Abstract

The issue of sex cannot be separated from human life, now days in the era of globalization, sex is not only fulfilling the needs of the desire to make out between individuals intimately or sex parties that are carried out directly. The existence of an online network that could connects a long distances allows for online sexual behavior (VCS) which performing sex scenes with tools or other part of the body by showing intimate parts of the body in front of the camera with an agreement in both way. It is not uncommon for one party to record the activity and use it as material to blackmail the other party by distributing or even selling the screen recording to online sites. This study aims to analyze the Criminal Liability perpetrators and victims considering that sex video calls were made based on an agreement in terms of Indonesian positive law, using the normative juridical method. Persoalan seks tidak bisa terlepas dari kehidupan manusia, di Era Globalisasi seperti sekarang ini seks bukan hanya pemenuhan kebutuhan hasrat bercumbu yang dilakukan secara langsung baik individu antar individu secara intim ataupun pesta seks yang dilakukan secara berkelompok. Adanya jaringan online yang menghubungkan bahkan jarak yang sangat jauh memungkinkan terjadinya perilaku seksual secara online (VCS) yaitu kegiatan telanjang ataupun melakukan adegan seks dengan alat bantu atau organ luar tubuh lainya dengan menunjukan bagian-bagian intim tubuh di hapadapan kamera dengan kesepakatan satu sama lain. Tidak jarang perilaku usil salah satu pihak merekam kegiatan tersebut dan menjadikanya bahan untuk memeras pihak lainya dengan mengancam menyebarkan atau bahkan menjual rekaman layar tersebut kepada situs online. Penelitian ini bertujuan untuk menganalisis pertanggung jawaban pidana pelaku dan korban sekstorsi mengingat video call sex dilakukan atas kesepakatan ditinjau dari hukum positif indonesia, dengan menggunakan metode yuridis normative.

Abstract

Food is one of the primary (primary) needs of humans. Food shortages can occur for various reasons, including natural and human-caused factors. For example, hoarding of food (rice) by unscrupulous traders. The Food Task Force Team of the Bali Regional Police's Special Criminal Investigation Directorate carries out routine activities such as market patrols and inspections of rice storage warehouses to curb hoarding by unscrupulous traders. Article 133 of Law Number 18 of 2012 concerning Food regulates the criminal act of hoarding or storing staple foods by food businesses. This study uses an empirical legal research method, examining the legal behavior of the community because it emphasizes field data and existing problems within the community as research subjects. The conclusion of this study is that the effectiveness of eradicating rice hoarding and violating food sanitation standards in the Bali Regional Police jurisdiction is not yet fully effective. This is due to limited monitoring facilities and infrastructure, the vast food distribution area, and low legal awareness among business actors.
