Abstract

The arrangement concept and development of the Metropolitan Area poses as one of the most interesting issues relating to local government law. Although the Regional Government Law provides flexibility for local governments to regulate and manage their regional affairs, in the Metropolitan Areas however, the Central Government takes part in structuring the regulations and institutions. This study examines two issues, namely the regulation of Metropolitan Areas in Indonesia and the relation of authority between the Central Government and Regional Governments in the arrangement of the Jakarta-Bogor-Depok-Tangerang-Bekasi-Puncak-Cianjur Metropolitan Area. This study uses a normative juridical method. The results of the study conclude that first, regulations regarding Metropolitan Areas are spread across various instruments, namely Legislations, Government Regulations, Provincial Regulations, and Regency/City Regional Regulations. Second, in structuring the Jabodetabek Metropolitan Area, the Central Government still dominates, while the Regional Government only needs to carry out what is the will of the Central Government. This dominance can be seen in the aspects of regulatory formation and management of Metropolitan Areas. Key Words: Authority; central government; regional government; metropolitan area AbstrakKonsep dan perkembangan penataan Kawasan Metropolitan menjadi salah satu isu yang menarik terkait hukum pemerintahan daerah. Meskipun Undang-Undang Pemerintahan Daerah memberikan keleluasaan bagi pemerintah daerah untuk mengatur dan mengurus sendiri urusan pemerintahan daerah, namun dalam isu Kawasan Metropolitan, Pemerintah Pusat ikut andil untuk melakukan penataan regulasi dan kelembagaan. Penelitian ini mengkaji dua hal yaitu pengaturan mengenai Kawasan Metropolitan di Indonesia dan relasi kewenangan Pemerintah Pusat dan Pemerintah Daerah dalam penataan Kawasan Metropolitan Jakarta-Bogor-Depok-Tangerang-Bekasi-Puncak-Cianjur. Penelitian ini menggunakan metode yuridis normatif. Hasil penelitian menyimpulkan, pertama, bahwa pengaturan mengenai Kawasan Metropolitan tersebar di berbagai regulasi yaitu Undang-Undang, Peraturan Pemerintah, Peraturan Daerah Provinsi, dan Peraturan Daerah Kabupaten/Kota. Kedua, dalam penataan Kawasan Metropolitan Jabodetabek, Pemerintah Pusat masih mendominasi, sedangkan Pemerintahan Daerah tinggal menjalankan saja apa yang menjadi kehendak Pemerintah Pusat. Dominasi ini nampak pada aspek pembentukan regulasi dan pengelolaan Kawasan Metropolitan. Kata-kata Kunci: Kewenangan; pemerintah pusat; pemerintah daerah; kawasan metropolitan

Abstract

The government's broad authority in managing state finances for handling the Covid-19 pandemic, which was originally regulated based on Perppu concerning about State Financial Policy and Financial System Stability for Handling the Covid-19. Pandemic and/or Facing Threats That Endanger the National Economy and/or Financial System Stability, was then determined by Law has the potential to cause losses to citizens or legal entities. However, there is an article of the Law that can trigger legal problems because it provides immunity to all government actions taken under this Perppu so that it cannot be the object of a lawsuit to the PTUN. Research with normative methods, through this statutory and conceptual approach, aims to, first, analyze the legal policy of regulating immunity to all government decisions and/or actions in state financial management for handling the Covid-19 pandemic; second, formulate alternative legal protection for legal subject who have the potential to be harmed by government actions and/or decisions in managing state finances for handling the Covid-19 pandemic. This study concludes one of them is legal protection can be accommodated preventively through administrative supervision, ratification and approval, and government openness; and repressively through the mechanism of administrative efforts or reports to the Ombudsman.

Abstract

Program Pengabdian Masyarakat PKM ini dilaksanakan bermitra dengan Pemerintah Padukuhan Sembung, Purwobinangun, Pakem. Permasalahan utama mitra adalah belum adanya kemandirian ekonomi. Oleh karena itu, pengabdi selama 2 tahun berturut-turut melakukan pengabdian pada tahun 2019 dan 2020 dengan kurun waktu 4 minggu. Tujuan dari pengabdian ini adalah untuk membentuk kemandirian ekonomi para ibu rumah tangga dan kebersihan lingkungan. Pengabdian ini menggunakan metode berupa penyuluhan kualitas batik, penyuluhan nilai ekonomi batik, dan pelatihan batik eco-print di atas media keramik. Adanya pengabdian tersebut berdampak terhadap peningkatan keterampilan Ibu-Ibu Padukuhan Sembung, dengan pelatihan variasi-variasi keterampilan membatik, sehingga mitra memiliki alternatif untuk mengembangkan jenis batik. Peserta pengabdian mengalami peningkatan keterampilan membatik eco-print di atas media keramik ditunjukkan dengan 18 orang yang sebelumnya tidak bisa membatik eco-print di atas media keramik kemudian setelah pengabdian dilakukan 18 orang tersebut bisa membatik eco-print di atas media keramik. Pelatihan ini melengkapi keterampilan peserta dalam variasi media batik eco-print, setelah sebelumnya telah diadakan pelatihan berbagai metode batik eco-print dan membatik batik eco-print di atas media kain.  This Community Service Program is carried out in partnership with the Government of Padukuhan Sembung, Purwobinangun, Pakem. The main problem of partners is the absence of economic independence. Therefore, for two consecutive years, devotees carried out service in 2019 and 2020 for four weeks. The purpose of this devotion is to form the economic independence of housewives and the cleanliness of the environment. This service uses batik quality counselling, batik economic value counselling, and eco-print batik training on ceramic media. This service's existence impacts the improvement of the skills of Padukuhan Sembung Mothers, with training on variations of batik skills so that partners have alternatives to develop types of batik. Service participants experienced increased eco-print batik skills on ceramic media, as shown by 18 people who previously could not batik eco-print on ceramic media. Then after the service, the 18 people could batik eco-print on ceramic media. This training complements participants' skills in various eco-print batik media after training on various methods of eco-print batik and batik eco print batik on cloth.

