Abstract

Abstract: A good policy is certainly the result of a good public policy formulation process. But the good policy does not necessarily achieve its objectives if the implementation process is not done well. Therefore, it succeds or not a public policy achieves its goals or objectives, it depends on the implementation process. Similarly, with the development policy of Integrity Zone or “Zona Integritas”, policies taken by the government to raise bureaucratic reforms to make public service work better. But if it is not implemented well, it would be difficult to achieve its goals. Abstrak: Sebuah kebijakan publik yang baik tentunya hasil dari sebuah proses perumusan kebijakan publik yang baik. Namun kebijakan publik yang baik itu, belum tentu mencapai tujuannya jika proses implementasinya juga tidak dilakukan dengan baik. Oleh karena itu, berhasil tidaknya sebuah kebijakan publik mencapai sasaran atau tujuannya, sangat tergantung pada proses implementasinya. Demikian halnya kebijakan pembangunan Zona Integritas, kebijakan yang diambil oleh pemerintah untuk mengakselari refomasi birokasi agar kinerja pelayanan publik semakin membaik. Tetapi jika tidak diimplementasikan dengan baik, maka sulit berharap akan berhasil mencapai tujuannya

Abstract

Children have the right to the protection of their constitutional rights, such as guaranteeing laws and regulations that are pro-child rights. Because the direction of legal policy aims to make law a rule that provides protection for the rights of citizens and guarantees the lives of future generations. The formulation of the problem in this research is How is the educative punishment system for children as criminals in Indonesia today? and 2. How is the educative punishment system in the future appropriate for children as perpetrators of criminal acts?. The research method used is this method is used juridical normative emphasizing on the science of law and the study of legal rules that apply in society related to the criminal system against children as perpetrators of criminal acts. The specifications used in this research are analytical descriptive, because this research is expected to obtain a clear, detailed and systematic picture. The legal materials used are primary, secondary, and tertiary legal materials. Analysis of qualitative descriptive legal materials. The results showed that child protection law is a legal subsystem and the purpose of criminal law, which includes a basic understanding of the principles of criminal law such as territorial principles, active personal principles, passive personal principles, universality principles, fictitious principles, and others. There are two legislative steps taken to protect children involved in criminal acts, namely Law Number 11 of 2012 concerning Juvenile Courts and Law Number 12 of 1995 concerning Corrections.An educational punishment system that is appropriate in the future for children as perpetrators of criminal acts is not given criminal sanctions by placing children in prison. The provision of educational sanctions must be the main consideration for judges in imposing sanctions, such as placing children in special schools that can place children as individuals who must receive guidance both morally and intellectually. The government should have started to seriously implement Restorative Justice, because this is an alternative for juvenile justice in Indonesia that prioritizes a welfare approach and a justice approach.

Abstract

The Covid-19 pandemic has affected the way of policing due to social restrictions, but then gathering and expressing opinions in public cannot be prevented, because this is a part of human right. Crowd control during the pandemic, one of which was escorting community convoys, then became a challenging task for the police. This paper aims to analyze the application of police discretion in escorting community convoys during the Covid-19 pandemic. Qualitative methods were used in the development of this research, by conducting literature studies and interviews in collecting data. The analysis in this study is based on discretionary theory and procedural justice theory. The results of the analysis show that currently policing is shifting to adjust to pandemic conditions, one of the important elements is the expansion of the police's discretionary authority in handling pandemics in the field related to law enforcement, especially regarding social restriction policies. This discretion then needs to be applied in public order management and crowd control. The way that the police can do in crowd control is to develop intense communication with the community to create dialogue-based solutions that the community will voluntarily comply with. The implementation of escorting community convoys in the jurisdiction of Polda Metro Jaya shows that the police who carry out escorts are still unable to apply discretion properly, causing discriminatory discretion and non-function discretionary deviations. This then causes public doubts about the ability of the police to exercise discretion in order to achieve justice

