Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis berbagai permasalahan Tenaga Kerja Indonesia (TKI) di Luar Negeri; dan mendeskripsikan perlindungan hukum TKI berdasarkan UU no. 39 tahun 2004 tentang penempatan Tenaga Kerja Indonesia di Luar negeri. Penelitian ini termasuk penelitian yuridis normatif dengan teknik pengumpulan data melalui kepustakaan dan dokumentasi menggunakan bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa masyarakat Indonesia  bekerja keluar negeri dipengaruhi oleh sempitnya lapangan kerja di luar negeri, rendahnya upah di dalam negeri, tersedianya lapangan kerja yang luas di luar negeri dengan tingkat upah yang jauh lebih tinggi dibanding di Indonesia. Persoalaan penempatan TKI diluar negeri sangat kompleks, baik persoalan pra penempatan, penempatan, maupun purna penempatan. Kasus-kasus yang sering menimpa TKI misalnya, panipuan, pamalsuan dokumen, pelecehan seksual, pemerkosaan, penyiksaan, dan traficking (perdagangan manusia). UU No. 39 tahun 2004 tentang penempatan TKI dimaksudkan memberikan perlindungan secara hukum kepada TKI mulai dari pra penempatan, penempatan, hingga purna penempatan.This study aims to determine and analyze the various problems of Indonesian Workers (TKI) in Foreign Affairs, and describe the legal protection of migrant workers under Law No. 39 Year 2004 About the Indonesian Labor. This research includes the study juridical normative data collection techniques through literature and documentation using primary and secondary legal materials. The results showed that the Indonesian people who are willing to work abroad is influenced by the narrowness of overseas employment, low wages in the country, widespread availability of jobs overseas to wage levels much higher than in Indonesia. The placement problem of workers abroad is very complex, both pre-placement issues, placement, and after placement. These cases are often among migrant workers for example, fraud, illegal documents, sexual harassment, rape, torture, and trafficking. Law No. 39 Year 2004 concerning the placement of migrant workers is intended to give legal protection to migrant workers from pre-placement, placement, until after placement

Abstract

Act no. 3 / 1997 on cildren justice, there are several weaknesses, both substantive as well as implementation. Based on the literature search results can be obtained a description of current courts child.  The  weakness  of the substantive law the  court the  child does  not regulate the diversion, whereas the current implementation of the court gives the child the negative impact of stigma on children's self how actors delinquency. Restorative justice model is one model of juvenile justice, in order to protect children in order to avoid the psychic trauma and label / stamp of former criminals. The main purpose of the restorative justice model is the improvement of wound suffered by the victim, perpetrator confession against injury caused by his  actions and conciliation and reconciliation among victim, offender and community.

Abstract

The  issue  of capital  punishment has  always  been a controversial debate.  Pros  and cons  of the application  of the  death  penalty always  fight ditingkatan community,  and policy  makers. Controversy also exists the death penalty in both international and national stage. From the results of literature in various literature indicated that capital punishment is not contrary to human rights, it is based on the restriction of human rights through the law of the country and some international document as efforts to protect the public from arbitrary deprivation of life in humans. The concept of the Penal Code still retains the death  penalty, but it is exceptional and placed  separately from the principal criminal row. The death penalty is applied as a last resort to protect the public from crime. This policy is based on the idea of a balance between the protection of individual interests with the public interest / universal. Keywords: Criminal dead, human rights

Abstract

Defamation  offense  against  God  (blasphemy)  of  the  Criminal  Code  has  not  been  set  explicitly, however, for the implementation of the actions that occur can be constructed in Article 156 and Article 156a of the Criminal Code. But the concept of the 2012 Criminal Code offense of contempt of  God  (Blasphemy)  has  set  out  clear.  In  some  foreign  countries  there  are  clearly  formulate Blasphemy in its penal code (as in the Netherlands, Finland), but also there are not formulating defamation  offense  against  God  (blasphemy)  explicitly,  as  in  Belgium,  Brunei  Darussalam, however  blasphemous  offense  can  still  criminalized  through  article  humiliation  /  desecration  of religious life. Keywords: crime, blasphemy.

