Abstract

The main problem in this study is how is the condition of religious communities after the circulation of the Directive of the Guidance and Guidance of the Islamic Community Guidance Number: Kep/D/101/1978 on Guidance for Loud Speakers in Mosques, Langgar and Mushola and how it is implemented in the context of pluralism and then see the policy in terms of perspective Islamic constitutional law. The purpose of this study is to describe how the conditions of worship of religious people before and after the circulation of the circular letter and to know how the implementation of the circular Directive Directorate General of Islamic Community Guidance Number: Kep / D / 101/1978 about Guidelines for Loud Speakers in the Mosque, Langgar, and Mushola for realizing what was instructed in the circular.

Abstract

Artikel ini mengkaji tentang eksistensi Uang Jujuran pada perkawinan di Nagari Tanjung Betung, Kecamatan Rao Selatan, Kabupaten Pasaman. Adapun yang menjadi pertanyaan adalah apa yang melatarbelakangi Uang Jujuran dalam perkawinan dan bagaimana keberadaan Uang Jujuran dalam pelaksanaan perkawinan tersebut. Metode yang digunakan adalah penelitian lapangan (field research) dengan pendekatan deskritif analitis. Adapun temuan dari penelitian ini adalah bahwa sebelum melaksanakan perkawinan calon suami harus membayar Uang Jujuran kepada calon istri dalam proses perhitungan keluarga terlebih dahulu, yang diawali dengan pelaksanaan menyapai (peminangan) oleh calon mempelai pria, kemudian dilaksanakan pertunangan, setelah dilaksanakan pertunangan maka dilanjutkan dengan perhitungan keluarga sekaligus pemberian Uang Jujuran sesuai dengan hasil kesepakatan kedua belah pihak. Jumlah Uang Jujuran ini  dilihat dari status calon istri baik dari status pekerjaan, kecantikan, dan tingkat pendidikan. Jika tidak dilaksanakankan maka berimplikasi akan diberi sanksi adat. Dan adapun dampak lain jika tidak dibayar oleh calon suami serta tertundanya upacara perkawinan. Oleh karena itu, pandangan Hukum Islam terhadap keberadaan Uang Jujuran dalam pelaksanaan perkawinan adalah termasuk kepada golongan ‘Urf Shahih. Hal ini berdasarkan syarat-syarat ‘urf dijadikan sebagai sumber Hukum Islam yaitu, adat tersebut bernilai mashlahat, karena berdampak pada kebaikan antara pihak laki-laki maupun perempuan, untuk memperlihatkan keseriusan untuk menikah, memperlihatkan rasa tanggung jawab laki-laki, memperlihatkan kemapanan laki-laki.

Abstract

This study examines the ownership status of plants and land in the loan agreement ('ariyah) in Jorong Guguak Baruah Nagari Padang Magek according to Fiqh Muamalah. The problem is that the implementation of borrowing loans ('ariyah) is not in accordance with the initial agreement, namely to plant chilies, but in practice the borrower plants papaya and banana trees, at the initial agreement the loan limit is until the land is needed back by the lender, but in practice the borrower Instead, they asked for compensation and continued to use the land until the time limit specified in the initial agreement of the two parties. From this problem arose the question of how the status of land ownership in the loan agreement ('ariyah) was located in Jorong Guguak Baruah Nagari Padang Magek and how the legal consequences of the plants in the loan agreement ('ariyah) in Jorong Guguak Baruah Nagari Padang Magek according to Fiqh Muamalah. This research is a field research (field research). The data were obtained through interviews and observations. This study found that the status of land ownership in the loan agreement ('ariyah) in Jorong Guguak Baruah Nagari Padang Magek is fully owned by the lender with proof of land certificate in the name of the lender and a letter of sale and purchase of land. The status of the ownership of the plant is owned by the borrower until the agreed time limit.. The legal consequences of the plant in the loan agreement ('ariyah) in Jorong Guguak Baruah.

Abstract

This paper examines the practice of implementing the Muzara'ah contract agreement in Jorong Sawah Kareh Nagari Balimbing. The purpose of this article is to find out and explain the practice of implementing the Muzara'ah contract in Jorong Sawah Kareh Nagari Balimbing in terms of three aspects, namely the implementation time limit, the form of profit sharing and ownership status according to Muamalah Fiqh. The results of the field study with data obtained from five groups of residents who carried out this muza'raah collaboration, the results obtained were that first; in terms of time limits, there is an implementation of the agreement that is not in accordance with the fiqh muamalah theory because when two groups cooperate and one of the parties dies, the muzara'ah agreement does not end. Second; in terms of profit-sharing, there are still cultivators who take the share of the land that should have been when one group that made the agreement dies, the contract and profit-sharing also end. However, the reality on the ground is that cultivators are still taking produce from the land. This is not in accordance with the concept of sharing the results of muzara'ah, unless it is then carried out with the concept of profit sharing on the basis of consensual agreement between the heirs of the land owner and the cultivators in the future. Third; viewed from the case of the concept of ownership status, land in the form of this cooperation belongs to imperfect property because land ownership is only in terms of the use of the object or its benefits. However, in practice there are groups who when the first party (land owner) dies and there is no stipulation on the expiration date of the muzara'ah in the agreement, assumes that he is the owner of the plant and still benefits from the land.

Abstract

This study aims to explain the implementation of weighing oil palm fruit in Nagari Talao Sungai Kunyit in terms of positive law and fiqh muamalah. This research is a field research. Data were obtained in two ways, namely secondary data and primary data. The primary data are toke (collectors), oil palm farmers and the Head of the Cooperative and Industry Office of South Solok Regency, while the secondary data sources are the profile of Nagari Talao Sungai Kunyit, Nagari year-end reports and Indonesian legislation. This study found that the implementation of weighing in the sale and purchase of oil palm fruit in Nagari Talao was carried out with containers made of wood that were rarely arranged, so that many “brondol” (small) palm fruit fell. Oil palm fruit that falls from the container is not counted in the scales, as a result of farmers' losses. In fact, the number of “brondol” (small) palm oil that has fallen is quite a lot. In positive law, the implementation of weighing selling oil palm fruit in Nagari Talao is not in accordance with the provisions of Article 25 and Article 28 of Law Number 2 of 1981 concerning Legal Metrology, Article 2 of the Minister of Home Affairs Number 68 of 2018 concerning UTTP Calibration and Re-calibration and Article 8 of Law -Law Number 8 of 1999 concerning Consumer Protection. In this explanation, it is explained that the weighing in buying and selling will not harm either party and the scales used must be recalibrated once a year. As for the implementation of fiqh muamalah muamalah in Islam, namely injustice to fellow humans, and there is no fraud (gharar) and elements of coercion (al-ikrah).