Abstract

This comprehensive study examines the complex phenomenon of air pollution in Indonesia, providing insights into various aspects such as current conditions, the policy framework, and potential strategies ahead. By conducting a comprehensive review of relevant literature and employing novel methods to analyze Google Trends data, a meticulous examination of prevailing themes and public inquiries is revealed. Significantly, there is an increasing societal awareness of air pollution's condition, effects, and regulation, especially in urban cities, in August 2023. This study not only highlights the current difficulties but also delves into potential lessons learned by other countries and provides valuable suggestions. This paper makes a valuable contribution to the field of air pollution mitigation policies and environmental management. This study provides policymakers, industries, and communities with a comprehensive framework to address air pollution problems. This comprehensive study allows relevant stakeholders to adopt strategies that lead to a more environmentally sustainable Indonesia.

Abstract

Penelitian ini didasarkan pada tingginya angka pelanggaran lalu lintas selama kampanye Pilkada 2015 di Surakarta, yang disebabkan oleh rendahnya kesadaran berlalu lintas di kalangan masyarakat terutama pada masa kampanye. Makalah ini juga membahas teori kegiatan rutin, yang menjelaskan kondisi-kondisi di mana tindak pidana dapat terjadi. Tidak adanya penjaga yang cakap, target yang sesuai, dan pelaku yang termotivasi adalah tiga elemen kunci yang dapat menyebabkan tindak pidana menurut teori ini. Artikel ini membahas efektivitas penindakan pelanggaran lalu lintas dalam mewujudkan keselamatan dan ketertiban berlalu lintas selama kampanye Pilkada di Surakarta. Penelitian ini menggunakan pendekatan kualitatif dengan teknik pengumpulan data berupa wawancara, observasi, dan pencermatan dokumentasi. Hasil penelitian menunjukkan bahwa Satuan Lalu Lintas Polresta Surakarta perlu meningkatkan penindakan pelanggaran lalu lintas selama masa kampanye Pilkada. Penelitian ini juga membahas teori aktivitas rutin yang menjelaskan kondisi di mana tindakan kriminal dapat terjadi. Penelitian ini memberikan rekomendasi bagi lembaga penegak hukum dan pembuat kebijakan untuk meningkatkan keselamatan berlalu lintas dan efektivitas penegakan hukum selama kampanye Pilkada.

Abstract

The Indonesian National Police (INP) should become a professional, credible, accountable, transparent based on the principles of Democratic Policing. This research uses qualitative approach with case study as a research method which uses sources such as documents, books, and other related literatures. From several evaluation research show that there are lots of efforts for organisational transformation which experience failures although the INP have chosen many strategies, planning and resources as well as strong administrative commitments. Threats to the success of transformation within the organisation may emerge whether from the inside or outside. The political will in a bureaucratical field and willingness of the public which is the initiative and capability to support the INP's transformation becomes the primary key in actualising the INP that is Presisi. It is a utopia if the transformation of the INP in becoming an ideal national police comes solely from internal INP efforts. This research's recommendations are: the public must be involved actively in all processes of transformation, the need to strengthen organisational culture, moral and ethics of police, the empowerment of human resources which are based on science, and the process of transformation must be followed through continuous monitoring and evaluation.

Abstract

The rapid development of information and communication technology in the digital era has significantly impacted public communication, especially through the use of social media by the Public Relations Division of the Indonesian National Police (Divhumas Polri). This study aims to analyze the effectiveness of the Intelligence Socio Analytic (ISA) used by Divhumas Polri during the 2024 Ketupat Operation in monitoring and understanding public sentiment across various social media platforms. The methodology employed is qualitative descriptive, using secondary data analysis from daily ISA reports. The findings indicate that Polri's communication strategy through social media effectively increased public positive sentiment, although challenges such as misinformation and traffic congestion still influenced some negative public perceptions. In conclusion, ISA's application by Divhumas Polri proved effective in managing public communication and maintaining societal opinion stability during the Ketupat Operation period.