Abstract

abstract Early  warning  of  corruption  crime  could  be  done  earlier  through  education.  School  could  make various  policy  strategy  in  building  anti-corruption  attitude  for  students.  This  research  aimed  to create  policy  strategy  for  building  anti-corruption  chacarcter  for  students.  This  research  used sociological juridic approach and descriptive analitic.From  the  research  result, school  could  do  several  steps  or  strategy  in  bilding  anti-corruption attitude through  :  1)  integrate  the anti-corruption  character  in  lessons  or  subject;  2)  uphold  the diciplines  of  the  school  rules  especially  when  examination  goes  on;  3) socialize  to  the  students about the crime of corruption; 4) build the canteen of honesty; 5) show the role model of honest and diciplines attitude to the students; 6) apply the transparent and accountability toward activities inn  the  school;  7)  integrate  to  the  extra  curicular  in  building anti-corruption  attitude;  8)  publish anti-corruption posters; 9) make anti-corruption education curriculumKeywords: corruption crime, policy strategy, Anti-corruption educatio

Abstract

The existence of “Tiban” market in Pekalongan is not freed from protracted economy crisis which caught up with Indonesia. The “Tiban” market as an alternative option of society to survive and get away from economy problem results the variety of either positive or negative effects which emerge various options about the existence of the market. Perceiving the pro’s and con’s to the existence of the “Tiban “ market, government must have made a rule which purposes to regulate the existence of the market in order to avoid various problems which inflict a loss upon the widespread society.Key Word : The Tiban Market

Abstract

The position of Notary as a profession that cannot be separated from the development of existing technology. The wave of technology in the Industrial 4.0 and Society 5.0 era requires Notaries to be able to move quickly, especially in carrying out their duties. Major changes in technological developments have encouraged the Indonesian nation as a modern democracy to transform its electronic system for the public interest. The term Cyber Notary emerged in this case, which was discussed as being able to speed up the work of a Notary as a public servant in terms of making a Notary deed. If it is based on the values that shape it, technology and politics are of course different, technology thrives in scientific knowledge and objective facts while law is made in the public domain which demands technical regulation in the reciprocal relationship between culture, politics and technology. This is concretized by Act No. 14 of 2008 concerning Public Information Disclosure (UU KIP) and Act No. 11 of 2008 concerning Information and Electronic Transactions (UU ITE) in conjunction with Act No. 19 of 2016.

Abstract

AbstractFeminist are trying to fight for women in Indonesia to stand in line with men. However, these struggles are often based on liberal ideology. Gender equality based on liberal values can certainly be contrary to the values of Pancasila.  Based on this, it needs to be discussed related to Pancasila Feminism as a form of gender justice based on the values of Pancasila precepts. Feminism based on human rights must still respect the differences in culture, nation and religion embraced by each country. In Pancasila feminism, all gender equality struggles must be in accordance with the nature of Pancasila which includes awareness as a creature of God, awareness as a civilized and just human being, awareness as a social being, unity and nationhood, and the ability to consult consensus. The views of feminism should not be contrary to the values of Pancasila, especially, with the value of Godhead. Religion considers that the position of men and women is equal in God's eyes. However, equality does not mean in all things for example in domestic and inheritance affairs.Keywords:  Feminism, Gender Equality, Pancasila  AbstrakPara pemerhati feminisme berusaha memperjuangkan kaum perempuan di Indonesia untuk berdiri sejajar dengan laki-laki. Namun, perjuangan tersebut seringkali berpedoman pada ideologi liberal. Kesetaraan gender yang berlandaskan nilai-nilai liberal tentu dapat bertentangan dengan nilai-nilai Pancasila.  Berdasarkan hal tersebut, perlu dibahas terkait Feminisme Pancasila sebagai bentuk keadilan gender yang berbasis pada nilai-nilai sila Pancasila. Feminisme yang berdasar pada hak asasi manusia harus tetap menghormati perbedaan budaya, bangsa dan agama yang dianut masing-masing negara. Dalam feminisme Pancasila, semua perjuangan keseteraan gender harus sesuai dengan sifat Pancasila yang meliputi kesadaran sebagai makhluk Tuhan, kesadaran sebagai manusia yang beradab dan berkeadilan, kesadaran sebagai makhluk sosial, bersatu dan berbangsa, dan kemampuan bermusyawarah mufakat. Pandangan feminisme tidak boleh bertentangan dengan nilai-nilai Pancasila, terutama, dengan nilai Ketuhanan. Agama menganggap bahwa kedudukan laki-laki dan perempuan adalah sama di mata Tuhan. Namun, kesetaraan itu bukan berarti dalam segala hal misal dalam urusan rumah tangga dan waris. Kata Kunci: Feminisme, Kesetaraan Gender, Pancasila
