Abstract

In the growing business world is balanced by the development of technology which is also increasingly rapid. Evidence in the field can be seen on the online trading site. The point is that in buying and selling online there is a process which then arises an agreement that is poured online or electronically. This electronic agreement if analyzed in the world of Notaries and the National Law domain indirectly also influences. The validity of the agreement is still questionable, because none of them are clearly stated in the provisions of the law. In the national law based on the law governing the deed itself, namely the Law of Notary Position and the Civil Code, the application of these provisions will not yet be clearly regulated in both laws. The principle of confidentiality that must be upheld in Article 16 of the LawJN must still be carried out even in making electronic deeds. This study uses a normative juridical method, which describes, explains and at the same time explains the notary liability in upholding the principle of confidentiality in the making of an electronic notary deed. be an authentic deed or not. Notary liability does not uphold the principle of confidentiality according to Article 16 of the UUJN, the notary must be responsible for all the contents of the deed.

Abstract

Diskrepansi regulasi dalam persyaratan pengangkatan notaris dan notaris pengganti di Indonesia telah memunculkan persoalan serius dalam sistem hukum notariat, khususnya terkait kepastian hukum dan perlindungan masyarakat. Penelitian ini bertujuan untuk menganalisis secara kritis ketidakharmonisan regulatif antara kedua jabatan tersebut, serta mengevaluasi dampaknya terhadap kualitas pelayanan notarial dan integritas profesi. Metode yang digunakan adalah pendekatan yuridis normatif yang dikombinasikan dengan analisis empiris dan studi komparatif terhadap sistem notariat di negara lain seperti Belanda, Prancis, dan Amerika Serikat. Hasil penelitian menunjukkan bahwa perbedaan mencolok dalam aspek kualifikasi pendidikan, mekanisme pengangkatan, sistem pengawasan, sertifikasi, dan pengembangan profesional antara notaris dan notaris pengganti menyebabkan ketimpangan kompetensi dan menurunkan kualitas akta notarial. Implikasi dari temuan ini menekankan perlunya reformasi sistem melalui penyatuan standar pendidikan, uji kompetensi terstandar, pengawasan terintegrasi, serta pelatihan dan sertifikasi berkala. Reformasi tersebut diharapkan dapat menciptakan sistem hukum notariat yang lebih konsisten, akuntabel, dan mampu memberikan perlindungan hukum yang lebih optimal kepada masyarakat.

Abstract

Abstract. The Omnibus Law on Job Creation (Law No. 11 of 2020) brought significant changes to labor regulations in Indonesia, particularly regarding termination of employment (PHK). This law provides greater flexibility for employers in the PHK procedure, especially for economic or efficiency reasons, but raises concerns about the protection of workers' rights, such as severance pay. In this context, Law No. 6 of 2023 was enacted to strengthen the protection of workers' normative rights, including in the PHK procedures and social security. This law clarifies the provisions related to PHK, offers better legal certainty, and strengthens sanctions for employers who violate the rules. Despite challenges in implementation, both laws aim to create a balanced labor climate that supports job creation and investment without sacrificing workers' rights.
