Abstract

Tujuan penulisan ini yaitu mengedukasi masyarakat melalui program KKN UINSU di desa Sei Suka Deras, Kecamatan Sei Suka, Kabupaten Batu Bara tentang pentingnya gizi seimbang dengan sosialiasi dan posyandu sebagai tindakan pencegahan terjadinya stunting sejak dini. Penelitian ini merupakan Community-Based Research (CBR) dengan pendekatan Participatory Action Research (PAR) yang melibatkan partisipasi masyarakat sebagai inti pelaksanaan dari penelitian. Sampel yang digunakan penelitian ini yaitu para ibu yang memiliki anak balita dimana penetapan sampel dilakukan secara tidak random. Teknik pengumpulan data berupa pengamatan langsung, dokumentasi, wawancara terhadap tokoh masyarakat, catatan lapangan, serta internet surfing yang dilakukan untuk memperoleh data-data terkini supaya data yang diperoleh bersifat faktual. Hasil dari penelitian ini menunjukkan bahwa tingkat kesadaran masyarakat mengenai masalah stunting meningkat setelah berpartisipasi dalam sosialisasi mengenai stunting. Selain itu juga, rutin dalam melakukan posyandu bagi balita untuk menurunkan prevelensi stunting dibawah 14%.

Abstract

Bahaya kolonialisme barat menjadi yang paling penting dalam pemikiran sosial-politik Jamaluddin. Menurutnya, perilaku menyimpang para penguasa muslim saat itu yang sangat absolut menyebabkan Islam mundur dan semakin membuat barat berkuasa di wilayah Islam. Oleh karena itu, Jamaluddin menciptakan beberapa ide di bidang politik untuk membuat umat Islam bangkit dan bersatu melawan kolonialisme, diantaranya yaitu Pan-Islamisme, Partai Nasional dan Pemerintahan Republik, ide tentang modernitas, dan tidak ada pemisahan antara agama dengan politik. Penelitian ini termasuk penelitian kepustakaan (Library Research). Metode yang digunakan adalah deskriptif analitis dengan menggunakan analisis kualitatif. Hasil penelitian menunjukkan bahwa di Indonesia, keinginan untuk menegakkan politik yang berbau syari’at Islam telah menjadi sebagian dari sejarah panjang perjuangan umat Islam di negeri ini. Oleh karena itu, tidak heran ketika dari kalangan Islam lahir partai-partai politik. Ada beberapa faktor yang menyebabkan munculnya partai-partai politik Islam di Indonesia. Salah satunya karena faktor sosiologis yang mana umat Islam sebagai kaum mayoritas di Indonesia memerlukan wadah untuk berorganisasi. Karena itulah gagasan Pan-Islamisme dijadikan peninggalan warisan pemikiran oleh tokoh Indonesia. Konsep Pan-Islamisme dalam perkembangan partai politik di Indonesia menunjukkan bahwa gagasan ini sangat berpengaruh karena menimbulkan wadah organisasi politik bernafaskan Islam di Indonesia.

Abstract

This study investigates the legal validation of pasu-pasu raja marriages, a traditional Batak Toba ritual, at the Tarutung Religious Court, particularly in cases involving converts to Islam. The research explores three primary issues: the legal status of pasu-pasu raja under Indonesian law and Islamic law, the requirements for validating such marriages for converts, and the judicial responses at the Tarutung Religious Court. Employing a normative juridical approach with case study analysis, the findings indicate that while pasu-pasu raja is not part of the formal Islamic marriage process, it can serve as a cultural complement to a legally valid Islamic marriage. Under Indonesian positive law, itsbat nikah (marriage validation) is permissible for convert couples, provided the marriage complies with Islamic principles and is free from legal barriers. Most Islamic scholars affirm the validity of non-Muslim marriages post-conversion, without the necessity of a new marriage contract. The Tarutung Religious Court aligns with this perspective, offering legal certainty to converts without mandating a new contract. This legal recognition is consistent with the principles of maqashid asy-syar'iyyah, which emphasize the welfare and legal legitimacy of marriages

Abstract

This study aims to analyze the protection of women's rights in the practice of remarriage contracts (akad nikah ulang) conducted after the birth of a child conceived out of wedlock in Tanjung Pura District, Langkat Regency. Normatively, Article 53 paragraph (3) of the Indonesian Compilation of Islamic Law (KHI) explicitly stipulates that a marriage performed while a woman is pregnant does not require a remarriage contract after the child is born. However, in social practice, this phenomenon persists due to the belief that the initial contract merely legitimizes the unborn child, whereas the second perfects the marital bond. Employing an empirical juridical method with a socio-legal approach, primary data were collected through interviews with religious leaders, KUA registrars, community figures, and practicing couples. Data were qualitatively analyzed using Islamic law, Indonesian positive law, and women's legal protection theories. The findings reveal that religious caution (iḥtiyāṭ), social pressure, stigma, and the pursuit of moral legitimacy primarily drive this practice. From the Shafi'i School perspective, remarriage is not obligatory if the initial contract fulfills all essential pillars and requirements. Similarly, Indonesian positive law provides no juridical basis for such practices. Consequently, this practice significantly impacts women's rights, reinforcing social stigma, imposing psychological burdens, undermining legal certainty regarding women's marital status, and reproducing gender inequalities within society. Furthermore, the study highlights the urgent need for structural intervention by state apparatuses and religious institutions to mitigate customary practices that systematically disadvantage women under the guise of religious perfection.

Abstract

This study examines the Galang Batang agreement as a form of conflict resolution between husband and wife in Gunung Manaon 1 Village from the perspective of Islamic law. Galang Batang is a local customary practice that serves as an informal mediation method in resolving marital disputes. The aim of this study is to understand the implementation mechanism of the Galang Batang agreement, its effectiveness in preserving household harmony, and the extent to which this practice aligns with Islamic legal principles, particularly in terms of justice, public interest (maslahah), and family dispute resolution. This research employs a qualitative method with a normative-sociological approach, through interviews with traditional leaders, married couples, and local religious figures. The findings reveal that Galang Batang not only functions as a means of conflict resolution but also reinforces social and religious values. From the perspective of Islamic law, this practice is acceptable as long as it does not contradict the sharia and upholds the principles of consultation (shura), justice, and peace. Therefore, Galang Batang represents a form of harmonization between customary law and Islamic law in resolving family conflicts.
