Abstract

Intellectual property is interesting to study since it has a very important role in the advancement of the economy in this era of globalization. Intellectual Property Rights (IPR) are rights that arise from the results of the human brain's thinking that produce a product or process that is useful for the community. IPR includes intangible movable objects as regulated in article 499 of the Civil Code. This intangible object is the result of human thought and the object of ownership is a movable object that can be transferred to another party so that it can be used as a fiduciary guarantee as regulated in Law no. 13 of 2016 concerning Patents (Patent Law). Article 108 paragraph 1 states that "Patent rights can be used as objects of fiduciary guarantee". However, patent rights as objects of fiduciary guarantee in a bank's loan practice are currently unavailable due to obstacles in its implementation. There is no special Asset Appraisal Agency that assesses the economic value of patent rights so that it can be used as a credit guarantee. This makes it difficult for patents to be used as a fiduciary guarantee. To realize patents as objects of fiduciary guarantee, firm and detailed juridical support is needed regarding IPR assets as objects of bank credit guarantees. The valuation of patented assets must be supported by the Patent Regulations protected by the Bank Loan Guarantee and the need for legal access under the Bank Indonesia Regulations to support the patents that are protected by the Trustee Guarantee. So there should be an appraisal agency that can assess a patent right so that it can improve the people's economy and advance the national economy.

Abstract

ABSTRAKWanprestasi adalah suatu sikap dimana seseorang tidak memenuhi atau melalaikan untuk melaksanakan kewajiban sebagaimana ditentukan dalam perjanjian yang dibuat antara penjual dan pembeli. Wanprestasi merupakan salah satu risiko yang harus dihadapi oleh para pihak yang terlibat dalam perjanjian, apalagi perjanjian tersebut menyangkut uang. Jadi dapat disimpulkan, pengertian wanprestasi adalah perbuatan ingkar janji oleh salah satu pihak dalam perjanjian di atas meterai sebagai akibat dari kelalaiannya sehingga tidak dapat memenuhi kewajibannya. Menurut Pasal 1457 KUH Perdata, jual beli adalah suatu perjanjian dimana satu pihak mengikatkan dirinya untuk menyerahkan suatu barang dan pihak lain membayar harga yang dijanjikan. Pokok permasalahan adalah bagaimana proses terjadinya wanprestasi dalam perjanjian jual beli sofa, dan apakah pertimbangan hukum majelis hakim dalam memberikan putusan dalam perkara wanprestasi sudah sesuai dengan hukum yang berlaku. Dalam penulisan penelitian ini, penulis menggunakan jenis penelitian yuridis normatif, dalam penelitian hukum normatif hanya bahan pustaka atau data sekunder dapat juga meliputi bahan hukum primer dan tersier. Hasil penelitian adalah hakim memutuskan untuk mengabulkan sebagian gugatan penggugat yaitu menyatakan tergugat wanprestasi dan menghukum tergugat untuk segera melunasi utangnya / sejumlah Rp. 231.000.000 (dua ratus tiga puluh satu juta rupiah) lebih rendah dari gugatan penggugat bahwa tergugat membayar utangnya sebesar Rp. 792.000.000 (tujuh ratus sembilan puluh dua juta rupiah). Dengan demikian putusan hakim sudah sesuai dengan fakta hukum dan sesuai dengan rasa keadilan masyarakat dalam hal ini keadilan penggugat dan tergugat. Kata Kunci : Wanprestasi,  Perjanjian, Penyelesaian ABSTRACTDefault is an attitude where a person does not fulfill or neglects to carry out obligations as specified in the agreement made between the seller and the buyer. Default is one of the risks that must be faced by the parties involved in the agreement, especially since the agreement involves money. So it can be concluded, the definition of default is an act of breaking a promise by one of the parties in the agreement on a stamp duty as a result of his negligence so that he cannot fulfill his obligations. According to Article 1457 of the Civil Code, buying and selling is an agreement in which one party binds himself to deliver an item and the other party pays the promised price. The main problem is how the process of default occurs in the sofa sale and purchase agreement, and whether the legal considerations of the panel of judges in rendering a decision in a default case are in accordance with applicable law. In writing this research, the authors used normative juridical research. In normative legal research, only library materials or secondary data may also include primary and tertiary legal materials. The results of the study were that the judge decided to grant part of the plaintiff's lawsuit, namely declaring the defendant in default and punishing the defendant to immediately pay off his debt / in the amount of Rp. 231,000,000 (two hundred and thirty one million rupiah) lower than the plaintiff's claim that the defendant paid his debt of Rp. 792,000,000 (seven hundred ninety two million rupiah). Thus the judge's decision is in accordance with legal facts and in accordance with the sense of justice in society, in this case the justice of the plaintiff and the defendant. Keywords: Default, Agreement, Settlement

Abstract

This research explores the transplantation of laws, especially how the process of adopting foreign laws into the Indonesian legal system faces challenges in the era of modernization, which often clashes with the norms that exist in society. Legal transplantation means the transfer of the legal system from one country to another with different social contexts and legal systems, a phenomenon that is increasing as globalization progresses. Many countries adopt foreign laws to accelerate legal reform and meet international standards, but this process is not without its challenges. This often raises legal political problems, including the potential threat to national legal identity. The selection of foreign laws that are not careful can have a bad effect on our current legal system. In this study, readers are invited to understand the importance of legal political challenges and the transplantation of foreign laws that are included in our national law.
