Abstract

The logical consequence of regional autonomy is that every regional government is obliged to improve efficiency and effectiveness in the administration of government and services to the community by utilizing regional resources. Regional taxes and regional levies, which are components of Regional Original Income (PAD), have good prospects for development. Therefore, regional taxes and regional levies must be managed professionally and transparently in the context of optimization and efforts to increase their contribution to regional income. The enactment of Law No.1 of 2022 concerning Financial Relations between the Central Government and Regional Governments, presents a restructuring or simplification of a number of regional taxes and regional levies. Regional taxes were restructured from 16 types to 14 types of taxes. Meanwhile, the object of regional retribution is simplified into 18 types of services from 32 types of services. The simplification of retribution has had an impact, especially on public service retributions, which lost 10 objects of retribution. In addition, the obligations of the Regional Government in providing public services to the community must be fulfilled. Among the many ways, the provision of public services can be fulfilled by the establishment of a BLUD. The implementation of BLUD by the Regional Government on user fees is often done. The simplification of user charges has a significant impact on the potential for PAD revenue. Moreover, many objects of public service retribution that are removed can become the basis for BLUDs as bodies that provide public services to local government delegates. The method used in this research is normative juridical, namely testing and reviewing secondary data. With regard to the normative juridical approach used, the research carried out through two stages, namely library research and field research which is only supporting. The results of the study show that the provisions related to the simplification of regional retribution by Law no. 1 of 2022 concerning HKPD, is dominated by changes in nomenclature, the abolition and addition of a number of objects of retribution. Elimination of retribution is not balanced with accountable supervision. The authority to establish BLUD is owned by the Regional Government in an attributive manner which is delegated to the UPT. The independence of BULD is reflected in the Government's desire to make BLUD a customer-oriented, not-for-profit-oriented and outcome-oriented organization. Conceptual changes and regulation of retribution have not reduced the problem of regional fiscal dependence. The simplified object of public service retribution needs to be optimized through BLUD services, in accordance with Permendagri No. 79 of 2019 concerning BLUD

Abstract

Penerapan sanksi administratif di Indonesia menghadapi berbagai tantangan, termasuk rendahnya tingkat kepatuhan, persepsi ketidakadilan, dan kurangnya efektivitas regulasi. Pendekatan tradisional yang cenderung retributif sering kali tidak mampu menciptakan penegakan hukum yang adaptif dan berkeadilan. Penelitian ini bertujuan untuk mengembangkan model sanksi administratif berbasis pendekatan partisipatif dan kolaboratif yang lebih responsif terhadap kebutuhan masyarakat dan pemangku kepentingan. Menggunakan metode penelitian hukum normatif, penelitian ini menganalisis peraturan perundang-undangan, doktrin hukum, dan praktik terbaik dari berbagai yurisdiksi melalui pendekatan perundang-undangan, konseptual, dan komparatif. Hasil penelitian menunjukkan bahwa integrasi pendekatan partisipatif dapat meningkatkan legitimasi kebijakan melalui keterlibatan masyarakat dan sektor swasta dalam proses perumusan dan implementasi sanksi administratif. Sementara itu, pendekatan kolaboratif terbukti efektif dalam memperkuat transparansi dan akuntabilitas melalui mekanisme evaluasi berbasis data dan sistem pengawasan lintas sektor. Pengembangan model yang adaptif, berkeadilan, dan akuntabel ini tidak hanya mendorong tingkat kepatuhan, tetapi juga meningkatkan kepercayaan publik terhadap sistem hukum administrasi. Implikasi penelitian ini memberikan kontribusi penting bagi pengambil kebijakan dalam merancang sistem hukum administrasi yang progresif, dengan mengedepankan inklusivitas, efisiensi, dan keberlanjutan. Rekomendasi berbasis bukti yang dihasilkan diharapkan dapat menjadi landasan dalam penguatan tata kelola hukum yang lebih demokratis dan berorientasi pada kebutuhan masyarakat modern.

