding, even Indonesia ratified the agreement, still the prospect implementation of the effectiveness is low.

Abstract

This research aims to explain why the Prophet Muhammad comply withThe Hudaybiya Treaty although in its articles are considered harmful. By answering the question above, it is expected to build a model of compliance to international agreement in the Islamic perspective. Christian Reus-Smit’sintertistial conception of politics considered appropriate in this study because it provides space for the role of ideas such as identity and norm in explaining a political action. This study found Prophet Muhammad complieswith Treaty of Hudaibiyah because of political deliberation which integrate four type or reason: idiographic, purposive, ethical, and instrumental. Ideographic deliberation determines the formulation of interest (purposive deliberation). The formulation of these interests will determine the action (instrumental deliberation) in accordance with the available resources and external constrain faced, as well as appropriate with or not contrary to Islamic norms and universally applicable norms (ethical deliberation). Ideographically, based on identities: as believers who should obey Allah and His Messenger, as a noble people who hold the promise. Purposively, the mission of Muslims is to preach the religion of monotheism to all mankind, therefore the condition of peace and religious freedom must be realized. Ethically, the question of how should we act is answered by everything done must in concordance with Islamic rules and customary law norms which emphasize the obligation to comply with the concluded agreements. Instrumentally, the chosen action which in line with the formulated interest and in accordance with the norms of Islam is complieswith the peace treaty.

Abstract

This research examines the implementation of ASEAN Way in conflict resolution between Thailand and Cambodia regarding the border dispute around the Preah Vihear Temple in 2011. ASEAN is faced with many problems related to disputes in its member countries, one of which is the problem of Thailand and Cambodia. The lack of clarity of the territorial line is one of the causes. Policies have been carried out, one of which is the 1962 International Court of Justice (ICJ) decision on the Preah Vihear Temple, which caused rejection from the Thai side due to different opinions regarding the layout of the country's territorial boundaries. The ASEAN Way, as a tool of regional diplomacy, will assist member states in mediating conflicts. They should rely on peaceful settlement of disputes, not interfere in the internal affairs of other ASEAN member states, and abandon the use of force. The ASEAN Way is considered "the superior product of cultural similarities among the people of ASEAN". The ASEAN way includes consensus-seeking activities and has formal and informal characteristics. Through the ASEAN Way mechanism with the track - one & track - two diplomacy approach method, it can be a success factor for ASEAN in resolving conflicts between the two disputing countries

Abstract

This study of international non-governmental actors (INGO) and peacebuilding has sparked a lively discussion because INGOs play a significant role in the peace process. On the other hand, INGOs with their own values frequently fight with one another or with the values of the local community. This study tries to comprehend the peacebuilding strategies of The Catholic Relief Service (CRS) and Muhammadiyah in conflict zones, particularly Timor-Leste and Mindanao. This study employs a qualitative approach with document analysis. The findings of this study indicate that CRS and Muhammadiyah play a significant role in promoting peace through the following efforts: (1) reducing human suffering by seeking the safety of conflict victims; (2) promoting peace through a democratic, non-violent, and participatory process by focusing on the safety of women and other vulnerable people; and (3) post-conflict reconstruction by restoring the lives of people affected by conflict in various aspects.
