Abstract

AbstrakKebebasan mengeluarkan pendapat dimuka umum di dalam konstitusi Indonesia Undang-Undang Dasar 1945 pasca Amandemen kedua telah diatur dalam pasal 28E ayat (3) yang menyatakan:“Setiap orang berhak atas kebebasan berserikat, berkumpul, dan mengeluarkan pendapat.” Yang dimaksutkan setiap orang berhak atas kebebasan mengeluarkan pendapat dapat berbentuk ungkapan atau pernyataan dimuka umum atau dalam bentuk tulisan ataupun juga dapat berbentuk sebuah aksi unjuk rasa atau demonstrasi. Unjuk rasa atau demonstrasi dalam kenyataan sehari-hari sering menimbulkan permasalahan dalam tingkatan pelaksanaan, meskipun telah dijamin dalam konstitusi kita namun tata cara dan pelaksanaan unjuk rasa seringkali melukai semangat demokrasi itu sendiri.Kata Kunci : Demonstran, senjata tajam AbstractFreedom of expression in public in the Indonesian constitution, the 1945 Constitution after the second Amendment has been regulated in Article 28E paragraph (3) which states: "Everyone has the right to freedom of association, assembly and expression." What is meant is that everyone has the right to freedom of expression, which can be in the form of an expression or statement in public or in written form or it can also take the form of a demonstration or demonstration. Demonstrations or demonstrations in everyday reality often cause problems at the implementation level, although it is guaranteed in our constitution, the procedures and implementation of demonstrations often hurt the spirit of democracy itself.Keywords: Demonstrators, sharp weapons

Abstract

As stated in the relevant law, Mining is part or all of the stages of activity in the context of research, management and exploitation of minerals or coal which includes general investigations, exploration, feasibility studies, construction, mining, processing and/or refining, or development and / or utilization, transportation and sale, as well as post-mining activities. The research method used is a normative research method that focuses on library research to obtain secondary data from legal materials. The normative approach is carried out by reviewing the applicable provisions or laws and regulations. The results of the study show that the basis for the consideration of the panel of judges in deciding the case number Decision Number 30/Pid.B/LH/2019/PN Pti is based on the legal facts that were revealed at trial in the form of statements of witnesses, documentary evidence, and the statement of the accused associated with appropriate evidence, the elements in the article as indicted by the public prosecutor, namely Article 158 in conjunction with Article 37 of Law Number 4 of 2009 concerning Mineral and Coal Mining, all of these elements have been fulfilled.

Abstract

Salah satu bentuk kejahatan yang sering terjadi di tengah-tengah masyarakat adalah salah satunya berupa pembunuhan. Pembunuhan merupakan suatu perbuatan yang mengakibatkan hilangnya nyawa seseorang. Pembunuhan berencana atau moord merupakan salah satu bentuk dari kejahatan terhadap nyawa yang diatur dalam Pasal 340 KUHP. Permasalahan dalam tulisan ini yaitu: pertama bagaimana ketentuan hukum mengenai tindak pidana pembunuhan berencana? Dan kedua bagaimana pertimbangan majelis hakim dalam penjatuhan hukuman terhadap pelaku tindak pidana pembunuhan berencana dalam perkara putusan Nomor 519/Pid.B/2021/PN Jkt.Pst?. Metode penelitian yang digunakan adalah metode penelitian normatif yang menitikberatkan pada penelitian kepustakaan untuk memperoleh data sekunder dari bahan-bahan hukum. Pendekatan normatif dilakukan dengan cara mengkaji ketentuan atau peraturan perundang-undangan yang berlaku. Hasil penelitian menyimpulkan bahwa Rumusan delik dalam pasal 340 KUHP tentang pembunuhan berencana terdiri dari unsur Subjek (normadressaat): barangsiapa, unsur Bagian inti delik (delictsbestanddelen) yaitu  Dengan sengaja, Merampas nyawa orang lain, dan Dipikirkan/direncanakan terlebih dahulu. Unsur berikutnya ancaman pidana yaitu berupa pidana mati atau penjara seumur hidup atau selama waktu paling lama dua puluh tahun.

Abstract

This study aims to obtain information and analyze the law regarding legal protection for witnesses based on Law no. 31 of 2014 concerning Amendments to Law no. 13 of 2006 concerning the Protection of Witnesses and Victims. By using the approach method in this research is a normative juridical approach. The Witness and Victim Protection Agency (LPSK) is considered important, because the wider community views that it is time for witnesses and victims to be given protection in the justice system. The role of witnesses and victims in every trial of criminal cases is very important because often witness statements can influence and determine the tendency of judges' decisions. As an institution that was born with the main task of providing protection for witnesses and victims, LPSK has shown a track record, which, although still small, has been praised by various parties. Several protections are carried out for witnesses and victims in serious cases, from which protection then contributes to upholding the law in order to achieve justice. Law Number 31 of 2014 concerning Amendments to Law Number 13 of 2006 concerning Protection of Witnesses and Victims, in Article 1 point 3 states that: “Victims are people who suffer physical, mental and/or economic losses caused by a criminal act. Abstract

Convicted drug abusers who serve prison sentences have rights protected by human rights and the law, one of which is the granting of remission. Remission is a reduction in the period of criminal service given to Prisoners and Criminal Children who meet the conditions specified in laws and regulations. Based on the above, the problem that will be discussed in this writing is how the provisions and conditions that must be met regarding the provision of remission for prisoners convicted of committing narcotic crimes and narcotic precursors, psychotropic drugs according to applicable law. As for the research method used is a normative research method which of course focuses on literature research to obtain secondary data from legal materials. The normative approach is carried out by reviewing the provisions or applicable laws and regulations. The results of the study that the implementation of the provision of Remission for drug offenders has been regulated in Government Regulation Number 99 of 2012 concerning the Second Amendment to Government Regulation Number 32 of 1999 concerning Terms and Procedures for the Implementation of the Rights of Conditional Assisted Citizens, as stated in article 34 paragraph (2), and article 34A paragraph paragraph 1 letter a and paragraph 2.