Abstract

This research will examine the spatial planning policies of the Denpasar-Badung-Gianyar-Tabanan (Sarbagita) Urban Area with the perspective of regional autonomy and human rights. Two things will be studied, namely first, the concept of spatial planning in the Denpasar-Badung-Gianyar-Tabanan (Sarbagita) Urban Area of Bali Province, secondly, related to whether the urban spatial planning is in line with the concept of regional autonomy and correlates with the principles of human rights. The research method used is normative juridical with statutory and conceptual approaches. The results of the study concluded that first, the formation of regulations regarding the Sarbagita Urban Area is dominated by the Central Government, while the Regional Government only follows the policies of the Central Government. As for the management aspect of the Sarbagita urban area, management is carried out by the Minister, Governor, and Regent or Mayor in accordance with their authority. Second, the development and management of urban areas must pay attention to the principles of human rights, one of which is to provide opportunities for the community to be involved in the arrangement, management and utilization of the spatial planning of the Sarbagita urban area.

Abstract

This study aims to examine the shift/sharing of authority between the Central and Regional Governments in the religious field, particularly regarding the implementation of Law Number 18 of 2019 concerning Pesantren. The Law provides a portion of authority to the Regional Government to facilitate Pesantrens in carrying out its functions as one of the centers for the development of Islamic religious knowledge. The Law also obliges the local Government to fund the Pesantrens through regional revenue and expenditure budgets by their authority and guided by statutory provisions. This study uses a normative juridical method. The results of this research conclude that the existence of the Pesantrens Law, on the one hand, shows that the Government has concern for efforts to maintain religion (Hifdz ad-Dîn); and, on the other hand, indicating that there has been a shift in authority from the Central to the Regional Government in governing of religion, particularly in terms of administering Pesantrens,

Abstract

The position of the Presidential Communication Office as a Non-structural Institution has raised both pros and cons debates that have led to a review of the urgency of the existence of this new institution. This study examines two things, first, the position, duties, functions, and institutional structure of the Presidential Communication Office and second, the urgency of the Presidential Communication Office in the Government System. The results of this study are, first, the Presidential Communication Office is a non-structural institution under and responsible to the President. Its position, functions, and duties are intended to provide support to the President in implementing communication and information on strategic policies and priority programs of the President. Second, the existence of the Presidential Communication Office needs to be reviewed in more depth, especially regarding the possibility of overlapping with the Ministry of Communication and Digital. In addition, the institutional structure of the Presidential Communication Office has the potential to conflict with the spirit of bureaucratic reform, if not followed by the arrangement of government institutions that have the same authority.

Abstract

Regulation of street vendors (PKL) remains limited. On the other hand, street vendors are closely related to micro, small, and medium enterprises, traffic, and spatial planning, thereby requiring local governments in manage the complexity of street vendors' affairs in line with the fulfillment of their constitutional rights. This research aims to identify the complexity of street vendor arrangement and empowerment policies that are in line with the active role of local governments in providing fulfillment of rights for street vendors, and to formulate a reformulation of street vendor arrangement and empowerment in a more appropriate local government frame. This research employs a juridical-normative approach, combining a statutory and a conceptual approach to address the complexity of fulfilling constitutional rights for street vendors in the regions. The fulfillment of constitutional rights through the arrangement and empowerment of street vendors in the areas is very complex. Regional policies are also very complex because they involve various sectors. The business characteristics of street vendors, which were originally informal, have evolved into formal trade. Both in terms of legal status, business legality, business arrangements and locations, and governance complexity. The arrangement and empowerment of street vendors need to be reformed and incorporated in the Law on Regional Government by categorizing them as a sub-concurrent government affair in the field of trade.

Abstract

One of the evaluations of the implementation of the 2024 Election in Indonesia is related to the fulfillment of the 30 percent quota for women in legislative nominations. In the 2024 Election, in the Gorontalo Electoral District, political parties that did not meet the 30 percent quota for women as legislative candidates were allowed to participate in the legislative election. Then, the Constitutional Court corrected and annulled the election results through a Revote in Electoral District 6 Gorontalo because many political parties did not meet the requirements. This decision is certainly interesting to study because it can have a major impact on legislative nominations that must include at least a 30 percent quota for women not only in Gorontalo but applies to all electoral districts in Indonesia. This study examines two things, first, the ratio legis and the urgency of the need to protect women's constitutional rights in legislative nominations in the General Election, second regarding the implications of Constitutional Court Decision Number 125-01-08-29 / PHPU.DPR-DPRD-XXII / 2024 concerning the protection of women in legislative nominations in the upcoming General Election. The research method used is normative juridical with case and statute approach. Secondary research data sources include Constitutional Court Decisions and laws and regulations related to legislative nominations in elections. This study concludes, first, that the Constitutional Court provides guarantees and protection for women in nominating legislative members in the 2024 Election. The 30 percent quota for women in legislative nominations by political parties is an absolute prerequisite for holding legislative elections at all levels. Second, the legal implications of Constitutional Court Decision Number 125-01-08-29 / PHPU.DPR-DPRD-XXII / 2024 require every political party to include a 30 percent quota in nominating legislative members in the Election. If this is not met, the political party cannot participate in the election.
