Abstract

The growth of Yayasan (Foundation) in Indonesia has became wide in all public life major such as in social, religion, or humanity major. The existence of Yayasan is a need for the public who want an institution that has a social, religion or humanity character or aims. Yayasan is a tool that functionally can become a tool for the social, culture, and sains works. But lately, the facts show that public bulid a Yayasan not just for the social, religion or humanity matters but also to waive their obligation, such as waive pay the  tax, to rich theirselves, and for the commercial interest that can make a damage to other interest. Beside this problems, there are other problems that occur such as, the activities that done by the Yayasan was not same as the Anggaran Dasar Yayasan and the disputes between the parties in the Yayasan. This problems can come about because there is no regulation that regulate this matters particularly, so with the birth of the UNDANG-UNDANG NOMOR 16 TAHUN 2001 TENTANG YAYASAN hope this problems can be solved.

Abstract

Development of technology, communications and the internet make people life easier and faster. Online systems provide changes to buy foods & goods, reserve online transportation even to get consultation with doctor. This research aims to examine the legal aspects of online consultation between doctor and patient or users, about the limitations that can be given in the consultation. The method used is the normative juridical method, using secondary data in the form of books, journals, articles and related regulations and data analysis techniques used are qualitative descriptive. The results of the study: (1). People can consult & communicate with doctors through the online medium by providing true information about their disease history, use of certain drugs and doctors would give the opinions according to the patient's information and the code of ethics; (2). Abstract

Indonesia is one of the countries in the world with the most cases of animal violence. The violence ironically also occurs in pets that should receive protection and good care by their owners. In addition to violence, pets are even abandoned by their owners, while it is known  that the Indonesian ius constitutum requires animal owners, including pets, to take good care of their animals until they die naturally. This study wants to examine how Indonesian law regulates obligations for animal owners towards their pets, legal protection of pets from acts of violence and neglect committed by owners, and to prevent similar acts from being repeated because apart from these acts violate the applicable legal rules, not in accordance with the dignity and dignity of the Indonesian nation as a civilized nation,  it also has the potential to cause an impact/disturbance to order, peace, and public health and the surrounding environment. The research method used is normative juridical with the nature of qualitative analysis using primary legal materials, namely Law Number 41 of 2014 concerning Livestock and Animal Health, Government Regulation Number 95 of 2012 concerning Veterinary Public Health and Animal Welfare and the Criminal Code (KUHP); secondary legal materials; and tertiary legal materials. The results of this study state that acts of violence and abandonment of pets by owners are included in the category of criminal acts, namely crimes and perpetrators can be subject to criminal sanctions.

Abstract

Covid-19 membawa dampak perubahan yang luar biasa dalam segala sektor kehidupan manusia, sisi ekonomi, kesejahateraan sosial, dan ketahanan pangan. Pada tulisan ini, Peneliti membahas tentang ketahanan pangan di Indonesia pada masa Covid-19. Masyarakat Indonesia memerlukan pangan yang baik, pangan yang berkualitas. Pangan yang berkualitas tinggi akan membuat masyarakat Indonesia semakin siap menghadapi Covid-19. Rumusan masalah peneliti: bagaimana perlindungan hukum untuk mewujudkan ketahanan pangan masyarakat di masa Covid-19? Dan bentuk insentif apa yang dapat diberikan kepada petani? Metode penelitian yakni metode yuridis normative. Peneliti menggunakan data sekunder yang berkaitan dengan topik Penelitian dan akan dianalisis secara deskriptif kualitatif. Hasil penelitian diharapkan dapat memberikan pandangan kepada Pemerintah dimana kebijakan impor pangan dilakukan sebagai upaya terakhir. Pemerintah melalui Kementerian Pertanian dan Pemerintah daerah wajib memberikan perlindungan hukum wajib diberikan ke petani dalam bentuk nyata, misalnya memberikan insentif. Insentif tersebut dapat berupa uang tunai, pemberian pupuk gratis, ataupun bibit dengan kualitas tinggi.

