Abstract

The development and progress of technology is very rapid, making everything now easier, including accessing the internet. The economy is one of the many fields that are experiencing rapid development as a result of technological developments, investment is no exception. One investment that is currently being discussed is the binomo platform. But in reality, binomo is not an investment but a platform that provides binary options services for potential investors. Juridically, the validity of futures contracts on the Binomo platform contradicts several articles in the Civil Code. The purpose of the research is to understand how the validity of futures contracts on the binomo platform is reviewed from the Civil Code. The research method is normative juridical research, namely research that is only aimed at written regulations, so this writing is closely related to libraries, because it will require secondary data from libraries that support the subject matter discussed and the laws and regulations. The results of the study, the validity of the futures contract on the binomo platform in terms of the Civil Code is contrary to several articles in the Civil Code, when referring to the legal terms of the agreement in article 1320 of the Civil Code, binomo does not meet when viewed from the 3rd legal requirement, namely a certain thing and the third legal requirement. 4, namely the legal causes of law.

Abstract

Perkembangan teknologi informasi membawa peluang sekaligus tantangan. Salah satu tantangannya adalah kemudahan distribusi produk digital yang melanggar hak cipta. Manga adalah salah satu karya berhak cipta yang didistribusikan secara ilegal dalam jumlah banyak. Efek dari pemyebaran scanlation (pembajakan) masih diperdebatkan. Manga telah menjadi objek pelanggaran hak cipta digital oleh para penggemarnya di seluruh dunia selama bertahun-tahun. Kegiatan fansubbing dan scanlation menciptakan kerugian ekonomi yang sangat besar bagi Jepang setiap tahunnya. Penelitian ini bertujuan untuk memaparkan legalitas manga-scanlation pada situs mangaku.live menurut perspektif Udang-undang nomor 28 tahun 2014 tentang Hak Cipta mengetahui perlindungan hukum hak cipta manga-scanlation yang diunggah oleh situs mangaku.live tanpa izin pencipta, dan upaya perlindungan hukum yang dapat dijalankan oleh pemilik hak cipta. Metode penelitian yang digunakan meliputi penelitian kepustakaan yuridis normatif yang fokus kepada kaidah – kaidah hukum berlingkup pada bahan hukum“UURI no. 28 tahun 2014 tentang hak cipta. dan penelitian dengan mengamati beberapa situs manga-scanlation. Hasil dari penelitian menunjukkan bahwa semuamanga-scanlation yang terdapat pada situs online mangaku.live illegal (tidak berlisensi) dan merupakan pelanggaran Hak Cipta yang berupa pembajakan. UU Hak Cipta berperan  dalam melindungi hak dan kewajiban pencipta antara lain mengatur dengan tegas hak Pemegang Hak Cipta, lisensi, tindakan terhadap pelanggaran Hak Cipta pada media komunikasi elektronik (internet), dan tindakan penyelesaian sengketa melalui pengadilan (perdata dan pidana).

Abstract

Penelitian ini bertujuan untuk mendeskripsikan tentang keabsahan perjanjian melalui aplikasi Tik Tok Cash. Tik Tok Cash hadir ditengah masyarakat sebagai solusi dalam keuangan masyarakat yang dapat meningkatkan keuangan masyarakat dalam waktu yang singkat. dalam penelitian kali ini peneliti menggunakan pasal 1320 KUHPerdata sebagai acuan dalam melihat keabsahan perjanjian. pengumpulan data, dan analisis dilakukan dengan metode kualitatif dengan pendekatan deskriptif -yuridis normatif. Hasil penelitian, keabsahan perjanjian pada aplikasi TikTok cash ditinjau dari KUHPerdata bertentangan dengan beberapa pasal pada KUHPerdata, Apabila mengacu kepada syarat sah perjanjian pada pasal 1320 KUHPerdata, TikTok cash tidak memenuhi jika ditinjau dari syarat sah yang ke 3 yaitu suatu hal tertentu dan syarat sah yang ke 4 yaitu kausa hukum yang halal. Peneliti menemukan bahwa dalam melihat keabsahan hukum perjanjian TikTok cash di Indonesia bisa dikatakan tidak sah karena tidak memenuhi syarat sah perjanjian di Indonesia.

Abstract

A price fixing agreement is an agreement practice entered into by companies in the same industry to fix prices for goods/services together in the relevant market. Price fixing agreements on air freight rates have a negative impact on business competition, especially for consumers who use air transport services. This study aims to determine the form of price fixing agreement practices on air freight rates and the form of legal protection for consumers against price fixing agreements on air freight rates. This research uses normative legal research methods through literature study. The results of this study indicate that business actors who enter into price fixing agreements to increase the price of airplane tickets beyond the specified tarif limit have violated the provisions of business competition law, which can harm consumers. The legal protection provided to consumers in the form of preventive legal protection and repressive legal protection depends on the jurisdiction and the applicable legal framework.

Abstract

A halal certificate is a statement letter on the halalness of a product issued by an authorized institution whose legitimacy has been ascertained, the large number of frauds committed by business actors for counterfeiting the halalness of their products causes threats to the rights that consumers should receive. As a form of protection for consumer rights, the government has established provisions that are currently in effect, namely Law no. 08 of 1999 concerning Consumer Protection. With the existence of this consumer protection law, it will have an impact on the welfare and peace of Muslim communities wherever they are. The results of the research are expected to raise awareness among business actors how important halal certificates and halal labels are for Muslims and non-Muslims alike. Based on this research, it can be concluded how the law regarding consumer protection regulates and protects consumers who feel disadvantaged by the actions of irresponsible business actors who only think about big profits without thinking about what impact they will get. The approach method used in this study is a normative approach, a normative approach is an approach that is carried out by observing problems by analyzing norms, regulations that apply, and based on circulating news. Looking at the rules provided by law regarding consumer protection, how is the responsibility that should be given by someone as a business actor for losses received by consumers for the products they distribute and what actions consumers must take to be careful in reading and listening to information regarding the halalness of the product they will consume or use.

Abstract

The principle of freedom of contract, as regulated in Article 1338 paragraph (1) of the Indonesian Civil Code, affirms that legally formed agreements bind the parties as law. This principle grants contractual autonomy to determine the formation, parties, and content of agreements, provided they do not violate statutory law, public order, or morality. However, such freedom is limited by the principles of good faith, fairness, proportionality, and the protection of weaker parties.The development of blockchain technology has introduced smart contracts as automatically executed electronic agreements based on pre-programmed code. Legally, smart contracts may be considered valid contracts insofar as they fulfill the requirements of Article 1320 of the Indonesian Civil Code and comply with the Law on Electronic Information and Transactions. Digital consent, such as authorization through a digital wallet, constitutes a legitimate expression of agreement.Smart contracts represent a modern manifestation of freedom of contract by enabling automated performance without third-party intervention, reflecting the prior intention of the parties embedded in blockchain-based code. Their application on platforms such as Stellar Lumens (XLM) demonstrates practical implementation in cryptocurrency transactions. Nevertheless, legal challenges remain, including regulatory gaps, transaction anonymity, technological inequality, and potential imbalances in bargaining power. Therefore, adaptive legal regulation is essential to ensure legal certainty, fairness, and effective legal protection.
