Abstract

The use of fatwa to delegitimize the constitutional rights of citizens to compete in a healthy manner in filling in public positions as occurred in the 2017 DKI Jakarta Pilkada is a form of injustice and manipulation. The fatwa which is actually not binding is then forced through the discourse strategy until the emphasis and mass action. In this paper, the phenomenon is examined with a critical discourse analysis tool in order to analyze the practice of acting that reflects social problems, relativize the practice of ideological mystification in fatwas, ignite public awareness of injustice and marginalization in the use of fatwas, and finally find solutions to overcome them. This paper shows that there has been a politicization of religion in the use of fatwas in the 2017 DKI Jakarta Pilkada. The politicization of religion through fatwas is a political practice that must be avoided, various solutions to overcome it, as contained in this paper, need to be further elaborated and executed.

Abstract

Nation building requires a cultural basis and platform as a basis for solidarity. In countries where the majority of the population is Muslim, religious aspirations and political movements must emerge. Certain strategies and handling are needed so that these Islamic aspirations are not counterproductive to national development. Muhammad Said Al-Asymawi's view on the relationship between religion and politics contributes a lot of understanding and clarification and becomes an important exemplar of the dynamics of thought so that fiqh siyasa rediscovers its relevance in the contemporary world. For Muhammad Said Al-Asymawi, Muslims need a fear of secularization in the sense of placing religion and politics in their respective places so that religion can manifest in life without being manipulated and reduced by politics. To arrive at this need requires a complete and adequate understanding of what he calls authentic Islam. His mastery of Islamic treasures and the history of Islamic development, makes his views on the relationship between Islam and politics difficult to refute and dispels the stigma of some people that he is a liberal thinker. Muhammad Said Al-Asymawi offers a scientific and authentic perspective on siyasa fiqh and makes siyasa fiqh actual and relevant again in the current situation and conditions.

Abstract

Mediation in court plays an important role in the settlement of divorce cases, besides being expected to be a means of accommodating the fulfillment of women's and children's rights post-divorce. Rules regarding mediation and guarantees for the fulfillment of women's and children's rights after divorce are summarized in several Permas and Sema. From a legal political perspective, these Perma and Sema are simultaneously based on the 1945 Constitution, Law No. 7 of 1984 concerning the Convention on the Elimination of All Forms of Discrimination against Women, and Law No. 12 of 2005 concerning Ratification of the International Covenant on Civil and Political Rights, aiming to create justice in the future, gender justice, and the benefit of society. In order for the law's objectives to be achieved, various Perma and Sema were formed as guidelines for judges and mediator courts to maximally guarantee the fulfillment of the law on women's and children's rights post-divorce. In particular, efforts not to carry out mediation in a pro forma manner, so that it fails to provide legal guarantees for the fulfillment of women's and children's rights post- divorce, permanent mediation in court, strictly and in detail stipulates the importance of good faith in mediation, as well as sanctions for parties who not having good faith in mediation, as well as partial agreements that contain the rights of post-divorce women and children.

Abstract

Religious offenses originate from material in Law no. 1/PNPS/1965 concerning Prevention of Abuse and/or Blasphemy of Religion. Material in Law no. 1/PNPS/1965 has repeatedly requested a judicial review of the Constitutional Court, with various arguments of damage to the constitutional rights of the applicants, but the Constitutional Court passed Decision Number 140/PUU-VII/2009, Decision Number 84/PUU-X/2012, Decision Number 56/ PUU-XV/2017, Decision Number 76/PUU-XVI/2018, and finally Decision Number 5/PUU-XVII/2019, essentially rejected the application. In the new Criminal Code, religious offenses are maintained with several new formulations. This article examines the political aspects of religious offense law in the new Criminal Code, especially in relation to the ideal legal ideals to be achieved through the accommodation and implementation of religious offenses in the Indonesian context. This study yielded several important points, first, religious offenses were once used by the colonial government to control the potential resistance of tarekat and Ratu Adil groups, so from this it can be understood that the political interests of the ruling regime were a determining factor in the interpretation and implementation of religious offenses. Second, the aim of religious offense law in the new Criminal Code is aimed at protecting freedom of religion and belief even for religious groups, so that the formulation of the offense also avoids word choices that allow excessive use which has the potential to criminalize religious groups and beliefs outside of orthodoxy. Third, a productive space for interpretation among law enforcers regarding religious offenses must be maintained and guidelines for the implementation of religious offenses for them must be immediately prepared, an interpretation space and guidelines that are compatible with the principles of guaranteeing substantive equality and upholding distributive justice, especially for religious groups and beliefs outside of orthodoxy. mainstream.

Abstract

Abstrak: Ekonomi syariah diharapkan mempercepat terwujudnya keadilan ekonomi yang merata bagi mayoritas masyarakat. Lembaga dan hukum ekonomi syariah berkembang pesat di Indonesia kontemporer. Perkembangan ini perlu dikritisi, di antaranya dengan meninjau ulang orientasi danpolitik hukum yang menopang perkembangan itu, sebab jika ternyata perkembangan tersebut tanpa orientasi dan politik hukum yang jelas, maka ia hanya menjadi semacan trend yang sulit diharapkan kontribusinya. Tulisan ini merupakan telaah politik hukum terhadap perkembangan hukum ekonomi syariah di Indonesia kontemporer. Telaah ini berusaha untuk menjelaskan dua hal pokok. Pertama,arah dan orientasi hukum ekonomi syariah Indonesia dari perspektif tujuan hukum Islam dan derajat saling-memengaruhi antara hukum dan politik rezim. Kedua,kemungkinan perubahan dan pengembangan lebih lanjut arah dan orientasi hukum ekonomi syariah di Indonesia.Hasil telaah ini menyimpulkan bahwa hukum ekonomi syariah di Indonesia tampakbelum didasari oleh tujuan dan politik hukum yang jelas. Ini merupakan resultan dari corak akomodasi pemerintah terhadap ekonomi syariah yang baru bersifat instrumental dan ad hoc. Jika hukum ekonomi syariah diharapkan semakin kuat kontribusinya terhadap ekonomi masyarakat di masa depan, ia harus digeser orientasi dan politik hukumnya, dari formalisme dan kepada pemihakan ekonomi yang jelas.