Abstract

Penelitian ini bertujuan untuk mengevaluasi efektivitas pengelolaan Alokasi Dana Desa di Desa Rahuning, Kabupaten Asahan, pada tahun 2023. Pada tahun 2023 Desa Rahuning menerima Alokasi Dana Desa sebesar Rp499.585.500. Dana ini digunakan untuk beberapa bidang, yaitu penyelenggaraan pemerintahan desa, pemberdayaan masyarakat desa, dan pelaksanaan pembangunan. Jenis penelitian yang digunakan adalah penelitian kualitatif dengan pendekatan deskriptif, serta metode pengumpulan data melalui wawancara dan dokumentasi. Dari hasil penelitian dalam kegiatan pengelolaan keuangan desa di Desa Rahuning Kecamatan Rahuning Kabupaten Asahan mencakup perencanaan, pelaksanaan, penatausahaan, pelaporan, dan pertanggungjawaban. Efektivitas pengelolaan Alokasi Dana Desa (ADD) di Desa Rahuning, Kecamatan Rahuning, Kabupaten Asahan, pada tahun 2023 berada dalam kategori efektif. Tingkat efektivitas pengelolaan ADD di Desa Rahuning pada tahun 2023 mencapai angka 100%, yang menunjukkan bahwa pengelolaan tersebut efektif. Berdasarkan hasil penelitian, dapat disimpulkan bahwa pengelolaan keuangan desa di Desa Rahuning telah sesuai dengan Peraturan Menteri Dalam Negeri Nomor 20 Tahun 2018. Namun, pertanggungjawaban pemerintah belum dilaksanakan secara optimal. Pemerintah seharusnya menginformasikan laporan keuangan desa melalui media seperti banner, baliho, atau saluran informasi lainnya.

Abstract

Introduction: The recognition of Individual LLCs is a concrete step from the government to support micro and small enterprises, which triggers Indonesia's economic growth. However, improvements to the regulation of Individual LLCs are needed immediately.        Purposes of the Research:  The research aims to explain and analyze the regulatory comparison of an Individual LLC in Indonesia and a Single-Member LLC owned by an Individual in Vietnam.Methods of the Research: The type of research is normative legal research with statutory and comparative approaches. Data was collected using library research with qualitative analysis.Results of the Research: The results can see from various aspects, such as the definition, company establishment, organizational structure, rights and obligations of company founders, and conversion. In Indonesia, the definition is outlined in Regulation of the Minister of LHR Number 21/2021, while in Vietnam is regulated in Law on Enterprises 2020. An Individual LLC in Indonesia can only establish by an individual, whereas in Vietnam, the owner of the Single-Member LLC can be an organization or an individual. Indonesia only knows the Company's Director, while there are President and a Director/General Director in Vietnam. The rights and obligations of the owner of an Individual LLC in Indonesia are not explicitly regulated, while Vietnam regulates it. It's possible to convert only an Individual LLC into a Capital Partnership LLC in Indonesia, while in Vietnam, it is possible to change either way. Evaluation and improvement of the regulation of Individual LLCs in Indonesia are urgently needed to create a firm legal umbrella for micro and small business actors.

Abstract

The corporation is an organized collection of persons and/or wealth, whether it is a legal entity or non-legal entity [Article 1 point 1 of Supreme Court Regulation No. 13 of 2016). Corporations are established to seek profit / profit unlawfully. Marks are one of the intellectual property rights protected by Law No. 20 of 2016 concerning Marks and Geographical Indications (Law 20/2016). Trademark rights holders are protected by Law 20/2016 from counterfeiting acts. This paper will discuss penalties both regulated in Law 20/2016 or will be regulated in Law Number 1 of 2023 concerning the Criminal Code [KUHP (Law 1/2023)] concerning corporate punishment. The formulation of the problem raised is how is the ideal punishment for corporations that falsify the perspective brand of dignified justice theory? The research method used is the normative juridical method. The author uses secondary data in the form of primary legal material, secondary legal material, and tertiary. And the author uses qualitative analysis to come up with a conclusion. The result of the study, namely the theory of dignified justice, is a theory initiated by Teguh Prasetyo, Professor of the Faculty of Law, Universitas Pelita Harapan, this theory is based on Pancasila and aims to humanize humans (nge wong ke wong-in Javanese). The Criminal Code (Law 1/2023) provides guidance on the requirements for corporations that can be criminally liable. Based on the Criminal Code (Law 1/2023), the criminal for corporations is the main crime in the form of fines, and additional crimes. Meanwhile, based on Law 20/2016, imprisonment and/or fines may be  imposed, for example: sentenced to a maximum of 5 (five) years imprisonment and/or a maximum fine of  Rp2,000,000,000.00 (two billion rupiah). The ideal crime & in accordance with the theory of dignified justice for the corporation is the criminal fine, and destruction of goods from the counterfeited brand, as well as the revocation of licenses.