Abstract

Ketidakseimbangan antara norma primer dan pengaturan teknis dalam peraturan perundang-undangan sering kali menyebabkan ketidakpastian hukum dan kesulitan dalam penerapan di lapangan. Norma primer yang terlalu abstrak atau pengaturan teknis yang terlalu rinci menghambat efektivitas hukum, menimbulkan interpretasi yang ambigu, serta mengurangi fleksibilitas dalam penerapannya. Penelitian ini bertujuan untuk mengembangkan pendekatan sistematis yang dapat digunakan dalam proses legislasi untuk menyeimbangkan kedua elemen tersebut. Dengan menggunakan metode yuridis normatif, penelitian ini menganalisis sejumlah peraturan yang ada dan mengidentifikasi ketidakseimbangan antara norma primer dan pengaturan teknis dalam legislasi. Hasil penelitian menunjukkan bahwa keseimbangan yang tepat antara norma primer dan pengaturan teknis mampu meningkatkan kepastian hukum dan memfasilitasi penegakan hukum yang lebih efektif. Pendekatan sistematis yang diusulkan dalam penelitian ini menawarkan kerangka kerja yang lebih terstruktur untuk menyaring materi muatan perundang-undangan, sehingga menghasilkan regulasi yang lebih adaptif, responsif, dan stabil di tengah dinamika sosial. Implikasi dari penelitian ini adalah perlunya reformasi dalam proses legislasi untuk meningkatkan kualitas dan konsistensi peraturan di berbagai yurisdiksi

Abstract

The bloated structure of government bureaucracy, characterized by overlapping authorities among ministries, significantly impacts inefficiency in policymaking, resource wastage, and inter-ministerial conflicts, ultimately slowing down public services and disadvantaging society. This study aims to explore the application of lean governance principles as an approach to streamline the bureaucratic structure of state ministries, focusing on waste reduction and workflow optimization. This study employs a normative juridical method with a doctrinal approach to analyze and understand the principles of lean governance in the context of efficient public administration. Data were collected through a literature review encompassing legal literature, scholarly journals, and relevant policy documents. The data analysis was conducted qualitatively using a descriptive-comparative method to assess the alignment of regulatory frameworks governing ministerial authority with the principles of lean governance. The implications of this study include the need for regulatory adjustments to support authority restructuring and enhanced information technology to improve transparency and accountability. Consistent implementation of lean governance is expected to create a more responsive and adaptive government, ultimately fostering greater public trust in the public sector.

Abstract

The public aspiration management system within Indonesia’s House of Representatives (DPR) operates without a clear framework rooted in administrative law, resulting in procedural ambiguity, weak institutional accountability, and limited meaningful public participation. The aim of this study is to analyze the normative and institutional shortcomings of the House of Representatives’ consultation system; consequently, it seeks to contribute by proposing a conceptual framework grounded in administrative law. Employing normative legal research with a conceptual and statutory approach, this study also draws on a qualitative analysis of institutional documents and academic literature. The findings revealed the absence of standardized regulations governing aspiration procedures, which rendered the system discretionary and resistant to objective evaluation. Aspirations are treated as political functions rather than administrative obligations, undermining the legitimacy of legislative representation. The study recommends institutional and regulatory reforms, including the development of standard operating procedures, a digital aspiration tracking system, and the integration of accountability principles into legislative ethical codes. These findings not only expose institutional deficiencies but also reconceptualize the DPR’s aspiration system within the framework of administrative law. A key theoretical contribution lies in extending the scope of administrative law beyond the executive branch to legislative institutions, particularly in the governance of public participation. Public aspirations are reframed as administrative rights and forms of public service rather than merely political functions. The introduction of a “limited administrative embedding” model provides a structured approach to integrating administrative principles into legislative functions without diminishing their political character.

Abstract

The principle of non-refoulement is traditionally associated with Article 33 of the 1951 Refugee Convention, yet contemporary displacement increasingly occurs outside the classical refugee framework. In addition to persecution and armed conflict, people may be forced to move because of environmental degradation, climate-related disasters, ecological vulnerability, loss of livelihood, and conditions that threaten human dignity and survival. This article examines how non-refoulement develops beyond the Refugee Convention, particularly in relation to environmental displacement and the limits of State sovereignty. It addresses three research questions: how non-refoulement operates under customary international law and international human rights law; to what extent its core content may be linked to jus cogens; and how it limits State discretion in migration control, environmental governance, and protection of displaced persons. This study uses normative legal research with statutory, conceptual, and case-law approaches. It examines international treaties, human rights instruments, environmental law principles, peremptory norms, judicial decisions, and recent scholarship on externalized migration control and climate-induced displacement. The findings show that non-refoulement functions as a multi-source obligation through three layers: the customary baseline binding all States, the human rights non-derogability layer protecting all persons from irreparable harm, and the jus cogens core prohibiting removal to peremptory violations such as torture, genocide, slavery, and crimes against humanity. The article contributes by formulating a three-layer normative convergence test and by linking non-refoulement to environmental displacement, sustainable development, and the legal limits of sovereignty.
